years old, married, JONHPAUL ANJAN 32 years old ,married ,CIREL MAQUING 33 years old
single and residing BARANGAY ALFONSO XIII QUEZON PALAWAN was arrested by elements of
Palawan provincial office, Anti-illegal drugs special operation task group led by SPO2 LIEZEL
C BATULAN under the supervision of PSSUPT Jinbert Azuelo . acting provincial director,
Palawan for violation of sec 5, article II of RA 9165 at DENR compound , BARANGAY ALFONSO
XIII QUEZON PALAWAN.
2. our police officer who served as a poseur buyer purchased from the subject one (3) heat
sealed transparent plastic sachet containing methamphetamine hydrochloride( shabu)
amounting of 3,000.00 pesos
3.after the buy-bust operation , the team conducted body search to the suspect in the
presence of barangay captain Mark Anthony Cabanag and Barangay Kagawad Arman
Quijano at said place and was able to covered the following evidence to wit;
a. one (3) heat sealed transparent plastic sachet containing POWDER substance also
known as SHABU with estimated market value of P300,000.00 pesos.
b. one (1)pack of ciggarrete containing fifteen (15) stick :and
c. cash amounting to 10,000.00 including 100 pesos bill marked with MAM used as buy-
bust operation.
4. arrested subject person and recovered evidences was brought before this office for
proper disposition and criminal charges against the suspect for violation of sec 5, article II
and sec II of RA 9165 is being prepared by this office subject for inquest proceeding.

4. To determine if the respondent Michael Y Cantiga, Jonhpaul anjan, Cirel Maquiling are liable for
violation of section 5 and 11 of republic act 9165 (comprehensive dangerous drugs act of 2002)
FACTS OF THE CASE
5. On FEBRUARY 22 at about 10 AM in the morning , Palawan Police provincial office, anti-illegal

drugs special operations task group led by SPO2 LIEZEL BATULAN ,under the supervision of PSSUPT
JINBERT AZUELO acting provincial director , Palawan PPO together with PADAC –PALAWAN and in
coordination of with QUEZON MPS , quezon ,Palawan an anti-illegal drugs operation (by-bust)at
DENR compound , barangay alfonso XIII, Quezon, Palawan which resulted to the arrest of
Mchael Cantiga, 42 years old, Jonhpaul anjan ,32 years old, Cirel Maquiling 33 years old and
resident off the same locality.
6. Relatedly , during the conduct of said operation, our police operative PO1 MARK ONG together
with confidential agent acted as poseur buyer and therein they purchased from the subject cirel
maquiling one (1) heat sealed transparent plastic sachet containing white crystalline to be shabu
amounting five thousand pesos 5,000.00. Moreover, after the by bust operation the team
conducted body search to the suspect in the presence of barangay captain arman quijano and
barangay kagawad mark Anthony cabanag at the said place and was able to recovered from the
possession control and custody of the and was able to recovered from the possession control and
custody of the suspect of the following items to wit;
a. one heat sealed transparent plastic sachet containing white crystalline substance believed to be
shabu marked with CM-01 estimated market value of P5,000.00
b. one(1) pack of Winston cigarette containing of suspected marijuana leaves wrapped in a piece
of paper marked with DLU-02;
c. cash amounting of Php. 3650.00 including the two (2)five hundred peso bills and one (1)
thousand peso bills marked money DLU at the upper rightmost portion used as buy bust money;
and
d. one (1) lighter marked with DLU-03
DISCUSSION
7. At about 10 am o’clock same date, team of PAIDSOTF led by SPO2 LIEZEL BATULAN under the
supervision of PSSUPT JENBERT AZUELO ., together with personnel of PADAC conducted briefing
and planned for anti-illegal Drugs operations against cirel maquiling , and there at PO1 mark Ong
designated poseur buyer ,PO1 MARK ONG as arresting officer and PO3 CHERLYN REPASO as
photographer. After the briefing, more or less 7:30 PM of same date the team left Puerto Princesa
City on board private vehicle bound for quezon , Palawan to launch possible anti-illegal drugs
operations against the subject (cirel maquiling )
8. That about 7 am in the morning , the team arrived at quezon , Palawan and meet our
confidential agent and discus the decided to planned for anti-illegal drugs operations against the
subject, and afterwards , coordadination with quezon municipal police station was made by the
under signed and like wised the PRE-OPERATIONS REPORT was forwarded to PDEA 4-B Regional
office;
9. The transaction between to our confidential agent and mark ong was on going and later agent
received a phone call from cirel maquiling informing that they will meet at DENR Compound ,
barangay alfonso XIII, quezon , Palawan.
10. At about 9 am time PO1 MARK ONG and our confidential informant proceeded at the agreed
place of transaction , and at around 10 am time FEBRUARY 22 2017 PO1 mark ong and
confidential agent arrived at the said place and after a few minutes the transaction was ended ,
and at that juncture PO1 ong gave the pre-arranged signal removed his head gear(bonnet), and
immediately the team approached the subject and arrest was executed by PO2 leizel batulan
11. This case requires no further argumentation as to determine the criminal liability of the subject
person wherein the result of the examination to the sachet containing white crystalline substance
conducted by Palawan Provincial Crime laboratory office is positive and likewise subject person
resulted positive on drug test screening
V.CONCLUSION
12. Premises considered that, cirel maquiling had evidently violated section 5 and 11, Article II of
republic act 9165 otherwise known as (Comprehensive Dangerous Drugs act of 2002)
VI.RECOMENDATION:
13. It is recommended that case for violation of section 5 and 11, article II, of republic act 9165
(Comprehensive dangerous Drugs act of 2002); be filled against the respondent subject CIREL
MAQUILING.

1. Please be informed that around 10 AM time of FEBRUARY 22 2017 date one CIREL MAQUILING
subject 33 years old married and residing at alfonso XIII, quezon , Palawan was arrested by elements of
Palawan provincial office, anti-illegal drugs special operation task group led by spo2 liezel batulan under
the supervision of PSSUPT JENBERT AZUELO , acting provincial director , Palawan PPO together with
PADAC-PALAWAN and in coordination with QUEZON MPS, Quezon Palawan for violation of sec 5, article II
of RA 9165 at DENR Compound BRGY.ALFONSO XIII QUEZON Palawan.
2. Our police officer who served as a poseur buyer purchased from the subject one (1) heat sealed

3. After the by bust operation , the team conducted body search to the suspect in the presence of
barangay captain MARK ANTHONY CABANAG and barangay kagawad ARMAN QUIJANO at the
said place and was able to recovered the following evidence to wit;
a. one (1) heat sealed transparent plastic sachet containing white crystalline substance also
known as shabu with estimated market value of P5,000.00 pesos
b. one (1) CIGARRETE wrapped in a piece of paper; and
c. cash amounting of P3,650.00.

disposition and criminal charges against the suspect for violation of SEC 5 article II and section 11,of RA

SUBJECT : FINAL REPORT ON VIOLATION OF RA 9165
1. Reference: accomplishment report on violation of RA 9165 dated FEBRUARY 22 2017.

2. In consonance with the above reference, on FEBRUARY 22, 2017 criminal charges for
violation of article II of RA 9165 against CIREL MAQUILING was filed before the Palawan
Provincial prosecutor Office through inquest proceeding under NPS NOS.IV-08-INQ-15E-
0081,and said cases was resolved by associate provincial prosecutor MARK LEDESMA. Further,
the said case was transmitted to the RTC-Clerk of court for resolution and issuance of jail
commitment order.
3. Furthermore, said accused was transferred to the Palawan Provincial jail management as
per order issued by Hon. Judge SHAIRA CLEMENTERA, presiding judge judge RTC Branch 48
under criminal case no.30892 for violation of section 5 and criminal case No.308993 for
violation of section 11.

Na ako si SPO2 LEIZEL C. BATULAN PNP, nasa wastong gulang, kawani ng Philippine
national policeat kasalukoyang nakatalaga sa Palawan police provincial office PAIDSOTF
tiniguiban, Puerto princesa city, at matapos manumpa ng aling sunod sa itinakda n gating
saligang batas ay nag sasaad at nagpapahayag ng mga sumusunod:
Na, noong PEBRERO 22, 2017 humigit kumulang ika 10:00 ng UMAGA ay nag sasagawa ng
buybust operation ang provincial anti-illigal drugs special operation task force sa pamumuno ni
PO2 LEIZEL BATULAN laban kay CIREL MAQUILING sa barangay alfonso XII quezon Palawan, at
ako ay tinalaga na arresting officer sa aming isasagawang buy bust operation;
Na, sa pamamagitan ng tulong ng isang confidential agent ay nagawang

makipagtransakyon ni PO1 mark ong (poseur buyer) ang transakyon dito kaycirel maquiling at
kasabay nuon ang pagbibigay ng pre-arrange signal na nagbigay hudyat sa amin na naisagawa
ang transakyon at ako bilang tinalagang arresting officer kasama ng aming team ay agad tinakbo
at inaresto itong siCirel Maquiling. Ay aking ipinaliwanag sa kanya sa harap ng mga testigo ang
dahilan ng kanyan pagkaaresto at kaugnay doon ang kanyang mga karapatan sa pamamagitan
ng pag bigkas ng mga naksaad sa Miranda doctrine. At aking siyang tinanong kong naintindihan
niya ang aking mga sinasabi at sumagot siya ng “OO”
Na pagkatapos noon kaagad nagsagawa ng pag marka at imbentaryo sa mga nakuhang

ebidensya dito kay Cirel maquiling na sinaksihan nina barangay kapitan mark Anthony Cabanag.
. Ng barangay alfonso XII , quezon Palawan at barangay kagawadArman Quijano . At pagkatapos
noon ay kaagad naming dinala itong si Cirel Maquiling sa Quezon municipal police station upang
makuhaan ng karagdagang dukomentasyon at dinala sa opisina ng PAIDSOTF.
Na matatagpuan sa brgy tiniguiban, Puerto princesa city upang sa karagdagang imbestigasyon
at masampahan ng kaukulang kaso kaugnay sa paglabag sa RA 9165.

Bilang patunay sa mga binabanggit ko dito sa aking malayang sinumpaang salaysay ng

pag-aaresto ako ay lalagda sa ibabaw ng aking pangalan ngayong ika-22 ng pebrero 2017 dito sa

ng isang confedential agent sa buy-bust operation laban kay Crel Maquiling sa bayan ng Quezon,
Palawan;
Na 7:30 ng umaga ng araw ding iyon, kami ay tumulak papuntang Quezon, palawan lulan
ng isang pribadong sasakyan;
Na 9:30 ng umaga ng araw ding iyon, kami ay nakarating sa roxas, Palawan at tumuloy
muna sa ligtas na lugar;
Na iniabot sa akin ni PO2leizel batulan ang isang (1) libong perang papel ng pilipinas na
msy mga serial number na UE966898 at dalawang (2) limang daan piso na may serial number na
NH H598716 at UZ628900 na aking minarkahan ng DLU na siyang gagamitin bilang marked
money laban kayCirel Maquiling;
Na kami ay matyagang naghihintay sa mga development at iuutos sa amin ni PO2 Leizel

Batulan patungkol sa operasyon;
Na 09:45 ng gabi ng araw ding iyon, muling nagpatawag ng konperinsya si PO2 Leizel
Batulan at sinabi niya sa barangay 3 sa lugar malapit sa opisina ng DENR mangyayari ang pag
bibinta ng illegal na droga, matapos nun ay ibinigay na rin ni spo2 Leizel Batulan ang kanya-
kanyang posisyon at direksyon na gagawin ng bawat isa sa amin at ang hudyat ( pre-arranged
signal) na pag aalis ng aking bonnet kapag naisagawa na ang transaksyon na bintahan ng illegal
na droga;
Na mga 09:50 ng gabi ng ika-22 ng pebrero, ako at ang confidential agent ay tumulak na
patungo sa lugar ng barangay 3 sakay ng tricycle na aming pinara, dala ko ang marked money, at
sumusunod sa amin ang pribadong sasakyan lulan an gamin team;
Na mga 09:55 ng gabi ika-22 ng pebrero nakarating kami sa lugar ng barangay alfonso XIII
malapit sa opisina ng DENR, at mula sa highway kita ko na may isang tao na nakatayo sa isang
waiting shed. Kinuha ko ang aking cellphone at tinawagan ko si SPO2Liezel Batulan upang
sabihin ang situation na iyon. Tuloy ang lakad naming dalawang confidencial agent, at ng
makalapit na kami ay nakita ko si Cirel Maquiling na naghintay sa amin;
Na nang makalapit kami ng kasama kong confidencial agent kay CIREL MAQUILING, agad
nitong tinanong ang pera, bilang sagot inilabas ko mula sa king bulsa ang perang papel (marked
money) na pinakita ko sa kanya.
Na aking iniabot kay CIREL MAQUILING ang dalawang libong perang papel (marked
money), pag kuha ng pera ay agad niyang nilagay sa kanyang kanang bulsa sabay kuha sa
kanyang kaliwang bulsa ng isang plastic sachet na may roong puting Kristal na bagay sa loob at
iniabot sa aking kaliwang kamay;
Na matapos iyon ay aking inialis sa aking ulo ang aking suot na bonnet bilang tanda at
hudyat na naisagawa na an gaming transakyon at mabilis na kumilos an gaming team upang
hulihin si CIREL MAQUILING;
Na matapos masiguro ang kaligtasan sa lugar ay amin ng ipinatawag ang mga witness
upang tumistigo sa gagawin imbentaryo at sila ay dumating sa area mga 1:30 ng umagang
petsang iyon;
Na aking ipinakita ang hawak hawak kong plastic sachet na may lamang putting cristal na
bagay na aking minarkahan ng “DLU purchased” galing kay CIREL MAQUILING sa mga witness at
agad ko tong minarkahan;
Na sinimulan kong kolektahin ang mga kontrabandong aming nakuha kay CIREL
MAQUILING Agad kong minarkahan ng CM-1 ang isang plastic sachet na may lamang putting
Kristal na bagay, isang pakiting ng isang sigarilyo na may lamang mga tuyong dahon at nakabalot
sa isang papel at minarkahan ko ng CM-2. At isang pirasong lighter na minarkahan ko ng DLU-3
kasam na rin ang pera na nagkakahalag ng p3650.00 kasam na ang mga marked money na
aming ginamit habang sinasaksihan/nagmamasid ang mga testigo na sina barangay kapitan
MARK ANTHONY CABANAG, at barangay kagawad ARMAN QUIJANO ng barangaylfonso XIII
Quezon , Palawan.
Na matapos iyon ay aking inimbintaryo ang mga nakuhang ebidensya/kontrabando na

nasaksihan din ng mga nabangit na testigo;
Na bilang pagpapatunay sa lahat ng aking mga sinabi ay ilalagda ko ang aking pangalan sa
gawing ibaba nito na ako ay hindi, pinilit, tinakot, sinaktan o pinangakoan nang anu mang

Office, Anti-illegal drugs special operation Task Group led by SPO2 Leizel C. Batulan under the supervision
of PSSUPT Jinbert A. Azuelo., Acting Provincial Director, Palawan PPO together with PADAC-PALAWAN
and in coordination with Roxas, MPS, Roxas Palawan. During the conduct of said Anti-Illegal Drugs
Operation (buy-bust) our police operative PO1 MARK ONG acted as pouser buyer and therein he
purchased one (1) heat sealed transparent plastic sachet containing to two thousand (P2,000.00) from
the subject and marked with CM Purchased.
Further the operating team instantaneously conducted body search on the arrested
suspect in the presence of Barangay Chairman MARK ANTHONY CABANAG. Barangay Alfonso XIII,
Quezon, Palawan and Barangay Kagawad ARMAN QUIJANO of Barangay Alfonso XIII, Quezon, Palawan
and the operating was able to recover from the possession of the subject the following evidences wit;
One (1) heat sealed transparent plastic sachet containing white crystalline substance also known as
shabu with estimated market value of5,000peso;
One (1) marijuana leaves wrapped in a piece of paper and cash amounting to Php10, 000 including the
two (2) five hundred peso bills and one (1) thousand peso bill marked with DLU used as buy-bust money.
The said operation was conducted in peaceful and orderly manner, and was witness by Barangay Officials
of said locality.
The actual physical inventory, marking and taking of photographs were conducted in the place of
operation and the presence of respondent and witness.
The recovered/seized item was properly turned over to PNP Palawan Crime Laboratory Examination and
custody.

RESOLUTION
At about 12:00 midnight, Palawan Police Provincial Office Anti-Illegal Drugs special
Operation Task Force led by SPO2 LEIZEL BATULAN was launched against the respondent about
10:00 AM of FEBRUARY 22,2017 the transaction between the confidential agent and CIREL
MAQUILING was on going,and later the confidential agent received a phone call from CIREL
MAQUILIMG informing that they will meet at DENR compound, Barangay alfonso XIII, Quezon ,
Palawan PO1 MARK ONG and our confidential informant proceed at the agreed place of
transaction, and at around 10:00 AM FEBRUARY 22,2017 PO1 MARK ONG and confidential
agent arrived at the said place and after a few minutes the transaction was ended, and at the
juncture PO1MARK ONG gave the pre-arranged signal removed his headgear (bonnet), and
immediately the team approached the subject and the arrest was executed by PO1 MARK ONG
The laboratory result conducted by Provincial Crime Laboratory concluded the

presence of Methamphetamine Hydrochloride also known as shabu as well as the seize dried
leaves during the body search to the respondent were also concluded the presence of
marijuana and the marked money use during the buy-bust operation was recovered from the
possession of the respondent.
Article II section 5 sale, trading, administration, dispensation, delivery, distribution,

and transportation of dangerous drugs and or controlled prosecutors and essential chemical
and section 11 possessions of Illegal Drugs of RA 9165.”(Article 148 of the Revised Penal Code,
as amended)
Guided with the foregoing, this office so hold to believe that respondent is probably
guilty with the offense as charged and should be held in trial thereof.
WHEREFORE, premises considered, it is most respectfully recommended that information for

Violation of section 5 & 11 of Article II, RA 9165 be filed against respondent CIREL MAQUILING before
the proper court of Palawan.
