09-03-20 Fine v Sheriff (2:09-cv-01914) Dkt #002 Referral to Magistrate Carla Woehrle and

On March 20, 2009, former US prosecutor Richard Fine filed his Habeas Corpus Petition at the US District
Court, Central District of California, naming Leroy Baca, Sheriff of Los Angeles County as Respondent.
The March 20, 2009 Notice of Reference to a US Magistrate Judge (Dkt #2), was issued with an invalid
signature box: [page 2, below]
a) The Deputy Clerk, who issued the record was never identified by name, only listed as ‘Deputy Clerk’.
b) The typed signature ‘CSAWYER’, is not a valid form of signature.
Access to the attestation/authentication record (NEF) of the Notice of Reference was denied, regardless of
repeated requests. However, access was gained to the dispositive records in this case - the Judgment and the
Mandate – and both were ‘entered’ in the docket with invalid NEFs as well.
Furthermore, in a similar case (Zernik v Connor et al) Referral to Magistrate Carla Woehrle was discovered
with no valid signature and no valid attestation (NEF), as was the case for all judicial records that Magistrate
Woehrle later issued in that case. [i ]
Therefore, it is believed that upon investigation it would be discovered that no valid attestation was entered for
the March 20, 2009 Notice of Reference of Magistrate Carla Woehrle in Fine v Sheriff .
Regardless, the invalid signature on the March 20, 2009 Notice of Reference is sufficient to conclude that
Magistrate Woehrle was acting in the case with no valid Referral, and with no authority at all.

Pursuant to General Order 07-02, the within action has been assigned to the calendar of the
Honorable Dean D. Pregerson, U.S. District Judge. Pursuant to General Order 05-07, the within
action is referred to U.S. Magistrate Judge Carla Woehrle, who is authorized to consider preliminary
matters and conduct all further hearings as may be appropriate or necessary. Thereafter, unless the
Magistrate Judge determines that an evidentiary hearing is required, the Magistrate Judge shall
prepare a report and recommendation and file it with the Clerk of the Court which may include
proposed findings of fact and conclusions of law where necessary or appropriate, and may include a
proposed written order or judgment, which shall be mailed to the parties for objections.

Pleadings and all other matters to be called to the Magistrate Judge's attention shall be formally
submitted through the Clerk of the Court.

The Court must be notified within fifteen (15) days of any address change. If mail directed by the
clerk to your address of record is returned undelivered by the Post Office, and if the Court and
opposing counsel are not notified in writing within fifteen (15) days thereafter of your current
address, the Court may dismiss the petition with or without prejudice for want of prosecution.
