MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This MEMORANDUM OF AGREEMENT is made and executed by and between Eulogio
“Amang” Rodriguez Institute of Science and Technology (EARIST), a learning Institution, duly
organized, licensed and existing under the laws of The Republic of the Philippines, with principal office
located at Nagtahan, Sampaloc, Manila Philippines, represented by DR. FREDERICK C.PENAin his
capacity as Vice President for Academic Affairs, herein referred as the FIRST PARTY;
The _________________with business address at_____________________represented in this
contract by Mr._______________here in referred as SECOND PARTY;
- WITNESSETH -
WHEREAS, the FIRST PARTY has sought the services of the SECOND PARTY to
accommodate their student in the College of Hospitality Management to undergo On-The-Job
Training at the hotel provided by_______________;
WHEREAS, the SECOND PARTY agreed among others, to accept the BSHM –
_________Students of the FIRST PARTY for their Student Internship:
NOW THEREFORE, for and in consideration of the foregoing premises, the FIRST PARTY
and the SECOND PARTY have agreed as they hereby agreed to enter into a Memorandum of
Agreement subject to the following conditions:
A. RESPONSIBILITIES OF THE FIRST PARTY (Eulogio “Amang Rodriguez Institute of
Science and Technology)
1. Shall hereby agree the SECOND PARTY,__________is the Official Training Provider
of their students enrolled in the College of Hospitality Management for School Year
2019-2020.
2. Shall ensure the SECOND PARTY, that their student who will undergo internship is
physically fit, and comply with all requirements of the immersion program;
3. Shall be responsible to have their student comply with the rules and regulations set
forth by the SECOND PARTY;
4. Shall be responsible to the SECOND PARTY for any/all damages or losses of
properties attributed to carelessness, negligence and or intentional act/s made by their
student.
B. RESPONSIBILITIES OF THE SECOND PARTY ____________.
1. Shall be responsible to provide a training program intended for BSHM –
________Students of the FIRST PARTY;
2. Shall hereby agree to accommodate the student and provide the number of training
hours;
3. Shall be responsible for the issuance of Certificate of Completion;
4. Shall not be liable for the occurrence of any sickness or other physical disorder directly
or indirectly arising to the student during the immersion period;
5. Shall provide a comprehensive training for 600 hours.
C. TERMINATION OF MOA
1. The SECOND PARTY and the FIRST PARTY may terminate this contract upon
violation of any terms and conditions as provided in this contract by serving notice to
the party at least 15 days prior to the date of intended termination.
D. PROVISIONS OF AMENDMENT
Any provision of this contract maybe subject for amendment with the conformity of both parties.
E. ATTACHMENTS/ANNEXES
The following attachment/annexes shall form an integral part of this Memorandum of Agreement:
1. The contract between ______________ and Eulogio “Amang” Rodriguez Institute of
Science and Technology
2. Letter of Acceptance of the______________for the student immersion.
E. EFFECTIVITY
This MEMORANDUM OF AGREEMENT shall take this school year 2019-2020 or as
maybe requested by the either parties unless sooner terminated in the manner provided for in the
preceding paragraph, but the same maybe renewed by both parties as the needed arises.
