Dear Sir,
I am concerned for my client, M/s. Sona Steel Enterprises
having its office at 301, Vyapar Bhavan, 368/370, Narsi Natha Street,
Masjid, Mumbai 400 009, who has instructed to write to you under
following circumstances :

1. My client says that my client is in business of sale and


supply of HR/CR/GP metal sheets and that you are known to my
client as you No.1 company is a regular customer of my client and you
No.2 and 3 have placed several orders for and on behalf of you No.1
for purchase of aforesaid material from my client.

2. My client says that in the course of business on 29th June


2015 you placed an order with my clients for purchase of MS Pipes.
Accordingly on 4th July 2015 my client sold, supplied and delivered to
you the aforesaid material and have raised invoice bearing Invoice
No.E1591 dated 04.07.2015 for Rs.1,61,456/-.

3. My client says that you have accepted the material


supplied by my client without any complaint of whatsoever nature in
respect of the quantity, quality, price and/or size. However, you have
failed and neglected to make payment to my client for the material
supplied by my client.

4. My client says that after several requests and follow up


from my client, in discharge of your legal liability against the cost of
material supplied by my client, you issued to my client a cheque
bearing No.142013 dated 31st December 2016 drawn on Bank of
Maharashtra, Satpur Branch for a sum of Rs.1,27,998/- towards part
payment of the aforesaid invoice,. However, you No.2 and 3 had
requested my client to bear with you for sometime and not to deposit
the cheque and further assured and promised that the question would
be honoured on presentation positively.

5. My client says that considering your business relations


with my client, my clients acceded to your request, and presented the
abovementioned cheque on 27th March 2017 with its banker Union
Bank of India, Khand Bazaar Branch, Mumbai. However, on 29th
March, 2017 my client received the unpaid cheque with Cheque
Return Memo issued by its banker Union Bank of India, Khand
Bazaar Branch, Mumbai with an endorsement “Payment Stopped by
Drawer”.

6. My client says that you have deliberately and knowingly


instructed your banker to stop payment with intention to cheat my
client. Thus after issuing the aforesaid cheque bearing No.142013
dated 31st December 2016 drawn on Bank of Maharashtra, Satpur
Branch for a sum of Rs.1,27,998/- you have failed and neglected to
pay to my client the cheque amount, which you are legally liable to
pay to my client.

7. Under the aforesaid circumstances, you are hereby called


upon to pay to my client the cheque amount of Rs.1,27,998/- (Rupees
One Lakh Twenty Seven Thousand Nine Hundred Ninety Eight Only)
within a period of 15 days from receipt of this notice failing which my
client shall be compelled to initiate appropriate legal proceedings
against you for recovery of the aforesaid amount and in that event you
shall also be liable to pay the costs of the proceedings.

Kindly note that if you fail to make the aforesaid payment


of the dishonoured cheque within the stipulated period of 15 days
from the date of receipt of this notice, you would render yourself liable
to be prosecuted as per the provisions of the Negotiable Instruments
Act, 1881.
