Government of the Punjab, (Finance Department), Lahore has requested to
this Court for issuance of necessary instructions to all District/Additional
District And Session Judge in the Punjab for compliance of the Rules
regarding production of valuable packets lying in the double locks of
District Treasuries. Copy of Rules 3.8 of PFR, Vol-I is added for kind
perusal at flag (A).

taken by concerned Officials of P.W.D department on 27.07.2011 and
asked for written demand. On said date a requisition for supply of

in spite of verbal/ telephonic reminders. In this regard, it is submitted
that all the wires relating to A.C Switch are lying open and in very
dangerous position. Hence it is necessary to get the same replaced
immediately before any incident takes place.

Respectfully sheweth as under:-

PRELIMINARLY OBJECTS

(i) The heading of the application has not been


correctly written, show the application cannot proceed.

(ii) The application does not come within the ambit


of order 7 rule 11 /C.P.C, therefore, it is liable to
objection.

ON MARITS

(1) That para 1 needs no reply.


(2) That para 2 needs not reply.
(3) That para 3 is incorrect and denied the suit is
competent and can proceed under the law.
There is no ground for rejection of the plaint

1. That sub-para (1) is absolutely wrong and


denied the plaintiff has good cause of action
and rightly entitled to recovered the arrears of
rent etc. and has rightly filed the suit as the
defendant failed to deposited the rent un
lawfully.

2. That suit is correctly maintainable in the present


form the objection is unlawful and un-called for.

3. That sub para (3) absolutely wrong and denied.


The plaintiff has every right to recovered the
arrears ofrent as the rented property was
purchased by the plaintiff/respondent and
same was duly transferred in the name of
plaintiff within the knowledge of
defendant/applicant.

4. That sub-para (4) is absolutely wrong and


denied. The plaintiff/respondent was correctly
claimed the arrears of rent etc. so the suit for
recovery is competent.

5. That sub-para (5) is wrong and denied. The suit


has been filed by the plaintiff, who is very
competent to file the same.

6. That sub-para (6) is absolutely wrong and


denied. The rented premises was decided under
order of the competent Court vize Additional
Rent Controller Cantonment Board, Lahore.

2. In view of the submission, made above reply, it


is respectfully prayed that the application be very kindly

copy of the above said judgment and decree dated
31.07.2012 and while going through the same, it has
transpired that the decree prepared by this Hon`ble
Court does not conform to the judgment dated
31.07.2012.

3. That under the law decree is always to be


prepared conforming to the judgment of the Hon`ble

4. That if the decree dated 31.07.2012 is not


corrected/prepared/amended/modified conforming to

It is submitted that the split installed in the Receipt
Branch gets out of order in every two days. This is due to the
order wait of the split, which is installed outside the kitchen of
the Judicial Academy. After every two days the rats eat the
wire and the split stop working.
2. We have made this complaint many times, but the result
is same after the electrician make it fix.
3. It is having into your kind notice that there is no space,
where they another unit is fixed for the electrician to stand and
do his work. As there is very little space over they have to
work no electrician is interested to come after every two days
and make the split in working condition by putting his life on
risk. As the Holy month of Ramzan is going it is very difficult
to sit in the branch, During this whole summer`s we are
having this problem and hotly two weeks of the summers the
split has worked the electrician are also very busy as they
cannot come after every two days.
As discussed with the electrician, it requested that kindly
shift the unit of the split to the roof of the Judicial Building.

Kindly supply the A.C.R forms three piece of neck ties for the

days of its repaired. It has been pointed out by the mechanic that the fan
of A.C is installed at the outside the kitchen of the Judicial Academy,
where the rates disturbed the wire of said spilt.

A.C from the outside the kitchen to roof of the Judicial Academy

It is submitted that the Receipts Branch was allotted an
intercom bearing number 193, before its shifting in the High Court
building of Punjab Judicial Academy, but no intercom or telephone was
provided up till now, resulting that inconvenience are being faced to the
members of branch as well as 0fficers sitting in the premises of high
court building.
2. In this connection, it is submitted that Receipts Branch deals
with the matter regarding revenue receipts pertaining to Lahore High
Court and entire district Judiciary in the Punjab. It also accomplished
assigned goals and objectives as entrusted by the higher authorities and
as laid down in the Punjab Budget Manual, Punjab Financial Rules and
Budget Call Circular issued by the Government of Punjab, Finance
Department for submission of Budget Estimates of Receipt in respect of
Lahore High Court (Principal Seat & Benches), Sessions, Civil, Small
Claims and ATA Courts in the Punjab. For the safe of time as well as
expenditure in the process of work a STD Telephone/intercom very
necessity for Receipts Branch.
3. In view above, it is, therefore, requested to arrange to install
a STD telephone/intercom in Receipts Branch, situated in the building of
Punjab Judicial Academy, Lahore.

or intercom facility in Receipts Branch, on top priority basis.

order passed by the Hon`ble Lahore High Court, Lahore in

Accounts Officer with my free consent and without any undue
coercion that if the decision of Supreme Court/High Court,
regarding the grant of increase in pension from the date of
restoration of commuted pension @ at which I was drawing
50% remaining pension, and the arrears thereof, is set aside
by any competent court of law. I am bound by this undertaking
that I will refund entire amount which would have been
received by me in accordance with Finance Division`s O.M.
referred to above.

It is in continuation of previous application
dated 17.9.2014 on the subject noted above and to say that
my son namely Ahmad Jamshaid passed his matric
examination (Annual) 2013, but his certificate has not been
received up till now. In this regard a request was diary bearing
No.12400 dated 17.09.2014(copy enclosed). By following
this, I visit at your good office many time, there the dealing

deliver the said certificate, but all in vain. Due to non-
availability of said certificate we are facing great hard ship
and may suffer from irreparable loss. It is pointed out that all
dues of board have already paid in connection with the
examination. For process of collecting the certificate a sufficient
amount has been spent by me for expenses from home to
Secondary Board office and in order to above said dealing

2. In view of above factual positions, it is,

2. In this regard it is submitted that the summer
season has started and unfortunately the second room of
Receipts Branch situated in the premises of Ist Floor of Punjab
Judicial Academy is still working without Air Conditioner. It is,

therefore, requested that in the interest of smooth functioning


of official work, Assistant Registrar (Building), may be
requested to make arrangement for installation of an Air
Conditioner as early as possible.
