The Motion for Claim of Right to Possession filed for Dominique Walker was set for hearing on
12/30/2019 at 09:00 AM in Department 511 before the Honorable Patrick R. McKinney. The Tentative
Ruling was published and was contested.

The matter was argued and submitted, and good cause appearing therefore,

IT IS HEREBY ORDERED THAT:

The post-judgment claim of right to possession filed by Dominique Walker is DENIED.
Claimant Walker appeared through counsel and the court took argument from both parties, At thc hearing,
Ms. Walker stipulated that she did not occupy the subject property, located at 2928 Magnolia Street,
Oakland, on the date this action was filed, and had no agreement "ith the prior owner or the new owner.

The court considered, and denied, Ms. Walker's request to proffer testimony through expert witnesses
concerning federal and international legal authorities regarding the right to housing. The court recognizes
the importance of these issues but, as raised in connection with Ms. Walker's claim of right to possession,
finds that they are outside the scope of this proceeding.

After consideration of the evidence submitted and the arguments of counsel, the court finds that claimant
has no valid claim of possession to the subject property. (CCP § 1174.3(d).)

The court hereby makes the following order:

The levying officer is ORDERED to proceed with enforcement of the of possession of real property issued
on 11/22/19, as deemed amended to include claimant Dominique Walker, which shall be effected within a

Upon receipt of the court's order, the levying officer shall enforce the of possession against any occupant
or occupants. (CCP § 1 174.3(g).) SO ORDERED,

The courtroom clerk is directed to the levying officer immediately regarding this order.
