CONDITIONAL DONATION

KNOW ALL MEN BY THESE PRESENTS:

This Deed entered into by and between:

ROMEO G. GUANZON, of legal age, Filipino, married to Teresita

Regalado Guanzon and a resident of Aguinaldo St.,Bacolod City, Philippines,
(hereinafter referred to as the “DONOR”)

– and –

PHILIPPINE NATIONAL POLICE-Bacolod, represented in this

instance by City Director Henry F Gomez, likewise of legal age, Filipino ,
married and with business address at c/o PNP, Taculing, Bacolod City, (herein
referred to as the “DONEE );

WITNESSETH:

WHEREAS, the DONOR is the owner in fee simple of a certain real

property, situated in Barangay Mansilingan, Bacolod City, Negros Occidental
more particularly described as Lot 971-E-2 in the OCT/TCT No.T-18793 of
the Land Registry of Bacolod City more particularly listed and described in
Annex “A” and attached hereto and made an integral part hereof;

WHEREAS, the DONOR is desirous of donating a portion of Five

Hundred (500) SQUARE METERS of his above-described parcel of land and
the DONEES hereby accept the same;

NOW, THEREFORE, for and in consideration of the civic and moral

duty and as pure act of liberality and generosity, the herein DONOR by these
presents transfers and conveys, by way of DONATION, a portion of FIVE
HUNDRED(500) SQUARE METERS of the above-described land unto the
DONEE, under the following terms and condition, to wit:
 1. That this lot is presently mortgaged with PNB, so that the donation is
subject in the approval of the latter;

2. That the DONEE shall within one (1) year put up, construct and
establish a PNP Sub-station with complete manpower, equipment and facilities,
otherwise, failure on the part of the DONEE to put up, construct and establish
a functional PNP Sub-station within one(1) year, this contract shall
automatically rescinded;

3. That in the event that the donated property is not used for the purpose
it was donated, that is, to put up and establish a PNP Sub-station then this
donation shall automatically rescinded and the property shall automatically
revert back to the DONOR;

WHEREAS, the DONOR does hereby state, for the purpose of giving
full effect to this donation, that he reserved for himself in full ownership
sufficient properties to support him in a manner appropriate to his needs;

WHEREAS, the DONEE does hereby accept through its representative,

CITY DIRECTOR HENRY F.GOMEZ this donation of the above-described
real property and does hereby express its gratitude for the kindness and
liberality of the donor.

IN WITNESS WHEREOF, we have hereunto set our hands, this 8th day
of January 2020 at Bacolod City, Philippines
