UNDER RULE 60(b) OF THE FEDERAL RULES OF CIVIL PROCEDURE
Plaintiff, JUVENAL ENRIQUE FONTALVO CAMARGO, hereby moves this Court
pursuant to Rule 60b of the Federal Rules of Civil Procedure for reconsideration and reversal of
its Partial Final Judgment Pursuant to Rule 54b entered September 6, 2019 based upon newly
discovered evidence obtained after the entry of the subject judgment. In its Decision dated
September 5, 2019, the Court stated as follows:
“Nor do the proffered declarations of the third party witnesses create a triable issue of
fact on the identity of the decedent’s killer, where the first declarant does not establish
any personal knowledge or experience to support his claimed belief that one of the
alleged abductors (El Russo) was an AUC leader or affiliate, and the second does not
establish any personal knowledge for the claimed belief that persons who admonished
him for moving the body were AUC affiliates or commanders. Without any independent
source evidence on record from which the alleged AUC affiliation of the abductor may
reasonably be drawn, this testimony does not create a triable issue of fact on the identity
of the decedent’s abductor or killers.”
Annexed hereto as Exhibit 1 is the Official Response to Right of Petition signed by Gener
Rafael Terraza Serge, Fiscal of the Delegated Prosecutor’s Office No. 31 Before the Justice and
Peace Tribunal, Directorate of the Specialized National Prosecutor’s Office of Transitional Justice

in Santa Marta, Magdalena, Colombia. This official document, duly signed and notarized by the
authorized government official establishes that “El Ruso”, whose actual name is Edwin Alberto
Ferrer Gonzalez, was part of the urban group belonging to the structure of the Northern Bloc of
the AUC, William Rivas Front under the command of Jose Gregorio Mangones Lugo, alias Carlos
Tijeras, who committed crimes in the various regions of the Zona Bananera; that he was captured
on November 4, 2004 by means of an arrest warrant issued by the Prosecutor’s office No. 6
specialized in Aggravated Extortion, Criminal Association Combined with Homicide and he is
currently incarcerated in prison in Barranquilla. The sources of the Prosecutor’s knowledge as to
the militancy of “El Ruso within the structure of the AUC’s Northern Bloc is stated to be from
analysis of interviews, Spontaneous Declarations of the applicants for benefits under the Justice
and Peace law, and demobilized persons who were part of the once United Self-Defenders of
Colombia, Northern Bloc, Willam Rivas front. This evidence was officially set forth in the various
criminal court judgments and sentences of various Supreme Court Judges set forth in detail on
page 2 of the documents. It is specifically set forth that within the illegal structure of the AUC,
“El Ruso” acted as a “patrol member” in the urban area of Cienega, Pueblo Viejo, Zona Bananera
municipalities.
Further annexed as Exhibits 2 and 3 are supplementary Declarations of the eyewitnesses
Sergio Manuel Contreras Castro and Ever Joel Fontalvo further attesting that the “El Ruso”
previously identified in their original declarations is the person whose photograph are annexed as
Exhibit A, corresponding to the person officially identified as Edwin Alberto Ferrer Gonzalez,
alias “El Ruso”
It is respectfully submitted that this document qualifies as “independent source evidence
on record” that a perpetrator of the abduction and murder of plaintiff’s decedent was indeed a

member of the AUC. This evidence, in addition to the eyewitness accounts of the witnesses
previously provided raises a triable issue of fact as to the whether the plaintiff’s decedent was
murdered by the AUC sufficient to warrant summary judgment.
The evidence now being submitted in the form of an official response to a Petition filed by
plaintiff’s criminal investigator, Carlos Fajardo Sanchez, was not accessible previously in this
form. However, we have been diligent in pursuing information concerning “El Ruso” from the
outset, but were hampered by the fact that the witnesses did not know his true name, and this
individual never surrendered or participated in the Justice and Peace Process or gave statements
comparable to those of Mangones, Hasbun etc. We submit that we have been diligent in obtaining
this new evidence, that it is highly material and corroborative of the statements of the witnesses,
and it is admissible. The document we have submitted is a notarized official document of a duly
authorized government official containing the findings of a government investigation. The identity
of this individual is further verified on the official web page of the Fiscalia General de Nacion,
annexed as Exhibit 4. Plaintiff has also requested and will submit a letter from the appropriate
office of the Fiscalia further certifying the authority of Fiscal Gener Rafael Terraza Serge to
provide the document in question. There is apparently a government holiday on October 3rd and
4th, and as soon as we have received the additional certification we will supply it. The authenticity
of the document and of the person giving it is self-evident and should be accepted as reliable in its
present form in any event.
For the reasons stated, Plaintiff respectfully requests that the Court accept the new evidence
proffered and grant relief from the subject Judgment under Rule 60(b) of the Federal Rules of Civil
Procedure, vacating the Judgment as to plaintiff Camargo and denying summary judgment to
defendants on this claim.
