TOPIC: Union between man and woman
FACTS: the petitioner filed a petition in the RTC to change his name and sex. The petitioner
alleged that he is “anatomically male but feel, thinks and acts as a female”; therefore, he
transformed himself into a woman thru sex realignment and from then on lived as a woman and
was in fact engaged to be married and then sought to change his sex and name in his birth
certificate.
Petitioner’s Argument (Rommel Silverio- Won): On the scheduled initial hearing, there was no
opposition to the petition and during the trial the petitioner testified for himself and presented his
doctor and fiancée as witnesses. The petitioner filed the said petition to align his birth records to
his present sex.
Respondent’s Argument (Republic- Silent): during the scheduled initial hearing, there was no
opposition to the petition.
Issue: W/N petitioner is entitled to the relief asked for.
FINDINGS OF THE Lower Court: the petitioner’s petition is granted.
FINDINGS OF THE CA: N/A
Ruling: The court rules in the affirmative:
Firstly, the court is of the opinion that granting the petition would be more in consonance with the
principles of justice and equity.
Likewise, the court believes that no harm, injury or prejudice will be caused to anybody or the
community in granting the petition. On the contrary, granting the petition would bring the much-
awaited happiness on the part of the petitioner and her fiancé and the realization of their dreams.
Finally, no evidence was presented to show any cause or ground to deny the present petition despite
due notice and publication thereof.
Wherefore, the court granted the petitioner to change his name and sex in his Certificate of Birth.
