JUDICIAL AFFIDAVIT OF
RONALD R. BANDONILL

This judicial affidavit of Ronald R. Bandonill was executed to serve as his cross-direct testimony in the
instant case. This judicial affidavit is being offered to contest:
1) the allegation of Reckless Imprudence Resulting in Homicide against the accused Panfilo “Pin” G.
Guerrero; including all the Annexes appended thereto, which he respectfully requests to be
correspondingly marked as Exhibits in this case; and
2) all other matters related thereto, with reservation to present additional exhibits in the course of the
proceeding in the instant case.

QUESTIONS were propounded by Plaintiff’s counsel, Atty. Leonardo D. Mabuti in English, the affiant fully
understands, while ANSWERS were given by witness Ronald R. Bandonill in English.

BACKGROUND OF THE CASE

Valentino Nonan y Mendoza a Filipino of legal age and a resident of Poblacion Sur, Sison, Pangasinan,
that on November 19, 2005, accused Panfilo “Pin” G. Guerrero, driving a 1998 Nissan Skyline r34 model
car, allegedly ran over the victim while the latter was crossing a pedestrian.

CROSS-EXAMINATION BY THE COUNSEL OF THE RESPONDENT

Q: Good morning, doctor. To clarify, are you an expert in identifying the cause of death of a person?

A: Yes.

Q: How long have you been an expert?

A: For almost 34 years starting in 1985 after I passed my Medical Board Examination.
Q: What exactly a medico-legal officer do?

A: We generally do autopsy examinations on people who died under various circumstances, including
caused by vehicular accidents, and part of that is documenting injuries to the extent that we can and
determining the cause of death.

Q: Did you personally examine the cadaver of the victim?

A: Yes.

Q: What is the cause of the death of the victim?

A: The victim died of CEREBRAL CONTUSION secondary to SEVERE TRAUMATIC HEAD INJURY.

Q: In determining the cause of death, do you make references to other sources of information, for
example, toxicology reports, police report, etc.?

A: Yes.

Q: What is the relevant of making references?

A: Because we need to determine the cause of death considering all the information that is available.
We, sometimes, need that information to ascertain why somebody died.

Q: Can you please elaborate?

A: Yes. For example, if someone died because of vehicular accidents, we obviously need to determine if
the person’s cause of death is due to the injuries caused by such accident by conducting post-mortem
examination.

Q: Whenever there is death because of vehicular accidents, do you usually go to the scene of accident?

A: Occasionally.

Q: In this case, did you visit the place where the collision happens?

A: Yes.

Q: So, are you certain that the cause of death of the victim, which are CEREBRAL CONTUSION secondary
to SEVERE TRAUMATIC HEAD INJURY, is because of the vehicular accident?

A: Yes.

Q: Did you check the police reports?

A: Yes.
Q: Did the police report matched your findings?

A: Yes.

Q: Are you the one who prepared, issued and signed this Autopsy Report?

A: Yes.

Q: Do you attest to the truthfulness of your statements in this affidavit?

A: Yes.

I am executing this judicial affidavit to attest to the truthfulness of all the foregoing facts and
circumstances.
