Addressing the International Crimes commited in Myanmar’s
territory, The United Nations Security Council: 1. Appoints the Arkheid Rohingya Salvation Army (ARSA) as an International Terrorist Group, which must be stopped; a. Calls the cooperation between the ASEAN Countries and International Police Forces to fiscalize severely the presence of ARSA’s members in their respective countries; b. The Burmese Intelligence Force should reinforce the investigations about ARSA ś actions on movement; c. The captured ARSA Members will be, primarily, judged by the International Criminal Court due to the allegation of these International Crimes: Crimes of Aggression and Crimes Against Humanity;
2. Declares a UNSC referral to account internationally the crimes
committed during Rohingya’s crisis. a. The crimes were referred to the ICC Prosecutor by the United Nations Security Council (UNSC) pursuant to a resolution adopted under chapter VII of the UN charter. b. The official allegations to be investigated by the International Criminal Court are: i. Genocide ii. Crime Against Humanity iii. War Crimes; c. The Human Rights Report of the independent international fact-finding mission on Myanmar from September 28th must be considered during the following parts of the Criminal Process: Preliminary examinations and Investigations d. The UNSC referral includes the names of alleged direct perpetrators, but focuses on those exercising effective control over them. In relation to the recent events in Rakhine State, this includes the i. Tatmadaw Commander-in-Chief, Senior-General Min Aung Hlaing, ii. Deputy Commander-in-Chief, Vice Senior-General Soe Win iii. Commander, Bureau of Special Operations-3, Lieutenant-General Aung Kyaw Zaw iv. Commander, Western Regional Military Command, Major-General Maung Maung Soe v. Commander, 33rd Light Infantry Division, Brigadier-General Aung Aung vi. Commander, 99th Light Infantry Division, Brigadier- General Than Oo e. The referral appoints that certain acts committed by ethnic armed organizations and ARSA may also constitute war crimes, such as the murderer of 5 UNSC’s ambassadors. f. The referral considers that ARSA’s members also committed serious human rights abuses, including the killing of dozens of suspected informants and the burning of the Rakhine village of Ah Htet Pyu Ma on 25 August 2017. Other abuses allegedly perpetrated by ARSA, including several incidents where Rakhine and members of other ethnic groups, including the Mro, were killed, require further investigation, as does the killing of up to 100 Hindu men and women from Kha Maung Seik.
3. Demands Myanmar manifestation of clear political will
supported by concrete actions for the sustainable return reintegration of the Rohingya to Myanmar. 4. Recommends Myanmar to build trust among the Rohingya by discarding discriminatory laws and practices and allowing "go and see" visits to northern Rakhine by Rohingya representatives. 5. Myanmar must guarantee the security and safety of the Rohingya by deploying civilian monitors from the international community in Myanmar's Rakhine state 6. Declares that the international community must address collectively the root causes of Rohingya problem are addressed and the violation of human rights and other atrocity committed against the Rohingyas are accounted for. 7. Install a fact-finding mission coordinated by the United Nations Security Council to investigate the Chemical Weapons Allegations a. The efforts must be made by the international consensus about the prominence of the Geneva Convention and The Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on their Destruction. b. Stress that all United Nations Security Council’s delegations are signatories of both Conventions
