Police Division ‘Three Edwards Center PO 210215, Cincinnati, OH 45221-0215 C Department of Public Safety University of CINCINNATI INTERNAL CORRESPONDENCE DATE: July 1, 2019 To: Maris Herold, Chief of Police From: Jeff Thompson, Captain - Standards and Strategic Development Commander Re: 19-15-14 Allegation: (On June 20, 2019, Officer Andrew Mueller possessed a firearm in a beer liquor premises, namely the “Corner Pub’, while consuming an intoxicating liquor while in the City of Montgomery, Ohio. The Montgomery Police Department opened a criminal case on Officer Mueller but decided not to pursue criminal charges on Officer Mueller and closed the investigation. Based on the preponderance of evidence obtained through the investigation by Lieutenant ‘Chris Elliott, which includes interviews of Officer Mueller and witnesses, | recommend this complaint be closed SUSTAINED. Officer Muelier violated Section 2923.121B (1) b3 of the Ohio Revised Code which states in part: 2923.121 Possession of firearm in beer liquor permit premises - prohibition, exceptions. (A) No person shall possess a firearm in any room in which any person is consuming beer or intoxicating liquor in a premises for which a D permit has been issued under Chapter 4303. Of the Revised Code or in an open air arena for which a permit of that nature has been issued, (8) (1) This section does not apply to any of the following: ( (2) A law enforcement officer or investigator who is authorized to carry firearms but is not acting within the scope of the officer's or investigator's duties, as long as all of the following apply: Department of Public Safety ; C Police Division University of Three Edwards Center CINCINNATI Po 210215 Cincinnati, OH 45221-0215 (iii) The officer or investigator is not consuming beer or intoxicating liquor and is not under the influence of alcohol or a drug of abuse. (E) Whoever violates this section is guilty of illegal possession of a firearm in a liquor permit premises. Except as otherwise provided in this division, illegal possession of a firearm in a liquor permit premises is a felony of the fifth degree. Officer Andrew Mueller’s actions are in violation of UCPD Policy 4.1.101 — Employee Conduct and Discipline, Section 17, Conformance to Laws, which states in part: Section 17. Conformance to Laws a. Employees shall obey all laws of the United States and of any state and local jurisdiction in which they may be present. Employees shall obey all applicable administrative regulations promulgated pursuant to local, state, or federal law. 3. Felony traffic/felony criminal law conviction. In accordance with UCPD Policy 4,1.101 — Conduct and Discipline, | recommend Officer Andrew Mueller receive 2/6 day suspension. ME 20-s: On June 28, 2019, Lieutenant Chris Elliott, Badge #133, interviewe; EM about Police Officer Andrew Mueller, Badge #122. iad met (fficer Mueller at the Comer Pub and was having a conversation with him observed Officer Mueller with a drink, while both were sitting at the table. The drink was later identificd to {EERE by the bartender as a double vodka soda which was ordered at the bar. [INIBBNNEB 2id she was getting “weird vibes and auras” from the conversation with Officer Mueller but didn’t know why but Officer Mueller did tell her he was a UC Student and getting close to graduating from the business college. SM Jecided to ask if he was an undercover police officer. Officer Mueller proceeded to stand up and say “Shhh” and pulled up the front of his shirt displaying a firearm in a holster and badge. what county he worked for, he stated Hamilton County. She asked for his bades name, but he refused. She felt like she needed to know his identity after the inci was unable to identify what particular department badge was displayed. According to (Officer Mueller abruptly left the pub. After the interaction, she went to speak with the bartender, Sarah Ledbetter, and told her about the incident. She asked Ms. Ledbetter if she knew his identity and asked if he paid with a credit card. Ms, Ledbetter showed her a copy of his credit card receipt with his name. According to Ms. Ledbetter looked up Officer Mueller’s name up on the internet and identified him as a UC Police Officer. ‘Sarah Ledbetter, Bartender ‘On June 27, 2019 at 19:55 hours, Lieutenant Elliott interviewed Ms. Sarah Ledbetter about Officer Mueller, Ms. Sarah Ledbetter is a bartender at the Comer Pub and served Officer Mueller two vodka and tonic doubles. Ms. Ledbetter did not see Officer Mueller consume those alcoholic beverages. Once ‘Ms. Ledbetter was made aware of the incident and she determined Officer Mueller’s identity, she texted her manager with the information that an off duty police officer, named Andrew Mueller, displayed his firearm in a holster and badge to a female patron in the bar. Angie Schuler, Bar Manager According to the Montgomery Police report, Ms. Schuler contacted a retired police officer from Montgomery Police Department, Greg Schill. Mr. Schill informed Ms. Schuler he was no longer employed with the Montgomery Police Department. Mr. Schill directed Ms. Schuler to speak with Sergeant Davenport of the Montgomery Police Department. She relayed the information from Sarah UCPD Complaint Form 15E Univer ‘CINCINNATI Case #s_19-15.1A_ Ledbetter, the bartender, to Sergeant Davenport. The information that an off duty officer, named Andrew Mueller, showed his firearm and badge to a female patron in the bar. Sergeant Mike Davenport, Montgomery Police Departim On June 25, 2019, Sergeant Davenport contacted Captain Jeff Thompson, Badge #140, and apprised bim of the allegation and of the ongoing investigation. On June 26, 2019, after consulting with Hamilton County Prosecutor, Mr. Richard Gibson, the Montgomery Police Department decided not to pursue criminal charges on Officer Mueller. On June 27, 2019, Sergeant Davenport sent Captain Thompson a copy of the completed and closed investigation. Police Officer Andrew Mueller, Badge #182 On July 1, 2019 at 10:55 hours, Lieutenant Elliott interviewed Officer Mueller. Officer Mueller's statement is consistent with] \d Ms. Sarah Ledbetter. Officer Muelier indicated that he did purchase and couis miewater and tonic doubles while at the Comer Pub. According to Officer Mueller, during a casual conversation, Ms. Morgan showed him a pepper bal] gun ina holster which resembled a real firearm. He proceeded to offer her some advice, safety tips, and possible negatives with the pepper ball gun. She asked him if he was an undercover cop. He then proceeded to stand up and show her his UC badge and UC issued firearm by lifting up his shirt. He stated he used poor judgment but the reason for showing her his badge and firearm was to validate the previous advice he had given her. Conclusion Al statements, including Officer Mucller’s own admission, are consistent that Police Officer Andrew Mueller did posscss a firearm while consuming alcoholic beverages at a beer liquor premises. He was contacied by the ‘manager of the Comer Pub- Angie Schuler. regarding an incident that occurred on June 20, 2019, Mtr. Ms. Schuler stated that an off-duty police officer by the ‘name of Andrew Muellar showed his firearm and badge to a female patron of the bar. Ms. Schuler stated that the female victim was ‘very upset and anxious aver the incident. Ms. Schuler then sent me a copy of Mr. Muellers credit card pub (atiached to report).
