Dear Ms. Whitaker:

You recently requested the opportunity to inspect or obtain copies of the results of Hannibal Police
Department’s “investigation results surrounding the Hannibal Board of Public Works” pursuant to
Missouri Revised Statutes § 610.023 et seq. Additionally, you requested copies of the results of
the “second internal investigation surrounding HBPW.”

The referenced Hannibal Police Department’s investigation was an investigation into personnel
matters and was not a criminal investigation. The contents of the “results” of that personnel
investigation are closed and not being produced pursuant to Missouri Revised Statute § 610.021
(3) and §610.021 (13). These statutes permit a public body to withhold records concerning the
“hiring, firing, disciplining or promoting of particular employees by a public governmental body
when personal information about the employee is discussed or recorded” and concerning
“individually identifiable personnel records, performance ratings or records pertaining to
employees…”

Because the “investigation” by the Hannibal Police Department was an internal affairs
investigation into a personnel matter for which employees were subject to potential discipline
and/or termination and because it included employees’ personnel records, these results are being
withheld.

The second internal investigation surrounding HBPW is also being withheld pursuant to Missouri
Revised Statute § 610.021 (1), which permits a public body to withhold records concerning “legal
actions, causes of action or litigation involving a public governmental and any confidential or
privileged communications between a public governmental body or its representatives and its
attorneys.”
