PROS. MARASIGAN:
Mr. Witness, during your last testimony you
made mentioned of the Inventory you made
reference to your Sworn Statement. Now, with
respect to that Inventory, I’m showing to you
the pieces of evidence that you marked and
confiscated from all of the accused. Please
identify said pieces of evidence as you stated in
this Inventory.

You have identified a while ago these pieces of
evidence, Mr. Witness. I am presenting to you
again the specimen. Can you point to this
Honorable Court what specimen did you recover
or seized from each of the accused? Let’s start
with Aaron Padica.

A: Naka-recover po kami sa kanila ng tig-iisa pong

methamphetamine.

Q: Which of the five specimen did you seize or

recovered from accused Padica?

A: Aaron Padica.

Q: And where did you get that one from the

accused, Mr. Witness?

A: Noong pinalabas din po namin sa bulsa nila

iyon… (When we asked them to lay out their
pockets.)

Q: What about Willie Bernales?

A: Willie Bernales po.

accused?

A: Ganoon din po, pinalabas din po namin sa bulsa

nila iyong mga gamit nila.

Q: And where did you get that one, Mr. Witness?

A: Noong pinalabas din po namin iyong bulsa nila.

Q: Aside from those specimen, Mr. Witness, did

you recover any other items or things from
their pocket?

A: Wala na po, iyon lang po.

Q: This means, Mr. Witness, that when you asked

them to empty their pocket, only the heat
sealed transparent plastic sachets were
recovered from them?

A: Opo.

Q: No money whatsoever? No cellphones?

A: Iyong pera po nasa lapag lang po kasi

nagsusugal po sila.

Q: From their pockets?

A: Wala po.

Q: You identified also a while ago the Receipt

Inventory for Property Seized. I’m showing to
you the document marked by the Prosecutor as
Exh. “C”. Would you agree with me, Mr.
Witness, that no signature of accused appears
on the document?

that there’s no proof that you furnished the
receipt inventory to the accused?

A: Wala po, Ma’am, kasi pinirmahan ko lang po.

Q: So on this document you would agree with me

that there is no proof that you furnished this

A: Noong ginagawa po namin iyan…

A: Iyong isa rin po doon sa Bantay Bayan po.

Q: And are you sure that she is a Bantay Bayan?

A: Opo.

Q: Not the wife of one of the accused Roldan

Faraon?

A: Hindi po.

55 years old ano?

A: 35, Your Honor.

In the conduct of drug operation, have you
undergone training or seminar regarding the
proper application of dangerous drugs law?

A: Wala pa po, Your Honor.

Do you know that under Sec. 21, requirement
na a copy of the inventory must be given to the
accused or to his representative. Alam mo ba
iyon?

A: Hindi po nai-ano sa akin iyong investigator po

namin, Your Honor.

COURT:
Kasi wala pa kayong training ano?

A: Yes, Your Honor.

COURT:
Okay, I think that would be all. Thank you very
much. Fiscal, sinong next witness mo?

PROS. MARASIGAN:
Your Honor, we no longer have any witnesses to
present.

COURT:

We will formally offer our documentary exhibits.

How many days? You want to make it oral or
you want how many days?

May I manifest for the record, Your Honor, that
there appears to be some confusion with
respect to the marking. There is a pre-trial

We will think over it. We might file a demurrer
to evidence, Your Honor.

ORDER

In today’s hearing, all of the accused are

present except for accused Willie Bernales. The
prosecution’s witness, PO2 Jesus Giray is also
present.

The Public Prosecutor presented PO2
Jesus Giray and the witness underwent direct,
cross, and clarificatory questions from this
Court for which the testimony of said witness is
hereby terminated. The Public Prosecutor
manifested that they have no more witnesses
to present and asked for a period of time to
formally offer their exhibits.

As prayed for, the Public Prosecutor is

hereby given a period of fifteen (15) days to
file their offer of evidence, and the Public
Attorney’s Office is hereby given an equal
period of fifteen (15) days to file their
comment thereto. Afterwhich, the prosecution
rested its case today, trial shall proceed on
October 21, 2020 at 1:30 o'clock in the
afternoon for the accused to present and
terminate his evidence.

SO ORDERED.
