EXTENSION OF LEASE AGREEMENT

KNOW ALL BY MEN BY THIS PRESENTS:

This Agreement of Lease made and entered into and between;

The Lessor: DR. Nicolas T. Balais, of legal age, Filipino,


married and a resident of Dagupan Tabuk, Kalinga Province, herein
called as PARTY I.

The Lessee: Alvin C. Antimano, of legal age, Filipino and


temporarily residing at No. 625 Gen. Tinio Street, Cabanatuan City,
Nueva Ecija, herein called as PARTY II.

W I T N E S S E T H: That

Whereas, the PARTY I is the owner in fee simple of a certain


parcel of land situated in Dimasalang, Cabanatuan City, Nueva Ecija
and more particularly described as follows:

“T-42060 North Lot 15, Block 1 subd. plan South Lot 11, Block 1
subd. plan Southest Gen. Tinio Street, Northwest Lot 13, Block 1,
subd. plan with an area of TWO HUNDRED FIFTY SEVEN (257) SQUARE
METERS, more or less.

Whereas, PARY I has offered to leased and the lessee has agreed
to rent the above-mentioned property.

Now Therefore, PARTY I, hereby lets and lease unto PARTY II, the
above-described property under the following terms and conditions:

The monthly rental shall be EIGHT THOUSAND PESOS (Php.8,000.00),


as to be paid by PARTY II at the bank savings account of PARTY I on or
before the fifth (5th) day of each month and every month thereafter, it
is expressly agreed and understood. That the payment of the rental
herein stipulated shall be made without the necessity of express
demand and without delay on any ground whatsoever;

The term of this agreement is for a period of one (1) year


commencing on August 1, 2013 and expiring on July 20, 2014. However,
it was further and expressly agreed upon by PARTY I and PARTY II that
this Contract of Lease Agreement shall become due and terminated
anytime should there be a buyer on the said parcel of land as
described above after giving due course on the “Right of First
Refusal” of Lease;

That PARTY II it shall use the promises as junkyard only for his
legitimate surplus business;

That PARTY II shall borne the electrical and water bills should
he choose to install such facilities for his personal consumption, and
maintain he proper cleanliness of the premises;

That PARTY II promise not to put a permanent structure like


concrete and G.I sheet made building, but rather detachable structure
only;

That the PARTY II, shall borne the expenses on the detachable
improvements should it be necessary and necessity for the operation of
his business;
Taxes and assessments shall be for the account of the PARTY I and
business permits will be at the account of PARTY II;

Upon the signing of this agreement PARTY II (Lessee) shall pay by


way of two (2) months deposit and one (1) month advance rental unto
the lessor or PARTY I, the sum of TWENTY FOUR THOUSAND PESOS
(Php.24,000.00) to cover the purpose it may serve; and/or maintain the
previous two (2) months deposit of FORTEEN THOUSAND PESOS
(Php.14,000.00) as this contract is a mere extension;

Should there be any infringement in this contract, it has been


expressly agreed upon by both parties that venue of litigation shall
only be in Dagupan, Tabuk, Kalinga Province.

IN WITNESS WHEREOF, both parties have hereto set their hands this

the same persons who executed the foregoing Contract of Lease
consisting of two (2) pages including this page where the
acknowledgement is written, signed by both parties on each and every
page hereof and further acknowledge to me that the same is their free
and voluntary act and deed.
