Abstract

Humiliation is a despicable act by degrading human dignity and as a creature

of God, one of the acts of humiliation that is often done is an insult to the body that can
unwittingly be convicted, by commenting on the physical flaws of others, it is because
there is no one act that justifies insulting activities. Humiliation of the body can cause
a cyclical disturbance to victims of insults that often lead to other criminal acts, in a
thesis study entitled Juridical Review of Criminal Acts Based on the Criminal Code
and Law Number 11 Year 2008 Concerning Information and Electronic Transactions,
the authors describe criminal acts of contempt conducted in social media and in the
world of reality, in conducting this research the writer uses a normative research model
where the source of the research is based on library studies, and uses aproblem statute
approch approach and a conceptual conceptualapproach approch with the formulation
of the problem namely the regulation of humiliation in Indonesia and bodyshame as a
criminal act as well as the validity of electronic evidence in the criminal law system in
Indonesia, the research results are known inthe 1945 Constitution of the Republic of
Indonesia Article 28 I Paragraph (2) Everyone is free from mistreatment fat
discriminatory on any grounds and are entitled to protection against discriminatory
treatment. Humiliation conducted on social media will be snared by Law Number 11
Year 2008 Regarding Electronic Transaction Information Article 45 Paragraph 1 Any
person who intentionally and without the right to distribute and or transmit and or
make accessible electronic information and or electronic documents that have a charge
which violates the decency as referred to in Article 27 Paragraph 1 in a criminal
sentence with a maximum imprisonment of 6 years and or a maximum fine of 1 billion
rupiahs and Article 27 Paragraph 3 each person intentionally and without rights and
distributes and or transmits and or makes it can be access to electronic information
and or electronic documents that have the content of defamation and / or defamation,
while insults committed outside of cyberspace will be ensnared with the Criminal Code
Book book 1 General Rules Chapter 16 insults Article 310 insults anyone who
intentionally attacks honor or the good name of someone with menud ell is something
that is meant to be clear so that it is known by the public because of pollution with a
maximum imprisonment of 9 months or a maximum penalty of 450 rupiah.
