Lawmaking vs. Execution
• Legislative Branch – Constitution Article 1
– “Make all Laws which shall be necessary and proper for
carrying into Execution the foregoing Powers vested by
this Constitution in the Government of the United
States, or in any Department or Officer thereof”
• Executive Branch – Constitution Article 2
– “Shall take Care that the Laws be faithfully executed”
• Delegation of legislative power to the executive
– Contrary to the Constitution? or
– Necessary for resolving complex technical issues in a
less political manner?

Administrative Procedure Act of 1946
• Response to concerns over “delegation” of

• Agency must follow specified procedures
