In accordance with the Third Judicial Circuit Court of Michigan Docket Directives 2018-03, Plaintiff respectfully requests that the above-captioned case be assigned to the Hon. Chief Judge Timothy M. Kenny. VERIFIED COMPLAINT Page 1 of 11 NOW COMES, the Plaintiff City of Detroit , a Municipal Corporation (“City”) and hereby states as follows for its verified complaint: PARTIES, JURISDICTION AND VENUE . ‘The Plaintiff City of Detroit is a Michigan Municipal Corporation vested with local authority to protect the health, safety and general welfare of the general public in the City of Detroit, State of Michigan. 2. Defendant Revere Dock, LLC is a Michigan Limited Liability Company that is the owner of real property and improvements at 5581 W. Jefferson, Detroit, MI 48209, located in Detroit, Michigan Subject Property. See Exhibit 1 attached hereto and made a part hereof. 3. Defendant, Detroit Bulk Storage, Inc (“DBSI”) is a Michigan Corporation and the tenant with possessory interest at the Subject Property. 4 Defendants are responsible for the conditions of the land, building(s)/structure(s) on the Subject Property. 5. Upon information and belief, at all times relevant to this action, Revere Dock, LLC has maintained a legal or equitable ownership interest Subject Property. 6. Plaintiff's claim(s) arise out Defendants’ ownership, possession and/or use of the Subject Property which is located in the City of Detroit. 7. This court has equitable jurisidiction by virtue of MCL 600.2940 et seq. 8. ‘Venue is appropriate pursuant to MCL 600.1621 et seq. since the Subject Property is located in the County of Wayne, City of Detroit. REAL PROPERTY TAXES 9. As of January 13, 2020, the Subject Property has one thousand, seven hundred sixty-nine dollars and seventy-five cents ($1769.75) in outstanding real property taxes. See Exhibit 2 attached hereto and made a part hereof. Page 2 of 11 Facts 10. Plaintiff incorporates by reference paragraphs one through nine of this Complaint as if fully restated herein. 11. On or about December 6, 2019 & January 15, 2019, the Subject Property was inspected by the City of Detroit Building Safety Engineering Environmental Department (hereinafter “City BSEED”), and City BSEED issued Emergency Correction Order (ANN2015-00641) and Correction Order (ANN2015-00641). See Exhibit 3. 12, Upon information and belief, the only use that is legally permitted at the Subject Property is vacant commercial land. See Exhibit 3 attached hereto and made a part hereof. 13. As of the date hereof, the Subject Property remains unsafe blighted, public nuisance and danger to the safety and welfare of the public in at least the following ways: a. The Subject Property does not have a valid Certificate of Compliance. b, The Subject Property is not permitted to be used in a manner itis eurrently being used. c. Defendants, Revere Dock, LLC and DBSI have failed to obtain an Engineering Report on the abatement of the hazard and have failed to restore the property to the legal use. d. Defendants have failed to obtain a Geotechnical Report as required to stabilize the sea wall. ¢. The Subject Property is not secured to prevent trespass onto the property. £, The collapsed area on the Subject Property is not properly barricaded. g. The accessory structures (detached fences, garages dumpster enclosures, walls) are not in sound condition. Page 3 of 11 h, The Plaintiffis concerned about the illegally stored aggregate on the Subject, Property and the possibility that it may cause collape and further contaminate the natural waterway. 14, The current condition of the Subject Property warrants immediate remediation because of the conditions listed above. 15. The Plaintiff seeks to have the Subject Property remediated in accordance with instructions from local, state and/or federal government; a barricade erected, and the property properly backfilled to grade level and subject to approval by local government officials. 16. Defendants’ acts or omissions on the Subject Property violate the City of Detroit Building Code and/or Property Maintenance Code and are in violation the minimum requirements for illegal hazards stored as discussed in Section 8-15-39 of the Detroit City Code, See Exhibit 4 Ordinance 8-15-39, COUNT ONE COMMON LAW PUBLIC NUISANCE 17. The Plaintiff incorporates paragraphs one through sixteen as if fully restated herein. 18. The public has an interest in abatement of public nuisances affecting health, safety, the environment, and in the protection of a public property right or interest. 19. The hazards on the Subject Property are a blight on the neighborhood and present an imminent threat to the health, safety and welfare of the public, and the buildings and structures constitute a common law public nuisance. 20. The conditions on the Subject Property are in plain view so that the Defendants are fully aware of the urgent need to remediate the Subject Property and clean up all of the hazards at the Subject Property. Page 4 of 11 21. The Plaintiff is entitled to abatement of the common law nuisance created by the owners and interest holders of the Subject Property. COUNT TWO NUISANCE ABATEMENT 22. The City incorporates paragraphs one through twenty one as if fully restated herein. 23. Defendants’ have failed, neglected, and/or refused to remedy the offending conditions that exist with the sea wall on their property for weeks. 24. Pursuant to MCL 600.2940, Plaintiff is entitled to an order requiring Defendants to abate the nuisance at Defendants’ sole expense, 25. The Subject Property is in violation of the City of Detroit Property Maintenance Code and/or the Vacant Building Ordinance as discussed above. 26. The Defendants’ are in violation of Detroit City Code 8-17-21 which makes it unlawful for any owner or agent thereof to keep or maintain any building or structure or part thereof, in an unsafe and dangerous condition. See Exhibit 4 Ordiance 8-17-21. 27. As of the date hereof, the building at the Subject Property remains dangerous in violation of the City of Detroit Property Maintenance Code and/or City of Detroit Official Zoning Ordinances and/or the Vacant Buil ing Ordinance and/or the Unsafe Structure/Dangerous Building Ordinance, 28. The City of Detroit is authorized to bring an action against the owner of the Subject Property for the full cost of the remediation; and to secure the sea walls making any building or structure safe, and/or maintaining the exterior of the building or structure, See Exhibit 4 Ordinance 8-17-45. REQUEST FOR RELIEF THEREFORE, the Plaintiff, City of Detroit, respectfully seeks the following relief from this Honorable Court: Page 5 of 11 @ Declare the Subject Property a public nuisance Order the Defendants to immediately abate the nuisance by: 1. Removing all Aggegrate, erecting a barricade completely surrounding the Subject Property, subject to City (BSEED) permits/inspections/approvals; backfilling the property to grade level within 20 days; all at the Defendants’ expense; and 2. Replacing or stabilizing the entire sea wall, for the Subject Property in a manner consistent with sound engineering principles and as approved by local, state and federal authorities, not limited to City BSEED, Army Corp of Engineers, Michigan Department of Environment, Great Lakes and Energy (EGLE), Michigan Department of Attorney General Environment, Natural Resources and Agriculture Divison. 3. Providing an Engineering and Geotechnical Reports on the stabilizing of the land and soil and the means of repairing sea wall of Subject Property. 4, Securing permits from City of Detroit (BSEED) on existing asphalt pad. Upon Defendants’ failure to abate the nuisance within the time specified by order of City BSEED, show cause for the failure to abate. D.
