1 MR.

PARKS: Oh --

2 A. You're asking me --

3 MR. ROSS: What did God tell you to do?

4 A. You're asking me --

5 MR. PARKS: Oh, let's call bull shit on that right

6 away, Brian. Let's call bull shit on that.

7 A. I'm Immanuel David Isaiah.

8 MR. PARKS: Hey, Immanuel --

9 MR. ROSS: I call bull shit on that, Immanuel.

10 MR. PARKS: You're talking about sex.

11 A. You're asking me to talk about things which are

12 sacred and holy.

13 MR. ROSS: So it was holy to have sex with her?

14 MR. PARKS: Sacred and holy?

15 MR. ROSS: Sacred and holy to have sex with a

16 14-year-old girl.

17 A. There you go. No. What you asked was, what does

18 it mean to receive her?

19 MR. ROSS: Yeah.

20 A. That's all you asked.

21 MR. ROSS: Give me an explanation.

22 A. And all I did is say, when you asked me the

23 question, what does it mean to receive her, then my answer

24 was, you're asking me to speak about things which are sacred

25 and holy, which I cannot talk about.

76
1 MR. PARKS: And I'm calling bull shit.

2 MR. ROSS: So am I. I call it a copout.

3 MR. PARKS: I call it bull shit. You're copping

4 out.

5 A. Call it whatever you want.

6 MR. ROSS: You're pretty cocky. That's what I see.

7 I see you sitting back there, you know, and spinning all of

8 this theological bull shit to cover up the fact that you

9 were -- wanted to take the 14-year-old girl as your own, so

10 you snuck in the bedroom during the middle of the night while

11 she's laying there with her nine-year-old sister in bed. You

12 hold a knife to her throat and say, you're coming with me.

13 MR. PARKS: This is not sacred and holy. This is

14 much more simple than that. This is about what you wanted.

15 This is about Wanda is a faithful follower, and she's been

16 with you through thick and thin. But she's a little old.

17 She's getting a little over weight.

18 MR. ROSS: Probably not as good looking as she

19 used to be.

20 MR. PARKS: Not as attractive, you know, over --

21 MR. ROSS: Elizabeth is a beautiful girl.

22 MR. PARKS: And she's beautiful, and she's thin.

23 MR. ROSS: Beautiful.

24 MR. PARKS: And she's compliant, and she's

25 obedient. She's everything that anyone could ever want.

77
1 MR. ROSS: From a woman.

2 MR. PARKS: And if she could just listen and be

3 with you, and you can talk to her and she'll obey you, and

4 she'll believe you and she'll follow you, and she would make

5 you a wonderful wife.

6 MR. ROSS: Bear you children.

7 MR. PARKS: There you go. And if that's your story

8 we're here to hear that.

9 A. That's not my story. That's your accusation, and

10 it's false.

11 MR. PARKS: It's my accusation. So if my

12 accusation is false, what --

13 A. I told you. I told you the truth.

14 MR. PARKS: God called her to you, you said. God

15 called her to be your wife.

16 A. Yes, sir, he did.

17 MR. PARKS: Be your wife to have sex with the

18 husband, so the two can be as one, man and woman joined

19 together; is that not right? What God has put together, let

20 no man put asunder. God called Elizabeth to be your sexual

21 partner and to be a good -- to be your wife and to be your --

22 A. You blasphemy God.

23 MR. PARKS: I do not blasphemy the scriptures or

24 blasphemy God.

25 A. The devil can quote scriptures, too.

78
1 MR. ROSS: So --

2 MR. PARKS: This is what happened. God called

3 Elizabeth to you to be your obedient wife, your 14-year-old

4 virgin. Pure.

5 MR. ROSS: Beautiful blonde.

6 MR. PARKS: I called to you for your --

7 A. I told you in God's eyes she was 18.

8 MR. ROSS: Clean.

9 A. In God's eyes she's 18.

10 MR. ROSS: In God's eyes she's 18?

11 A. In god's eyes she's 18.

12 MR. PARKS: In the real world, in our eyes she's

13 14.

14 A. In God's eyes she's 18. And she chose, and she

15 willingly chose to be sealed as my wife.

16 MR. PARKS: She chose to be sealed to you? You

17 know, this is what we call a break-thru because we want you to

18 talk about your relationship with her. If your relationship

19 with Elizabeth Smart is good and holy and ordained by God, we

20 want to hear about.

21 A. That's all you need to know about it. You said it

22 all.

23 MR. PARKS: You know --

24 A. Though you don't believe it. That's all you need

25 to know. So --

79
1 MR. PARKS: So did Elizabeth show up in your camp

2 one day led there by the Lord? If you have nothing to be

3 ashamed of in this relationship, we really want to hear how it

4 came to be.

5 A. You're both working very hard.

6 MR. PARKS: We're working hard because we want your

7 story. You have a story.

8 A. You're working very hard. Both of you are working

9 very hard.

10 MR. ROSS: Do you want to know why we're working

11 hard?

12 A. I already know why you're working hard.

13 MR. ROSS: Why's that? Why?

14 A. Because you believe in what you're doing, and you

15 like to do a good job. What you believe is all the things

16 you've accused me of, so you're working really hard --

17 MR. ROSS: Elizabeth has accused you of it, too.

18 A. -- working really hard.

19 MR. ROSS: Elizabeth accused you of it.

20 A. You're working really hard.

21 MR. ROSS: How come when we asked Elizabeth what

22 happened, she didn't say that she was delivered to Immanuel

23 David Isaiah by the Lord and accepted it?

24 A. I can just imagine why she would say the things you

25 wanted her to say.

80
1 MR. ROSS: No. No. We simply asked her, where

2 have you been?

3 A. She -- I can just imagine why she would say the

4 things you want her to say.

5 MR. ROSS: We don't want to, you know --

6 MR. PARKS: Brian, I talked to Elizabeth in the

7 Sandy police station. I had a little short interview with her

8 out there. She told me that you, not anyone else, not anyone,

9 but you appeared in her bedroom and held a knife on her and

10 took her out of the house under threat of harming the family,

11 and that you walked her to a campsite where Wanda was, and

12 that you tethered her, kept her for days. You and Wanda

13 demonstrated to her how to perform sex, and she was forced to

14 have sex with you. Brian, these are not actions --

15 A. Immanuel David Isaiah.

16 MR. PARKS: You're changing the subject, Brian.

17 A. I'm not -- you're not being a friend to me. You're

18 using intimidation.

19 MR. ROSS: We'll talk to you.

20 A. You're not a friend to me.

21 MR. ROSS: Okay. Let me ask you this, Immanuel.

22 We have plenty of time today.

23 A. You're putting your arm around me is not that of an

24 arm of a friend.

25 MR. ROSS: Is this anything worse, though, than

81
1 what you did to Elizabeth?

2 A. What are you --

3 MR. ROSS: I'm asking you a question.

4 A. All I'm saying is what I did was I did --

5 MR. ROSS: You did what? You almost answered the

6 question.

7 MR. PARKS: You know, Brian, whenever we get too

8 close to the truth --

9 MR. ROSS: Out comes the Bible.

10 MR. PARKS: -- out comes the Bible.

11 A. I told you all I've done is obedience to the Lord.

12 MR. ROSS: Get back to the Bible stuff.

13 MR. PARKS: You're under your defense mechanism

14 because we got a little close to the truth there.

15 MR. ROSS: Yeah. You talk about putting his arm

16 around you, is that anything worse than what you did to

17 Elizabeth? And all of a sudden the Bible comes out. So let's

18 go back again.

19 A. I haven't done anything. I haven't done anything

20 to Elizabeth except the Lord God --

21 MR. ROSS: Okay. So you did some stuff to her, but

22 God told you to do it?

23 A. I received her, I received her as my wife according

24 to the commandment of the Lord.

25 MR. ROSS: Okay. So somehow she had to get to your

82
1 campsite. She says you got into the bedroom and took her

2 there.

3 MR. PARKS: She said she was forced to go.

4 MR. ROSS: This wasn't something that was

5 preplanned that she knew about it ahead of time and had her

6 bags packed.

7 MR. PARKS: God didn't deliver her to you, you went

8 and got her.

9 A. You can get her to believe many lies and

10 accusations.

11 MR. ROSS: Like the lie to know you're a servant of

12 the Lord?

13 A. You can get her to believe many lies and

14 accusations.

15 MR. ROSS: Did you get her to believe any? Did you

16 get her to believe any?

17 A. I did not get her to believe anything. The Lord

18 brought her to the knowledge of the truth.

19 MR. ROSS: So you got her to believe that she was

20 your wife.

21 A. I didn't get her to believe anything. The Lord

22 brought her to the knowledge of the truth.

23 MR. ROSS: So her knowledge of the truth is what,

24 that you're a servant of the Lord and she should have sex with

25 you and she should be your wife and that she should bear your

83
1 children and she should be sealed to you?

2 A. You know, this isn't going anywhere. I didn't say

3 that.

4 MR. PARKS: Well, we agree, because you keep

5 sending us off on tangents, so when we get to the very --

6 MR. ROSS: When we get real close to stuff, then it

7 gets interesting because, you know, all these theological

8 stuff starts spewing out of your mouth and makes no sense to

9 anybody sitting in the room.

10 A. No. And it didn't when Christ spoke, either.

11 MR. ROSS: You're not Christ.

12 MR. PARKS: You're not Christ. You may have a

13 resemblance to him with the beard and long brown hair.

14 A. I never said that I was. And I need to use the

15 restroom again, if that's possible. I need another drink of

16 water, if that's possible.

17 MR. PARKS: Yes. That's possible.

18 MR. ROSS: Let's just check and make sure

19 everything is clear.

20 MR. PARKS: You wait here, and I'll be right back.

21 MR. ROSS: All right. It's clear.

22 (Defendant leaves and returns singing.)

23 MR. PARKS: We appreciate that. We can use a break

24 now and then. Brian --

25 (Defendant is still singing.)

84
1 MR. PARKS: I know the song, too, Brian. I like

2 the song, too. (Unintelligible).

3 MR. ROSS: Did you sing this to Elizabeth?

4 MR. PARKS: No. We sang it at church. I never

5 ever sang it at a campsite where I had a 14-year-old girl

6 tethered up.

7 MR. ROSS: Right before you had sex with her?

8 MR. PARKS: Before I raped her.

9 MR. ROSS: Did you ever sing it before you held a

10 knife to a 14-year-old girl's throat?

11 MR. PARKS: No.

12 MR. ROSS: Neither did I.

13 (Time lapse.)

14 MR. ROSS: You're going to need something.

15 MR. PARKS: Are you going to come to the savior?

16 Immanuel, it's time to talk again. Immanuel.

17 Immanuel.

18 MR. ROSS: How many more versus is it in this song?

19 I grew up Catholic. We don't have this song.

20 MR. PARKS: Four.

21 MR. ROSS: Four? So this is number two.

22 MR. PARKS: Immanuel, we're going to wait right

23 here while you hide in your song. And when you're done

24 singing, you're going to have to come out and talk to us.

25 MR. ROSS: You can't sing forever. You can't sing

85
1 forever.

2 (Defendant still singing; time lapse.)

3 MR. PARKS: Immanuel --

4 MR. ROSS: How about giving us the truth?

5 (Time lapse.)

6 MR. PARKS: I'm actually waiting for digital

7 photos.

8 MR. ROSS: Okay.

9 MR. PARKS: Waiting for Jason to come.

10 MR. ROSS: I gotcha. I thought you were waiting

11 for Amazing Grace.

12 MR. PARKS: No. We can wait for that, too. I'm

13 waiting for Jason to get here.

14 MR. ROSS: Or Swing Low, Sweet Chariot.

15 Sad, he doesn't know the rest of the words.

16 MR. PARKS: That's the problem with Brian is he

17 puts on the airs of being a great Christian, but when it comes

18 down to real substance, I'm afraid there's no substance to it.

19 I'm going to see where Jason is.

20 MR. ROSS: All right.

21 (Mr. Parks left the room.)

22 (Defendant still singing.)

23 MR. ROSS: Got hung up on that one. It's a tough

24 note.

25 (Defendant stopped singing.)

86
1 (Mr. Parks returned to the room.)

2 MR. PARKS: Brian, I'd like to take a couple of

3 your pictures. Would you mind standing up?

4 UNIDENTIFIED PERSON: You tell me which pictures

5 you want.

6 MR. PARKS: Oh, just do a bunch. Do a couple

7 close-in head shots and face shots.

8 UNIDENTIFIED PERSON: It may not be --

9 MR. ROSS: Does he have any tats or anything?

10 MR. PARKS: I don't believe he does. He doesn't on

11 the records that I have on him.

12 UNIDENTIFIED PERSON: Slide a little bit, and we'll

13 just get the whole thing of you. Step back just a little bit

14 because I'm trying to get some distance here.

15 MR. PARKS: Do you have any tattoos?

16 UNIDENTIFIED PERSON: Do want this, too?

17 MR. PARKS: Oh, yeah. Take a bunch.

18 MR. ROSS: Take a profile, too.

19 UNIDENTIFIED PERSON: How about looking at this

20 handsome gentleman right there.

21 All right. How about looking at the wall for me.

22 In fact, why don't you just step this way a little bit so we

23 can get a little more light on you.

24 MR. ROSS: Any scars or anything?

25 MR. PARKS: Immanuel, do you have any tattoos? Any

87
1 scars or anything like that?

2 A. No.

3 MR. ROSS: Any wounds or anything?

4 A. (Witness indicates by shaking head from side to

5 side.)

6 UNIDENTIFIED PERSON: I'll go give this to Ron and

7 we'll make sure it worked.

8 MR. ROSS: Have a sit, Immanuel.

9 MR. PARKS: Sit down. We got awfully

10 confrontational (unintelligible), but honest to goodness, can

11 I explain some things to you? Your --

12 (Defendant is singing.)

13 MR. PARKS: Are you going to hide in your songs?

14 A. I am the Lord Jesus Christ.

15 MR. ROSS: Quoting the Bible can't work anymore.

16 We're onto it. We've got to find a way to crack this new

17 defense mechanism.

18 MR. PARKS: I've read the Bible. And when I read

19 the Bible I remember the scriptures about little children and

20 how you're not to harm them. And, Brian, I'm just wondering,

21 are you going to tie a millstone around your neck and jump in

22 the lake like the Lord commanded that you should do? If you

23 are a servant of the Lord, you should obey his commandments.

24 And, Brian, you have not obeyed the Lord's

25 commandments. In fact, you've been rather bad, Brian. Sin

88
1 against a child, Brian.

2 MR. ROSS: God forgive the sinners.

3 MR. PARKS: God will not forgive some sins.

4 Harming children is one of the sins that will not be forgiven,

5 Brian, ever.

6 You know, this is a great mechanism that you've

7 come up with here.

8 MR. ROSS: Yeah.

9 MR. PARKS: You need to talk to us. Honest to

10 goodness, let's take --

11 A. Get thee behind me, Satan.

12 MR. PARKS: We're on your side.

13 A. Get thee behind me, Satan. Get thee behind me

14 Satan.

15 MR. PARKS: I'm not Satan, and I'm right here. I'm

16 Cordon Parks.

17 A. Get thee behind me, Satan.

18 MR. PARKS: I want a rational explanation --

19 A. Get thee behind me, Satan.

20 MR. PARKS: If you're prophet of God --

21 A. Get thee behind me, Satan.

22 MR. PARKS: You have no power.

23 A. Get thee behind me, Satan.

24 MR. PARKS: You have no power, Brian.

25 A. Get thee behind me, Satan.

89
1 MR. PARKS: You have no power.

2 A. Get thee behind me, Satan.

3 MR. PARKS: You do not speak for Jesus, Brian.

4 MR. ROSS: This is a new defense mechanism.

5 MR. PARKS: You do not speak for Jesus. You have

6 no power over me. You have no power over anybody. You are

7 not a servant of the Lord because you have sinned. You have

8 harmed a child in direct contradiction to Jesus Christ's

9 commandments. You need to evaluate your life here, Brian. We

10 want your explanation of what happened. That's all we want.

11 MR. ROSS: That's why you're here.

12 MR. PARKS: That's why you're here. You have to

13 come back to the secular world for a few minutes, and you have

14 to explain your actions because we need to explain your

15 actions.

16 (Unidentified person entered the room.)

17 UNIDENTIFIED PERSON: They were a little dark, so I

18 can turn the flash on to take another disk of whichever ones

19 were dark.

20 MR. PARKS: Go away. Go away.

21 UNIDENTIFIED PERSON: Sorry.

22 (Unidentified person left the room.)

23 MR. PARKS: Okay. You have to get down to the core

24 of the earth, Brian, and you have to give us a secular

25 explanation of what happened. You don't have any power here.

90
1 You don't speak for Jesus Christ. You have done things that

2 are sins and in direct contradiction to scriptures. We

3 actually don't hate you. We really don't.

4 MR. ROSS: We just want an explanation for what

5 happened, so we can bring it back to the family.

6 MR. PARKS: Honest to God, you do have to sit up

7 straight, and you do have to take some responsibility for your

8 actions. And if you don't think that you were doing anything

9 wrong, then we are going to hear that, too, okay. We have

10 been bad. We have belittled you, and we have called you a

11 fraud and done all kinds of things because you haven't been

12 truthful with us and you haven't given us explanations. We're

13 really ready to listen. We have to hear your story to tell

14 the judge.

15 So will you talk us? Brian, will you talk to us?

16 MR. ROSS: Listen, we're going to have a lot more

17 patience. We've waited nine months to learn of this. And we

18 can out wait you on this. So we're not going away, and you're

19 not leaving here. All it takes is a couple minutes to explain

20 what happened in a way that we can understand. That's it.

21 MR. PARKS: Yeah. If you don't live in the world

22 you've got to come back to us to the secular world to just

23 make your explanations, okay.

24 MR. ROSS: And if you never would have taken her,

25 we never would have to have this conversation. You could go

91
1 live wherever you want to go live.

2 MR. PARKS: Right now all we have is Elizabeth's

3 explanations of the events of what happened. And quite

4 frankly, they make you look really, really bad. They do. I

5 mean, there's no question about who did it. And there's

6 really no question about the motive for it, and there's just

7 no question about what happened. You've got to stand tall for

8 some pretty serious accusations and crimes, and we've given

9 you have every opportunity to give us a rational explanation

10 of what transpired and give us your side of the story.

11 And we are very confused by your actions. You

12 proclaim that you have done nothing wrong, even though what

13 you have done is directly in contradiction to state laws and

14 federal laws and God's laws. And whenever we get close to

15 asking you what happened, you just go off on irrational

16 diatribe and start quoting scriptures and singing.

17 It's obvious to me you're very uncomfortable with

18 your own actions and that you have no explanation. And unlike

19 a true servant of Jesus Christ who can stand up and tell the

20 truth and answer further actions, you cannot. You cannot tell

21 us what happened, of course leads us to know, Brian, you're a

22 fraud. Deep down in the core of your being, you know that you

23 are just a loser. You're just a loser, and you can't make it

24 in the world who does fancy young girls.

25 MR. ROSS: Unless --

92
1 MR. PARKS: And will take a virgin out of her own

2 bed at night and wanting to force her to have sex with your

3 smelly, disgusting self, a girl younger than your own

4 daughters, for God's sakes.

5 MR. ROSS: You're not a servant of Jesus Christ.

6 MR. PARKS: You are what you are, which is

7 unfortunately just a real low life, street beggar, child

8 rapist, fraud, sinner.

9 A. I love you.

10 MR. PARKS: I don't love you, Brian.

11 A. I love you.

12 MR. PARKS: Then tell me the truth.

13 A. I do love you.

14 MR. ROSS: No, please don't. I've got enough,

15 seriously.

16 A. I hope you don't hate me.

17 MR. PARKS: I don't hate you.

18 MR. ROSS: I hate what you did.

19 A. Then I forgive you.

20 MR. PARKS: I don't forgive you, Brian. You have

21 no power to forgive me.

22 MR. ROSS: Brian --

23 MR. PARKS: You have no power to forgive sins on

24 earth. That power only belongs to God. You don't forgive me.

25 I don't want your forgiveness. You don't have the power to

93
1 grant it. You think you are morally superior because you

2 convinced yourself that the Holy Ghost speaks to you and only

3 to you, and, Brian, that's just a fraud. That's a lie. You

4 have deceived yourself. Let's face it. You have a loser job

5 at OC Tanners, you've had a string of losing marriages. You

6 haven't been able to hold a job.

7 MR. ROSS: XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX

8 XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX.

9 MR. PARKS: You have just -- you're just a loser.

10 You are not set up on a pedestal by anybody. You're not

11 better than anybody else.

12 MR. ROSS: You had to keep this girl in your camp

13 by tying her down.

14 MR. PARKS: That's right.

15 MR. ROSS: That's what she told us.

16 MR. PARKS: You had to take her at knife point.

17 Why would anybody want anyone like that? A young girl,

18 virgin. A child rapist. Actually, you think of yourself as

19 the highest of the highest of the -- God --(unintelligible),

20 but the truth of matter is your name is Brian Mitchell, and

21 you're attracted to young girls. And you're just a loser who

22 can't hold a job or keep a marriage together or stay in a

23 church. You're just --

24 MR. ROSS: Or raise a child.

25 MR. PARKS: Or raise a child or be a responsible

94
1 father. You're just nothing, Brian. You're just a loser.

2 MR. ROSS: Or find attractive women.

3 A. That's the first true thing you've said, and I'll

4 admit,(unintelligible) Jesus Christ.

5 MR. ROSS: Here we go again.

6 MR. PARKS: That's right. We'll all sinners,

7 Brian.

8 A. (Unintelligible).

9 MR. PARKS: We're all nothing. And you least of

10 all, if you are a true believer of Jesus Christ and a follower

11 of his, why, you would have killed yourself for harming a

12 child. So don't tell me that you're a servant of God because

13 servants of God obey his will and obey his commandments.

14 That's right in the Bible.

15 MR. ROSS: And they don't and they don't and they

16 don't deny what they've done.

17 MR. PARKS: Prophets stand up and answer questions

18 directly.

19 MR. ROSS: They all just stand up and say, hey, I

20 did this, and they're willing to take responsibility and have

21 whatever happened. Christ gave himself up, and he knew he was

22 going to die. And he was executed. I know that much about

23 the Bible.

24 MR. PARKS: So the real core values of Brian to us

25 is that Brian is just a loser and can't make it.

95
1 MR. ROSS: Any time somebody asked you really

2 difficult questions off the Bible, you quit your job and move

3 somewhere else, changed your name.

4 MR. PARKS: I talked to your mom about you quite a

5 bit. Talked to your own children about you. I feel bad for

6 you, actually. You've had a pretty tough life, you know,

7 career-wise. Certainly your marriage-wise, Debbie is a very

8 mean, vindictive person. You've been through a lot of hell.

9 But don't tell us that you're a servant of

10 Jesus Christ when your actions speak louder than your words,

11 okay? So this is it. We're getting down to like your last

12 opportunities here. We want to hear you talk. How about it?

13 MR. ROSS: Brian, can you open your eyes here for a

14 second here? Come on, just for a little bit. Don't open them

15 and say, I love you, because, you know, it's too gushy for me.

16 But maybe you could explain, would you be willing to explain

17 that to her family? I mean, do you want us to walk out of

18 here and tell Elizabeth's parents that God put Elizabeth

19 through hell since June 5th? And tell them that God delivered

20 your daughter Elizabeth, your beautiful 14-year-old Elizabeth,

21 delivered her to --

22 MR. PARKS: A homeless transient that smells bad

23 that lives in a tent in the mountains?

24 MR. ROSS: Is that what you want us to tell her --

25 tell them?

96
1 MR. PARKS: You know, the reason that we know that

2 you're full of shit is because your actions speak louder than

3 your words. The burglary in San Diego, you gave a bad name.

4 You told them your name was Johnson, Michael Johnson. The

5 date of birth you told them is one digit off from every digit

6 in your birthday. Does a servant of God break into, what was

7 it, a church? What was that all about?

8 MR. ROSS: Did Jesus when he was confronted by the

9 Romans, did he ever say his name was Mike Johnson?

10 MR. PARKS: And not only that, what about the

11 shoplift from the 7-Eleven across the street? Stealing beer?

12 Beer? I mean, what's that all about?

13 You know, you're just full of shit, Brian. Full of

14 shit. And we want to get to the basics here. We really do

15 want to get in your head and have you tell us what you were

16 thinking and what happened and why you did what you did. It's

17 your story to tell. I've got to tell you right now, it's not

18 looking good for you.

19 You are really looking at the rest of your life in

20 prison. And I know right now, that doesn't seem much to you,

21 but you're never going to see Wanda again. You're never go to

22 walk around and panhandle. You're never going to eat decent

23 food.

24 MR. ROSS: You've got to wonder what's going on in

25 that interview, too. You think Wanda wants to spend the rest

97
1 of her life in prison? You think she's going to fall for this

2 hook, line and sinker? Or do you think she's going to start

3 talking about everything that happened during the past nine

4 months and how you engineered this whole thing and planned it?

5 MR. PARKS: Just that you wanted a young girl.

6 MR. ROSS: Women are women. Hell hath no fury like

7 a woman scorned. And I guarantee you there's probably some

8 point in time your wife was probably jealous that you were

9 paying more attention to a beautiful 14-year-old blonde-headed

10 girl than her.

11 MR. PARKS: You know, we see what happened here,

12 Brian. What happened is Wanda is getting a little older.

13 She's getting a little dumpy looking. You go work on a house,

14 and there's an absolutely beautiful, obedient --

15 MR. ROSS: Angel.

16 MR. PARKS: Virgin.

17 MR. ROSS: Playing the harp.

18 MR. PARKS: And oh, my goodness. Why would God

19 have her even born on this earth unless it was to deliver her

20 to you for you to do what as you would with her?

21 It's a pretty ugly scenario here. We're thinking

22 very ugly thoughts about you, Brian, and your response is to

23 try and hide behind your closed eyes. Now you can't, okay.

24 You just can't. You're a fraud. You're not a servant of God.

25 God doesn't talk to you. The Holy Spirit hasn't told you to

98
1 do anything. You took this girl because of your own lust and

2 your own desires. You committed a horrible crime against God

3 and against the laws of the state of Utah, the United States,

4 and you've done terrible things. I mean, the only thing you

5 can do is hide behind your closed eyes, you know. It's not

6 getting through to you. If you want to go down like this,

7 you're going to go down. But let me tell you, you're not

8 going down as a servant of God.

9 MR. ROSS: You're going down as a child rapist.

10 MR. PARKS: You're just going down as a child

11 rapist. You're going down as the lowest of low.

12 MR. ROSS: And when get in that prison with all of

13 those other people they're going to seek even uglier thoughts

14 than we are.

15 MR. PARKS: You're going to be famous. You think

16 the Lord will protect you in prison, but I guarantee, just as

17 you cannot order me to get behind you and get out of your hair

18 and drop dead, you sure as can't order them to do anything

19 either, because, Brian, you have no authority from God. The

20 Holy Spirit has granted you nothing. Nothing, Brian.

21 MR. ROSS: It must have been pretty powerful to

22 have that power over Elizabeth that whole time, that whole

23 nine months.

24 MR. PARKS: Any other child would have absolutely

25 just run away at the first opportunity, okay. But you just

99
1 latched on to one that because of her good LDS upbringing was

2 very obedient and easy to brainwash. Now your luck has run

3 out.

4 MR. ROSS: It's time to answer.

5 MR. PARKS: So how about it? Are you going to tell

6 us anything, or are you just going to hide there behind your

7 closed eyes and be a martyr? Martyrs, you know, it's too good

8 of a term for Brian.

9 MR. ROSS: Exactly.

10 MR. PARKS: Brian is no martyr.

11 MR. ROSS: You think of a martyr like -- he's

12 definitely not one of them.

13 MR. PARKS: Well, I guess we're getting into things

14 that are just too painful to talk about here. He's just

15 hiding in there, and you're not responsive or answering us.

16 Tell me this, though, Brian, you do realize that

17 your life is different; it's not moving on; right? You do?

18 MR. ROSS: Maybe he's trying to impress upon us

19 that he's already been delivered and he's not able anymore --

20 MR. PARKS: I hate you to tell you this, Brian, but

21 the rapture has not happened. God has not taken you to

22 heaven. You're still in this room with me and Jeff here. You

23 cannot escape. God is not going to save you because you have

24 not been subservient to God. Not the true God. You're just a

25 lowlife child molester. God is not going to protect you from

100
1 us. There's no protection from us.

2 You need to come out of there, Brian. Come on.

3 MR. ROSS: Do you know how many people have been

4 hurt in addition to Elizabeth and her family? How many people

5 have been dragged in here because they worked at the Smart

6 house and had their lives completely disrupted because of

7 something that you did to satisfy your own sexual lust for a

8 14-year-old girl?

9 MR. PARKS: Do you know that a man was taken into

10 custody named Richard Ricci, a totally innocent man, innocent,

11 and he knew about it, and he failed to tell us? You failed to

12 come forward, and Richard Ricci died because of your actions.

13 He died because of your refusal to come forward and be a man.

14 MR. ROSS: He died because of the stress of being

15 held in prison.

16 MR. PARKS: You were willing to let another man

17 take your place.

18 MR. ROSS: Christ wouldn't have done that.

19 MR. PARKS: Doesn't Christ take our place for our

20 sins? And instead you sent an innocent man to death because

21 you weren't man enough to step forward and admit your actions.

22 You could have saved Richard Ricci at any time. At any moment

23 you could have saved an innocent man just by coming forward

24 and saying, here she is alive and well. But, no, you let him

25 die. You let an innocent man go down and die for your

101
1 actions. And for what? For what, Brian? Because of your

2 sexual desires for a young virgin?

3 Oh, man. I don't love you, Brian. You are a

4 fraud. You are a fraud, sir.

5 MR. ROSS: You let people take the blame.

6 MR. PARKS: You piss me off because you try to hide

7 behind Jesus Christ to justify your own actions in your own

8 mind.

9 MR. ROSS: Which isn't uncommon with pedophiles.

10 MR. PARKS: It's not. It's absolutely not.

11 MR. ROSS: Child molesters always do. Usually

12 they're the ones that sing the loudest.

13 MR. PARKS: That's right. The loudest at church.

14 MR. ROSS: Yeah.

15 MR. PARKS: Priests, youth counsellors, LDS

16 bishops.

17 MR. ROSS: That's right. Yeah.

18 MR. PARKS: And here we have another right here.

19 MR. ROSS: Servant of the Lord.

20 MR. PARKS: Servant of the Lord, that let an

21 innocent man go to his death because he refused to come

22 forward. A man who harmed a child, a mere child. You know,

23 no, we don't have any respect for you, Brian. And I don't

24 think that your name is Immanuel. I think that's all part of

25 the grand fraud that is your life. I'm waiting to hear

102
1 rational explanations for your actions, Brian.

2 MR. ROSS: I've got nothing else going on, do you?

3 I can sit here.

4 MR. PARKS: I need to make a phone call. By the

5 way, we'll sit here and wait you out past dinner.

6 (Time lapse.)

7 MR. PARKS: What's the smile for?

8 A. I was just enjoying the tune you're playing.

9 MR. ROSS: Really? Why? You think I'm frustrated?

10 Do you take joy in frustrating our efforts? Kind of a power

11 play. Here's a homeless transient guy who can't keep a job

12 who's got the whole Salt Lake City Police Department and the

13 FBI just waiting to hear what you have to say. That's pretty

14 powerful. That's pretty powerful. And that's what it all

15 comes down to. It's not consent. It's not, you know, oh, I'm

16 in love with this -- you know, this Elizabeth girl, she's in

17 love with me. She's going to be sealed as my wife and live

18 out in the woods with her. It's not that. It was all about

19 power. Otherwise you could have just knocked on the door and

20 say, excuse me, Mr. Smart, but I think your daughter wants to

21 come with me.

22 MR. PARKS: Power.

23 MR. ROSS: It's all about power. You must be

24 feeling pretty powerful now. It has nothing to do with Christ

25 or the Bible or the Old Testament, New Testament. None of

103
1 that. It all comes down to Brian David Mitchell, a homeless

2 transient who can't keep a job.

3 MR. PARKS: Loser.

4 MR. ROSS: Can't keep a wife. XXXXXXXXXXXXXXXXXXX

5 XXXXXXXXXXXXXXXXXXXXXXX and, you know, complete loser in

6 everything. But, boy, for that nine months you were king.

7 You had a 14-year-old girl at your beck and call. But she

8 didn't come willingly. You had to tie her down, put a knife

9 to her throat and threaten her little sister.

10 And now since you can't take responsibility for

11 your stuff, for your actions, you sit there. You sing church

12 hymns. You quote scripture. You shut your eyes. That's

13 pretty powerful.

14 MR. PARKS: The only problem is you don't seem to

15 know your scriptures as well as you think you do.

16 MR. ROSS: Not as well as Cordon.

17 MR. PARKS: I've only read the Bible three times.

18 MR. ROSS: I can honestly say I only read it when

19 they told me to.

20 MR. PARKS: You don't know your hymns. You run out

21 of the verses. After the second verse you don't know the

22 words for them.

23 MR. ROSS: And you start humming.

24 MR. PARKS: You start humming. You can't answer

25 the truth. You know, the truth is such a simple thing. It

104
1 never changes. It never changes.

2 MR. ROSS: So the new move is to keep quite and sit

3 there with your eyes shut and pretend we're not here.

4 MR. PARKS: You talk about our tactics being bad,

5 yours are worse. Do you think you're the only guy that we've

6 ever talked to in this room? You think you're the only

7 pedophile we ever sat down with and had a long chat with?

8 MR. ROSS: And ask how many kids they've had sex

9 with. How many children they forced.

10 MR. PARKS: You're really not that different, you

11 know. You're not that different than anybody else. You're

12 not. You're just not. You're not special, Brian. This bull

13 shit about the Holy Spirit talking to you and commanding you

14 to do this and commanding you to do that.

15 MR. ROSS: It's a copout.

16 MR. PARKS: It's one big ego defense mechanism to

17 cover up the failures of your life.

18 MR. ROSS: It's a thinking error. Failure to take

19 responsibility for our own actions. Put it on the

20 Holy Spirit. That's --

21 MR. PARKS: But we know deep down inside, you know,

22 the Holy Spirit doesn't talk to you, Brian. You know that.

23 MR. ROSS: Deep down inside you know you feel

24 horrible about yourself, and you think you're a horrible

25 person because you like having sex with young girls. But the

105
1 only way you can defend it and kind of move on without tying a

2 millstone around your neck and throwing yourself in the lake

3 is trick yourself into some thinking distortion that the

4 Holy Spirit told you to do it.

5 MR. PARKS: You know, you stand convicted by your

6 own actions, Brian. You are convicted, very convicted,

7 because Jesus said, by the fruits I shall know them and know

8 what they are. Good trees bring forth good fruit; bad trees

9 bringing forth bad fruit.

10 We've seen what you brought forth, Brian. And what

11 you brought forth are two rather large felonies under the

12 state of Utah statutes. Forcible sex with a young underage

13 girl, abduction out of her safe bedroom in the middle of the

14 night, female. Your arguments are absurd on their face. As

15 far as you being a servant of Jesus Christ, your actions speak

16 much louder than your words.

17 You know, you're just a fraud. And do you think

18 you're seriously going to go to court and sit in front of a

19 jury of your peers and try and say that you are deluded into

20 thinking you were doing the right thing, and maybe that will

21 get you off somehow?

22 I need to point out to you that you were contacted

23 by a policeman by Wild Oats, and you gave a bad name. You

24 were contacted, you were arrested for burglary in San Diego,

25 and you gave a bad name and a bad date of birth. The Sandy

106
1 police stopped you at State Street up by the graveyard, and

2 again, you gave a false name and a false date of birth to try

3 to fool them into thinking you're somebody else.

4 MR. ROSS: But when you were stopped today you're

5 Immanuel David Isaiah.

6 MR. PARKS: And once you're arrested by me and we

7 bring your ass down here, and then you climb up on your high

8 horse and try to hide behind Jesus Christ and scripture, but

9 you don't know your scriptures that God damn well. And you

10 don't know your hymns.

11 You're just revolting to me, okay. You think

12 you're something special, but you're just another criminal.

13 Another criminal committing criminal acts and you've got to

14 stand for it.

15 All we even want you to express your opinions

16 about, you know, about why you are who you are and why you did

17 what you did. You won't answer the most direct and easy put

18 questions, not even an answer, no answer.

19 MR. ROSS: No.

20 MR. PARKS: You're a fraud. You're a fraud, Brian.

21 You stand convicted in the eyes of God and in the eyes of the

22 law. And you don't have --

23 MR. ROSS: Sexual (unintelligible).

24 MR. PARKS: You just don't have any explanation,

25 and that's why you're hiding behind your closed eyes and your

107
1 stony silence. You just, you have no explanation.

2 MR. ROSS: And we are not going away.

3 MR. PARKS: You have no inspiration.

4 MR. ROSS: God is not going to save you from this.

5 MR. PARKS: And you ordered me in the name of God

6 to get behind you, and here I am in your face, and you know

7 now that you don't have any authority of God. You're just a

8 man like anyone else, okay. Not a very good one at that.

9 MR. ROSS: I think there's a reasonable argument to

10 suggest that God delivered you to us.

11 MR. PARKS: You're here. We saw through your lies,

12 and we arrested you. And we brought you here.

13 MR. ROSS: Why did you come back to Salt Lake City?

14 How about just answering that, Brian. Why did you come back

15 to Salt Lake? This had to be the hottest place of all places

16 to come to. Everyone knows Elizabeth's face. It's still

17 posted on every single storefront that I've ever been in since

18 June 5th. Why did you come back here? Was she getting to be

19 a pain in the ass? Huh? Two women, too much of a pain? Too

20 much nagging?

21 Is that it? You got a little smile on your face

22 when I said that. Women can be tough to live with. Two? You

23 could die of estrogen poisoning. Come on, man. Humor me with

24 an answer. Why did you come back to Salt Lake City? Come on.

25 Why did you come back to Salt Lake? Huh? Did you come back

108
1 to Salt Lake because you wanted her to go back home? Huh?

2 Was it getting too much of a pain to try to support three

3 people on panhandling and recycling cans? Was she starting to

4 hope that she was back home with her parents and school and a

5 boyfriend her age, with her sister Mary Katherine? Huh?

6 MR. PARKS: You know, you might think that you're

7 special and all that, but as soon as we separated Elizabeth

8 from you, I mean, the very second, I sat down with her in

9 Sandy and she started to give you up. She gave you up. She

10 didn't hesitate. And you know what she thinks of you? She

11 thinks you are a child rapist. You took her virginity from

12 her. You took her out of her own house away from her own

13 family and did the most vial and unspeakable act a grown man

14 could ever do to a child. Elizabeth doesn't like you. She

15 doesn't like you. She's talking about you right now, okay?

16 MR. ROSS: So is your wife Wanda.

17 MR. PARKS: You're nothing special. Elizabeth

18 doesn't like you at all. She found you actually rather smelly

19 and disgusting. You know that, Brian? Your family for all

20 eternity, Wanda and Elizabeth, they don't even like you.

21 MR. ROSS: That's got to be tough.

22 MR. PARKS: When we asked Elizabeth, is Elizabeth

23 Shearjashub.

24 MR. ROSS: Shearjashub.

25 MR. PARKS: That's a bunch of bull shit. That

109
1 is --

2 MR. ROSS: Did you actually think that this

3 biblical explanation was going to work? Because, I mean, as

4 soon as we walked in it was almost like it was scripted.

5 MR. PARKS: I'm sure Brian has been thinking what

6 would happen when the gravy train came to an end and the

7 police finally got onto him, because I'm sure even in your

8 thinking, Brian, you know that the good times wouldn't last

9 forever.

10 MR. ROSS: You had to have an exit strategy.

11 MR. PARKS: This is it? The only problem is we

12 debunked your fantasy life about being a prophet of God.

13 MR. ROSS: Give it up.

14 MR. PARKS: It would have worked had you stood up

15 and told the truth whenever you were contacted by the police,

16 you know, the jury would have believed you. But since you've

17 deliberately lied three times that I'm aware of now to cover

18 your identity I don't think any jury is going to believe that

19 you're really that crazy, are they, Brian?

20 MR. ROSS: No. Well, your whole life is crashing

21 down around you, right now.

22 MR. PARKS: I would say it's over.

23 MR. ROSS: It's done. Wanda has given you up. She

24 obviously didn't like the fact that nine months, you know, he

25 found someone knew, a beautiful 14-year-old Mormon girl.

110
1 MR. PARKS: I brought Elizabeth down with her dad.

2 They road in the back of my police car all the way down here.

3 You know, they sat there and cried together all the way back.

4 They were so happy to get back together again. And Elizabeth

5 was so happy that she no longer ever has to see you again as

6 long as she lives. She never has to touch you again. She

7 never has to smell your foul body odor. She never has to lie

8 with you.

9 MR. ROSS: She never has to sleep out on the

10 streets again, sleep at a campsite tethered down so she can't

11 run away. She's free.

12 MR. PARKS: She's free of you. And you think

13 anybody's going to want to protect you? Guess again.

14 MR. ROSS: No one is.

15 MR. PARKS: She's already in there telling us

16 everything that happened.

17 MR. ROSS: And guess what, Wanda doesn't want to

18 spend the rest of her life in prison.

19 MR. PARKS: You're finish, my friend. You're going

20 to jail from here on. You're never, ever, ever going to get

21 out. You are going to die in prison. Does that mean anything

22 to you? No one is going to listen to you prophesy out there.

23 No one is going to give a shit that you say you're inspired by

24 God. You're going to die a very miserable and lonely old man

25 in a jail cell with nobody to come visit you. Nobody cares

111
1 about you. Is that what you want?

2 MR. ROSS: And all your stuff about being a

3 prophet, as soon as this hits the news, they're not going to

4 look at you that way. They're going to look at you as a

5 homeless, jobless, drifter, loser, child molester, kidnapper.

6 It's not going to say, servant of the Lord arrested in the

7 kidnapping of Elizabeth Smart. They're going to say, homeless

8 drifter who worked at Ed Smart's arrested for kidnapping

9 Elizabeth Smart.

10 MR. PARKS: Child rapist.

11 MR. ROSS: And raping her. And all of your stuff

12 about marriage sealed by -- she was -- you received her from

13 the Lord is going to be laughed at. Maybe sometime you'll

14 want to tell us exactly what happened. I'm not leaving.

15 MR. PARKS: Now you have no explanations. You have

16 to hide in your stunning silence because --

17 MR. ROSS: The truth is too difficult for you to

18 say.

19 MR. PARKS: The truth is too difficult to face.

20 Instead of being --

21 MR. ROSS: I mean, just think how it sounds if you

22 were to say it. I like to have sex with 14-year-old girls. I

23 mean, just to admit that, that has got to be the lowest of

24 low, especially when you know that it's wrong.

25 MR. PARKS: Especially when you have to do it by

112
1 force. I mean, there's 14-year-olds out there that will lay

2 down there if you approach them right, consensually they'll be

3 glad to. But no. No.

4 MR. ROSS: Not a beautiful angel like Elizabeth.

5 You had to take a knife, sneak into her bedroom, threaten to

6 kill her, threaten to kill her little sister and drag her out

7 and hike up to a camp and tie her down.

8 MR. PARKS: She's got to be a virgin pure. And

9 that doesn't make you any more pure, Brian. That just makes

10 you that much more sick. Sick, Brian. You've got to have a

11 virgin, so you took one against her will.

12 MR. ROSS: Because God --

13 MR. PARKS: Bull shit on you and your wife. And

14 all you can do is sit there behind your silence because we

15 both know you've got no explanation. You've got nowhere to

16 go.

17 MR. ROSS: You're a pussy.

18 MR. PARKS: You're a loser. You just can't answer.

19 MR. ROSS: But you know what? I feel comfortable

20 knowing that Elizabeth Smart from here on out is where she

21 belongs. And I feel comfortable knowing that you will never

22 be able to put your hands on her again, and you'll spend the

23 rest of your life in prison. Now I feel no shame for it. I

24 don't think I'll burn in hell for it. I think my patriot and

25 saint, Saint Michaels is, you know, going to look down upon us

113
1 and say, good job. There's not going to be any shame or

2 anything like that.

3 It's going to be difficult to face up to the fact

4 that one day, while you weren't expecting it to be today, you

5 don't know what day it was going to be, that you would

6 actually have to face up to the fact that you're whole belief

7 was all a bunch of lies, based on a bunch of lies.

8 MR. PARKS: Based on lust.

9 MR. ROSS: Yeah. That's what it all comes down to.

10 You wanting to have sex with Elizabeth Smart, that beautiful

11 blonde hair angel who played the harp, that lived in a nice

12 house that you worked at. And you said, remove her from

13 Babylon.

14 MR. PARKS: What a laugh.

15 MR. ROSS: Why would you say that? Huh? Why is

16 the Smart family -- why is their house considered Babylon?

17 Why did you feel a need to remove her from there?

18 MR. PARKS: Now, if you would have chosen an

19 unrighteous girl, that would have even been some sort of an

20 explanation, but these guys were devout LDS.

21 (The tape ended.)
