Constitution of Pakistan 1973
(Constitution Making and Salient Features)

Constitution making:

April 14, 1972: The first session of the National Assembly of Pakistan in the State Bank Building,
Islamabad. 142 members took oath.

April 17, 1972: The Interim Constitution adopted and 25- member Constitution Committee was
appointed to prepare a draft of the Constitution of Pakistan by 1 st August, 1972. Mian Mahmud
Ali Kasuri was the nominated Chairman.

April 22, 1972: First meeting of the Constitution Committee was held.

August 14, 1972: Mian Mahmud Ali Kasuri moved a motion for extension of time for the
submission of a draft of constitution by the Constitution Committee up to the 31 st of December,
1972. The motion was adopted on 16th August, 1972.

October 9, 1972: Mian Mahmud Ali Kasuri vacated the Chair of the Constitution Committee and
Mr. Abdul Hafeez Pirzada was unanimously elected to Chair the Committee.

October 17-20, 1972: In view of the impending constitutional discussions, President Zulfiqar Ali
Bhutto invited the leaders of all Parliamentary parties and groups. Subsequently a Constitutional
Accord was signed on 20th October, 1972, that settled major issues pertaining to the future
Constitution.

December 31, 1972: The draft-Constitution presented in the National Assembly of Pakistan by
Mr. Abdul Hafeez Pirzada.

February 2, 1973: The bill to provide a Constitution for the Islamic Republic of Pakistan was formally
introduced.
April 10, 1973: The National Assembly passed the Constitution of 1973 with 125 votes.

April 12, 1973: The President of Pakistan authenticated the Constitution of 1973 as passed by the National
Assembly of Pakistan.

August 14, 1973: The Constitution of 1973 was enforced.

Salient features of Pakistan

 Sovereignty of Allah

Sovereignty over the entire universe belongs to Almighty Allah and the authority
bestowed by him on men is a scared trust which the people of Pakistan will exercise with
the limits prescribed by Quran’s and Sunnah.
 Country Name
Pakistan shall be known as “Islamic Republic of Pakistan”.

 Official Religion of the State


Islam shall be the state religion of Pakistan.

 Muslim President and Prime Minister


The constitution laid down that only Muslims shall be elected President and Prime
Minister of Pakistan. Non non-Muslim could hold these offices.

 Definition of a Muslim

The constitution also gives the definition of a Muslim. A person who believes in Tauheed
or Oneness of Allah, and in the prophet hood of Hazrat Mohammad (P.B.U.H) as the last
prophet of Allah has described as a Muslim.

 Protection of Islamic Laws

All the existing laws will be brought into conformity with Islamic principles and no law will
be enforced, which is repugnant to the teachings of Islam.

 Compulsory Islamic Teaching and Holy Quran


The state shall try to make the teachings of Holy Quran and Islamic Studies compulsory
to encourage and facilitate the learning of Arabic language.
 Teaching of Arabic and printing of Quran
The teaching of Arabic will be compulsory from 6 to 8 classes in schools and printing of
Quran will be made error free.

 Islamic Values
Islamic values for example, democracy, liberty, equity and equality will be the main
objectives of the Constitution.

 Islamic System
The inclusion of Islamic Provisions ensures an Islamic system in the country

 Zakat and Usher


The government will established the system of Zakat and Usher by establishing the
Zakat and Usher Councils.

 Elimination of Riba
The government will eliminate Riba and make the economy of the country free from
Riba

 Council of Islamic Ideology


There is a council of Islamic ideology which shall guide the government in respect of
Islamic techniques, their implementation and propagation. It’s Chairman and members
are appointed by President. Although its advice is not binding on the government yet it is
not essay for any government to ignore or over rule its suggestion or opinion regarding
any law.

 Unity of Islamic World


Government will give full attention towards the unity of Muslims world.

 Strengthen Bond with Muslim World


The state shall endeavor to strengthen fraternal relations among Muslim countries in order to
promote Islamic unity.

 Free Judiciary
Judiciary shall be independent and will work without any political and economic
pressure.
