SUBJECT: DISTRICT 3 CODE COMPLIANCE ISSUES

On September 7, 2019, After-Hours Supervisor Trelana Haines and I met Commissioner Carollo
and Jose Suarez from his staff at the MRC to participate in a ride-along in the Commissioner’s
District. The purpose of this ride-along was for Commissioner Carollo to point out a number of
reportedly persistent Code Compliance violations that occur mainly at night and on the weekends
that he feels have gone unaddressed. Commissioner Carollo has given similar tours of District 3
to City Manager Emilio Gonzalez, Deputy Manager Joe Napoli, and former Code Compliance
Director, James Bernat.

We met at 10:45 pm and finished at approximately 1:00 am. No tickets or Notices of Violation
were issued. All issues were observed from within the vehicle. The main Code Compliance issues
observed included potential: parking on unimproved surfaces, storage of inoperable/untagged
vehicles, parking lots without striping, drainage, or lighting, façade violations, failure to maintain
the exterior of a commercial property, parking of commercial vehicles in residential zones, noise
violations, mingling, failure to maintain a vacant lot, restaurants operating outside of the scope of
their Certificate of Use, illegal dumping, outside storage, failure to maintain fences,
nonconforming signs, and outdoor seating without a warrant.

Issues that will be referred to the Police Department: apparent prostitution, traffic violations,
particularly, valet parking and ride-sharing services impeding/stopping the flow of traffic on 7th
and 8th Street to load and unload patrons of local bars and restaurants, patrons obstructing the
sidewalk.

Issues that will be referred to the Fire Department: alleged establishments over their occupancy
loads.

We began by driving West on 7th Street from SW 2nd Avenue. The Commissioner pointed out
several common illegal dumping sites, a number of lots where valet operations park cars on the
grass of apparent residential lots. We continued West to SW 27th Avenue, then returned, driving
the length of District 3 along SW 1st Street, SW 8th Street, Flagler Street, and NW 7th Street. We
also drove North on SW/NW 17th Avenue and SW/NW 12th Avenue until the Miami River.

Supervisor Haines will follow-up in assigning the issues we observed for investigation. Below is
a list of the addresses I was able to capture during the drive and the associated potential
violations:
• Potential illegal parking next to 1773 SW 8th Street (no lighting).
• Across from 1761 SW 7th Street – Potential illegal valet parking on unimproved residential
lots
• 5th Street and SW 17th Avenue – Bar check request – potential obstruction of sidewalk,
operating outside of the scope of the Certificate of Use
• 140A SW 16th Avenue – Bar check request - potential obstruction of sidewalk, operating
outside of the scope of the Certificate of Use
• 466 SW 17th Avenue – Bar check request - potential obstruction of sidewalk, operating
outside of the scope of the Certificate of Use
• 328 SW 17th Avenue – Bar check request - potential obstruction of sidewalk, operating
outside of the scope of the Certificate of Use
• 1120 NW 2nd Street – Potentially commercial vehicles in a residential zone, parking on
unimproved surfaces, outside storage
• 515 NW 12th Avenue – Bar check request – potentially operating outside of the scope of the
Certificate of Use
• 1137 NW 1st Street- Potentially commercial vehicles parked on unimproved surfaces in a
residential zone
• 140 NW 8th Avenue – Potential façade violations, failure to maintain the exterior
