AFFIDAVIT OF CLAIMANT

I, DARWIN BINGAYEN ALCANTARA, of legal age,

Filipino, married, with address at Junction Luna, Abulug,
Cagayan, after having been sworn in accordance with law, hereby
state that:

1. I am the owner of ALCANTARA COMMERCIAL, DB

ALCANTARA AGRI SUPPLY and DB ALCANTARA
AGRI CONST SUPPLY (“Alcantara”) all located at
Libertad, Abulug, Cagayan;

2. Defendant Peter Ganaden (“Peter”) of legal age. married,

with address at Quirino Luna,Apayao;

3. ALCANTARA COMMERCIAL, DB ALCANTARA AGRI

SUPPLY and DB ALCANTARA AGRI CONST SUPPLY is
engaged in the trading business of agricultural products
and construction supply;

4. Between January 1, 2013 to March 11, 2013 Peter started

purchasing construction supplies with Alcantara through
credit;

5. Peter made partial payments but failed to settle the

principal amount of his purchases before due dates. As a
consequence, the balance of his credit incurred
surcharges of 3% per month and ballooned to One
Hundred Twenty Four Thousand One Hundred Seventy
One Pesosand Twenty One Centavos (P124,171.21);

6. A Statement of Account in the amount One Hundred

Twenty Four Thousand One Hundred Seventy One Pesos
and Twenty One Centavos (P124,171.21) dated 8 April
2016 is hereto attached to the complaint marked as
Annex “A”;

7. A demand letter was sent to Peter on 23 February 2018

through mail with registry receipt ED 402 103 794 ZZ. A
copy of the registry return receipt is hereto attached as
“Annex B”;
 8. To date the demand for payment seemed to have fallen on
deaf ears as no payment was made at all.

I am executing this affidavit to attest to the truth of the

foregoing facts and for the purpose of filing the small claims
complaint against Peter Ganaden.
