AFFIDAVIT OF WITNESS

I, Armando G. Bais Jr., 24 years old, single, resident of Sitio Mananao Dist. 1, San Manuel,
Isabela, after having sworn in accordance with law, do hereby depose and state THAT:

1. I was present and personally saw that the accused, Loren L. Atabay committed the crime of
Slight Physical Injuries against the victim, Billy Joe B. Concepcion, as follows, to wit:
a. That we were instructed by Ms. Lenore Lee Lopez, our supervisor, to disassemble the
standees, tarpaulins and display racks used in the recently concluded Trabaho, Negosyo,
Kabuhayan at Konsyumer (TNKK) Job and Business Fair conducted at FLDY Coliseum last May
1, 2019.
b. That at around 4:00 pm, I, together with Warren Taguba and Billy Joe Concepcion, was
carrying the water dispenser and the remaining water gallons to the vehicle of Mr.
Concepcion but upon placing them Ms. Lopez instructed us to place them in the office
vehicle instead.
c. That upon placing the water dispenser and water gallons in the office vehicle, Mr. Atabay
commented that Mr. Concepcion should have not brought his vehicle if he will not use it to
return the items to the office.
d. That upon hearing the statement of Mr. Atabay, Mr. Concepcion answered that he will just
carry again the items and return it to his vehicle. While in the act of pulling the water
dispenser and water gallons out of the office vehicle. Mr. Atabay commented again that,
“Pagnernerbyosin nak” then I said to Mr. Atabay “Gayyem chill lang” but the latter
attempts to punch Mr. Concepcion.
e. That in order to pacify the incident I urge Mr. Concepcion to calm down and advised him to
enter inside the coliseum however I was shocked seeing Mr. Atabay followed Mr.
Concepcion and punched him unmindful of the presence of the crowd.
f. That as a result of the punching it led to a swollen of his face near the right portion of his
eye. Thereafter I tried my best to stop them but to no avail
g.
h. Mr. Atabay continuously punched Mr. Concepcion and this was only stopped when the
police intervene.
i. That upon seeing the swollen face of Mr. Concepcion, I asked Mr. Darwin Laureano to buy
ice and gave it to Mr. Concepcion to apply firs aid measure in his face.

I executed this affidavit to attest the truthfulness of the foregoing facts.
