AFFIDAVIT IN LIEU OF THE LEGAL CAPACITY

I, PHAWAT ARYUNAN, of legal age, single . Thai National, and a resident of No. 51
Village No. 7, Kut Bong Sub-District, Phon Pisai , Nong Khai Province, Thailand after
having been duly sworn to in accordance with law , depose and say:

1. That I am a Thai National with Passport Number AA4019953 issued by the

Ministry of Foreign Affairs of Thailand on January 15, 2016 and I desire to marry
Jenevel C. Timbengan , a Filipina and resident of 21-D Marvex Drive Ballintawak,
Quezon City, Philippines;

2. That, under Article 21 of the New Family Code of the Philippines, before a marriage
license can be issued to me, it would be necessary for me to secure a Certificate of
Legal Capacity to Contract Marriage issued by the Diplomat or Consular Official of
my country;

3. That it has become impossible for me to comply with the provision of the New
Family Code of the Philippines for the reason that the Embassy of Thailand does
not issue such a certificate;

4. That however, I attest under oath that I am still single, not having been married in
my country or anywhere outside my country and remained single until the present;

5. That in view hereof, I have the legal capacity to contract marriage with Jenevel C.
Timbengan;

6. That this affidavit is being executed to attest to the veracity of the foregoing facts,
and for all intents this may be of legal worth.
