REQUERIMIENTOS LEGALES Y DOCUMENTACION
( Organizaciones Fiscalizadoras )
1. PROPOSITO
Establecer la documentacion legal requerida por
las Organizaciones fiscalizadoras de las
empresas Contratistas, haciéndo referencia a
las leyes que deben conocer y aplicar las
empresas contratistas.
2. ALCANCE
Este procedimiento define el cumplimiento y do-
cumentación requerida ante organizaciones fis-
calizadoras del pais.
3. APLICACION
Este procedimiento es obligatorio para todas las
empresas Contratistas, Sub-Contratistas, Pro-
veedores de Servicios Generales, Vendedores y
Representantes de Vendedores, y cualquier
persona asociada al proyecto dentro las áreas y
caminos de acceso del proyecto.
4. DEFINICIONES
Legislación aplicable: toda Ley, decreto, reso-
lución, norma o documento que sea de aplica-
ción a las actividades que se desarrollen en el
proyecto a través de las cuales puede llegarse
a reclamar su cumplimiento por medio de la au-
toridad de aplicación.
Norma de referencia: todo documento o norma
que aún sin ser de aplicación legal en las
actividades de FLUOR, y por lo tanto de cum-
plimiento no exigible, contiene información, lími-
tes, criterios, entre otros; que pueden servir
como referencia.

Ocupacional y Medio Ambiente: Organización
que asegura, gestiona, coordina y controla el
cumplimiento de procedimientos, regulaciones y
normativas aplicables en actividades HSE para
el Proyecto, asegurándo la aplicación de las
mejores prácticas en cuanto a Salud, Seguridad
y Medio Ambiente, así como también, exige que
se cumplan los requisitos del Cliente dirigidos a
la prevención de accidentes, enfermedades
ocupacionales y protección ambiental.

LEGAL REQUIREMENTS AND DOCUMENTATION
( Controlling Organizations )
1. PURPOSE
Establish the legal documentation required by
government organizations for Contractors, and a
list of reference laws, which must be known and
applied by the Contractor.
2. SCOPE
This procedure defines the required compliance
and documentation before governmental organi-
zations of the country.
3. APPLICATION
This procedure is mandatory for all Contractors,
Sub-Contractors,, General Services Providers,
Vendors and Vendor Representatives, and any
person associated to the project within the areas
and access roads of the project
4. DEFINITIONS
Applicable legislation: all laws, decrees, resolu-
tions, rules or documents, which are applicable to
the activities being executed on the project. that
come to be brought to our attention for its com-
pliance through the applicable authority
Reference Rules: All documents or rules, which
are not of legal applicability to the FLUOR activi-
ties, in as much not enforceable, but, contain in-
formation, limits, and criteria among others that
can serve as a reference.
HSE / Health Safety and Environment Dept.:
are those who ensure, manage and coordinate
HSE activities for the Project, complying with the
procedures, regulations and applicable rules and
client requirements, centered in the prevention of
accidents, professional illnesses and environ-
mental protection: by ensuring the use of the best
practices in Health, Safety and Environmental .

5. CONSIDERACIONES GENERALES
El Contratista, Subcontratista y/o Proveedor de
Servicios deberá mantener en el sitio de trabajo
los documentos legales, procedimientos y
estándares aplicables de Salud, Seguridad y
Medio Ambiente
La Autoridad Competente o Legal podrá
monitorear todas las áreas de trabajo para
verificar el cumplimiento de los requerimientos
legales en Salud, Seguridad y Medio Ambiente
establecidos.
6. PROCEDIMIENTO
Documentación previa al inicio de los trabajos
y/o servicios:
Antes del inicio de las actividades en el
Proyecto se deberá presentar la siguiente
documentación legal y técnica:
 Presentar documentación original y
un juego fotocopiado del Programa
de HSE.
 Fotocopia de la matrícula habilitante
del Responsable Profesional y/o
Técnico en Higiene y Seguridad para
el Proyecto, fotocopias de matrículas
del personal técnico afectado al sitio
de trabajo conforme normativa legal.
 Documento que acredite la relación
contractual de la empresa
Contratista, Subcontratista y/o
Proveedora de Servicios con el
Profesional habilitado del Servicio de
Higiene y Seguridad y del Técnico
afectado al Proyecto.
 Entregar un informe que detalle los
centros asistenciales de derivación
ante el caso de accidentes, asimismo
y cuando exista un acuerdo de
partes entre la empresa Contratista,
Subcontratista y/o Proveedora de
Servicios y un centro de asistencia
médica, presentar nota original del
acuerdo con membrete y datos de
contacto del responsable de la
unidad sanitaria / médica.
 Documento informando el servicio de
emergencia ó ambulancias para el
traslado de accidentados.
 Nota informando sobre el servicio de
ambulancia y lugar de derivación del
personal, para casos de

5. GENERAL CONSIDERATIONS
The Contractor, Sub-contractor and/or Service
Provider must maintain at the work site the appli-
cable legal documents, procedures and stan-
dards, Health, Safety and Environmental docu-
mentation.
The competent or legal authority can monitor all
the work areas to verify the compliance of the le-
gal requirements in Health, Safey and Environ-
ment.
6. PROCEDURE
Documentation prior to initiating the work and/or
services:
Prior to the start of work activities on the project,
the following legal and technical documentation
must be presented to the FLUOR:
 Present the original document and a
copy of the approved HSE program
 Photocopy of the certifying documen-
tation of the responsible professional
and/or technician in Hygiene and
Safety for the Project, photo copies of
the certifying documentation of the
technical
 Document that accredits the contrac-
tual relationship with the Contractor,
Sub-contractor or Service provider
with the Hygiene and Safety Profes-
sional and the technician for the pro-
ject
 Deliver a report which details the as-
sistance centers where personnel will
be sent in case of an accident, the
same when their exists an agreement
between the Contractor,
Sub.contractor and/or Service Pro-
vider and an assistance medical cen-
ter: present the original note of the
agreement with the members and in-
formation of the responsible contacts
of the medical/Health unit.
 Document that informs on the Emer-
gency Service or Ambulance for the
transport of the injured
 Note informing about the ambulance
service and place where personnel will
be sent, in cases of illnesses (that are

enfermedades inculpables (no
accidente de trabajo), y sistema de
emergencia contratado para su
traslado.
 Plan de emergencias ante
situaciones críticas como incendios,
lesionados graves, accidentes viales,
derrames, etc.
 Certificado del examen médico
preocupacional / periódico de cada
persona, debidamente
confeccionado, calificado y firmado
por el Médico Laboral.
 Constancias de homologaciones de
incapacidades preexistentes
detectadas en los exámenes
preocupacionales ante la autoridad
competente, en los casos que
aplique.
 Certificados de las verificaciones
técnicas de todos los vehículos que
estarán afectados al proyecto.
 Seguros de Responsabilidad Civil de
toda máquina pesada, vehículo
automotor y/o remolque que ingrese
y/o realice prestaciones en el
proyecto.
 Certificación técnico / mecánico
emitido por un ente calificado
reconocido, de todos los equipos que
estarán afectados a izajes de carga
y/o elevación de personas (Ej. grúas,
hidrogrúas, piloteras,
autoelevadores, manipuladores
telescópicos, plataformas aéreas,
etc.).
 Constancia de Seguro de accidentes
personales para el caso de
trabajadores autónomos; empresas
unipersonales; transportistas, fleteros
y/o taxistas, remiseros que manejen
su propio vehículo; choferes sin
relación de dependencia, que
manejen vehículos de terceros y toda
otra forma de contrato en donde el
subcontratista sea autónomo frente a
la legislación laboral y/o impositiva.
 Fotocopia con la firma del trabajador
sobre la Notificación de Riesgos del
Sector, Área o Tipo de Trabajo a
realizar.

consulters, Truck Drivers, Taxi Driv-
ers, remiseros that drive their own ve-
hicle, Chauffeurs independent of
whether they drive third party vehicles
and all other forms of contracts where
the sub-contractor is automonous unto
labor legislation and/or taxable
 Photocopy with the workers signature
indicating notification of the sector

 Registro habilitante y autorización
legal (Nacional / Provincial); para el
uso, distribución, almacenamiento,

ante la autoridad competente.
Durante la ejecución del proyecto, se
presentará la siguiente documentación:
 Confección del Legajo Técnico de la
obra / prestación y/o servicio que
presta la empresa Contratista,
Subcontratista y/o Proveedora de
Servicios.
 Fotocopia del registro de entrega de
los elementos de protección personal
con acuse de recibo por parte de
cada trabajador y especificación del
elemento entregado (acuse de recibo
por parte de cada trabajador).
 Fotocopia del registro de personal
participante en los cursos de
capacitación impartidos por la propia
empresa Contratista, Subcontratista
y/o Proveedora de Servicios.

 Registered Authority and legal au-

During the execution of the project, the following
documentation will be presented :
 The confection of the legal technical
register of the Job / services and/or for
the support that is afforded from the
Contractor, Sub-Contractor and /or
service provider
 Photocopy for the issue and reception
of personal protective elements for
each worker and specifications of the
element issued ( proof of receipt by
every worker)
 Photocopy of the register of personnel
who have participated in training
courses given directly by the Contrac-
tor Company, Sub-contractor or Ser-
vice Provider
