THIRD PARTY CLAIM
I, Juan Santos, of legal age, single, resident of Ateneo
Avenue St., Naga city, having sworn in accordance with law, depose and say that:
I am the true, lawful, and absolute owner of that certain
property, now in possession of Spouses Jose Matapang and presently being levied upon and more particularly describe as follows:
A parcel of land of P3,518 square meters situated in the
Sta., Cruz, Mangga St., Naga City now covered by TCT No. T 30,762.
The property covered by T.C.T. No. T-159703 located in
Sta., Cruz, Mangga St., Naga City was mortgaged by the spouses Matapang to Juan Santos on 14 April 2017 as security for the payment of a loan of P1,000,000.00. For failure to comply with the conditions of the mortgage, Spouses Manalo extra-judicially foreclosed the mortgage and the land was sold at a sheriff's sale held on 25 November 2018, Jose Manalo as purchasers thereof. Consequently, TCT No. T-159703 was cancelled and TCT No. T-30,762 was issued in the name of Jose Manalo.
That the value of the above-described property is One million
PESOS (P1,000,000.00); That I hereby claim said property as my own, being entitled to its ownership and possession.
