Heard Mr. P. Roy Barman and Mr. TD Majumder, learned

counsel appearing for the accused person, Sri Badal Choudhury.

Also heard Mr. AK Bhowmik, learned Advocate General

assisted by Mr. Ratan Datta, learned PP appearing for the State-

respondent.

The petitioner, Smt. Namita Gope has filed the present

application under Section 439 Cr.P.C. for granting bail to the

accused, Mr. Badal Chowdhury, who is accused of committing

offence punishable under Sections 409/418/420/201/120(B) of

the IPC and under Section 13 of the Prevention of Corruption Act,

1988.

Learned counsel appearing for the accused-person has pressed

for passing an order for interim protection to the accused-person

as he is seriously ill, more particularly, suffering from cardiac

ailments and has been admitted in the hospital and may not be

able to face/attend the custodial interrogation.

Learned Advocate General, has submitted that a notice be

issued upon the State-respondent and the case may be fixed on

30.10.2019 to produce the case diary.

Accordingly, issue notice calling upon the State-respondent to

show cause as to why the instant bail application shall not be

allowed, as prayed for; and/or why such further and other

order(s) shall not be passed as to this Court may deem fit and

proper.

Notice is made returnable on 30.10.2019 when the State-

respondent shall definitely produce the case diary of West

Agartala PS case no. 2019 WAG 251.

Since Mr. Ratan Datta, learned PP appears and accepts notice

on behalf of the State-respondent, no formal notice needs be

issued.

Learned PP is also given liberty to file objection in response to

the instant bail application.

Meanwhile, this court expects that the State-respondent shall

take all necessary steps in regard to monitoring the health

condition of the accused-person, Mr. Badal Chowdhury.

List the matter on 30.10.2019.
