Admin, Code §§87,1057 97.1059, 97.1073, ‘Special Accreditation Investigation In response to muitile complaints received by the Texas Education Agency (TEA or agency) alleging violations with laws relating to governance of an Independent School District and ‘complance with the Texas Open Meetings Act, TEA issued a Notice of Special Accrectation Investigation (Alon January 22,2018, and due to concems reported by Houston ISD staf ssued sirametnded Nobce of SA ws March 24,2016, to iduue alleged velaions of contact prouulernent On August 5, 2019, the Agency issued a Preliminary Report and provided the dit and Its twustees an opportunity to respond. After conducting an informal rview ofthe responses, the ‘gency laued a Final Report on Ociober 30, 2018, which documented the folowing findings: ‘+ A quorum of the board of trustees deliberated and exercised decision making powers tutside of a pubic meeting held in compliance wit the Texas Open Meetings Actin vilaton of Tex. Eve. Code §11.051(0+), ‘+ Members ofthe board of trustees acted individually on behalf ofthe board, exceeding the scope of thei authorty in volation of Tex. Edue, Code §17.05%(@1) Governance of Independent Schoo! District ‘+ Mombers ofthe board of rusees violated contract procurement rules while the district was selecting 2 vendor/contract a wel as atemating to tamper with conracts that had been ‘warded in violation of Tex. Educ. Code §§44 031 and 44.031(a)(1). ‘Based on these findings, the Final Report recommended lowering the district's accreditation status 4nd appointing a conservator and a board of managers to ensure appropriate governance of the istrict and implementation of policies and procedures to adress the issues raised in the Final Report ‘Accreditation Status and Appointment of a Board of Managers and Superintendent Pursuant to Tex Educ. These actions are neceseary because the alstrict has failed to comply wih the requirements related to purchasing as set forth in Subchapter 8, Chapler 44 o the Education Code, See Tex. Educ. Cade §§ 39.052{0,2WAN() ang 71086(6)(3E}, and 19 Tex. Admin. Code §§97.1055(0)(2)(A)\v) and 97.*055(). Given the inabily of the board of rusees to govern the disc, these sanctions are necessary to Protect the best interests ofthe distiic's current and future students. See 19 Tex. Admin. Code £97.1057(9. The findings demonstrate that incvidual members of the board of trustees acted on behalf the board outside of @ meeting that complied withthe Texas Open Meetings Act resulting an ineficient or ineffectual use of distil funds or propery. See 19 Tex Admin. Code 497.1057(0(1). The board members should have focused on implementing effecve change to Improve the performance of studentsin the cistrct's ow performing camguses. See 19 Tex. Adin, (Code §97-1057(9(4). The board of trustees falled to doo, The findings inthe Final Report demonstrate material defciences that are serous and extensive See 19 Tex. Admin. Code §97.1055(0)1)€). The findings also demonstrate thatthe district's governing problems are long-standing and have recured overtime. See 19 Tex. Admin. Code 4$97-1059(0)2). The deficiencies cite inthe Final Report demonstrate a substantial and imminent treat o the welfare ofthe districts students anc tothe public interest because the board of trustees 's unable to gover the distric, as demonstrated by its inabilly 0 adéress the fong-stancing academic deficiencies at Wheatley High School, See 19 Tex. Admin. Code §97.1059(0\4). As slated above, | have reviewed the Final Report and determined thatthe findings contained ‘herein compel me to lover the district's accreditation status. For the same reasors cited above, ‘hese fnaings also compel me to appoint a board of managers fo exercise the powers and dues ofthe board of trustees. The rating of Academically Unacceptable was the lowest rating in the accountability system. The campus was requited to prepare a targeted rnproverment plan. 12012, no campus ratings were issued due to raniton from the TAKS to the STAR test. Under ‘tis transtion, 2011 and 2013 ratings were tealed as consecutve. See 19 Tex. Admin. Code §87-1085(2)9). 12013, Wheatley High School was assigned a fral academic aocountailt rating of Improvement quired. This was the campus’ second consecutve unaceepiable rang. The campus submitted is targeted improvement plan and a targeted reconsution pian, 12014, Wheatley High Schoo! was assigned a fal academic accountabilty rating of Improvement Pequired, “This was the campus’ third consecutive unacceptable rating. The campus was ‘designated 2 Texas Tle 1 Proity School (TTIPS) and received the TTIPS Cycle 3 Grant. As @ candton of that grant, the campus submited quarery progress reports, staff and Principal ‘Sfectiveness submissions, and end of year reports. 12015, Wheatley High Schoo! was assigned a fal academic accountabit ating of Improvement Pequired. This was the campus fourth consecutive unacceplable rating. The campus continued ‘oimplement its plan associated with the TTIPS Cycle 3 grant 12018, Wheattoy High School was assigned a final academic accountability ating of mprovermant quired. This was the campus’ fith consecutive unacceptable rating. Under prior aw, this district and campus wouid have been ordered to repurpose the campus, select alternative management, {cose the campus.’ However, due tothe passage of HB. 1642, a new set of sanctions was auhorzed. H.8. 1842 incuded a transition plan for campuses such as Whealley. Under the ‘tansion provisions, Wheatley was essentilytrested as having three consecutive faled ratings ‘allowing the 2016 rating, rather than fv. This was the campus’ sith consecutive unacceptable rating. In 2018, Wheatley High School had student performance that would have led to its seventh consecutive failed rating. However, due to the Huricane Harvey waver, Wheatley was nat issued 1 rating of Improvement Required. Insleed the campus was net rated. This action is necessary Because the Agency's systems for campus accountabilly have identited the board of trustees aerial deficiencies and inability to implement effecive change to improve the performance of ‘Mudents assigned othe campus, See 19 Tex. The HISD Board of Trustees has silowed this campus to operate with unacceptable ratings since 2011, earring 7 consecutive Jnaceeptable ratings, and demonstrate an ongoing failure of the boord of trusts to addres areviousl identified deficiencies and establish a patter of recurring deficiencies. Code 397-1053(a)() Length of the Conservator Appointment On September 2, 2018, | appointed Dr. Doris Delaney as @ conservator. At the time of this appointment, Kashmere High School had the most consecutive years of unacceptable performance of any campus in the stale. The commissioner may appoint a board of menegers ia conservator has been assigned tothe district in any part of two consecutive school yeas, including the curent School yer. See Tex. Educ. Code §39.006(b) and 19 Tex Admin. Code §97.1057(d). Or. Delaney’s Detiod of appointment has included four consecutive schoo! years inouding mast ofthe 2016-17 School year, the entire 2017-18 school year, the erdive 2018-19 school year, and part of the current 2018-20 school year. Under the conservaior's recton, Kashmere High School has earned an ‘sccoptabo rating. Educ Code §30.087(3) 304.004, 308.006, and SOA 11(1) and 10 Tex. Admin, Code 6507-1057, 7.1058, and 87-1073(). ‘A majorty ofthe board of managers will consist of members ofthe Houston ISD commurity who sre commited to service on behalf the students ofthe cistct and the community. The members of the board of managers wll be responsible for overseeing the manegement ofthe Houston ISD, Including oversight of the district's efforts to address and correct Identhied dafciencise, and implementation of effective structural and procedural improvement strategies forong-iem postive Ghange.
