Based on the preponderance of evidence obtained through the investigation by Lieutenant Chris Elliott, which includes Uber receipts and interviews of IMIR Sergeant Ronald Owens (Butler County Sheriff's Office), and Officer Muelier’s own admission, I recommend this complaint be closed SUSTAINED. Case #: 19-30-1A Investigative Notes and Summary: Allegation ME alle ge< that Officer Andrew Mueller, Badge #182, harassed her by calling her phone multiple times and coming over to her house and pounding on the front door aiter being advised not to do so. SR wit.-s: On December 16, 2019, lieutenant Chris Elliott, Badge #133, interviewed [I did not want the interview to be audio recorded. 7 and Pollce Officer Andrew Mueller, Badge #182, had been in an off and on relationship for the past four years and had recently broken up in the last month or so. Officer Mueller had called her 14 times on December 12, 2019, between the time frame of 2048 hours and 2051 hours He called her 16 more times between 2055 hours and 2255 hours. MN did not answer any of these calls. Officer Mueller also texted her multiple times. Her text messages to Officer Mueller indicated for him to stop attempting to contact her and not to come to her house or she would call the police. Her text messages also stated for him to leave her alone. Officer Mueller did arrive at her house, knocked on the door, and ring the doorbell multiple tines. [ENT id not make contact with Officer Mueller but she did call 911 once he arrived at her house. Officer Mueller left her residence before the police arrived and she never ‘opened the door. Officer Mueller made no threats and she wants no action taken including filing a telecommunications harassment report with the Butler County Sheriff's Office. ‘Sergeant Ronald Owens, Badge #1223, Butler County Sheriff's Office On December 16", 2019, Lieutenant Chris Elliott interviewed Sergeant Ronald Owens from the Butler County Sheriff's Office. On December 12, 2019, EEF ontacted the Butler County Sheriff's office to report that Officer Mueller was at her residence without her permission and she wanted him to leave. Officer Mueller had alreaidy left the premises prior to the deputies’ arrival; they were not able to make contact with him, [mM notified the deputies of the text messages and phone calls as well, but she refused to file a criminal complaint. Butler County Deputies completed an information report for a “Domestic Dispute.” Police Officer Andrew Mueller, Badge #182 ‘On December 19, 2019, Lieutenant Elliott interviewed Officer Mueller. Officer Mueller’s account of the incident is consistent with JINN account, Officer Mueller did attempt to call NN sbout 30 times and that she did text message him to leave her alone and not come to her residence. He also indicated that he did go to her residence and attempted to make contact. Officer Mueller denied having his firearm with him during this incident. Investigation Arreceipt of the Uber transaction was provided by Office Mueller. Google mapping was conducted and the Uber transportation and mapping does coincide with the timeline. Conclusion All evidence and interviews, including Officer Mueller’s admission, are consistent with the allegation. Investigating Officer shall forward this report to the Standards & Strategic Development Section Commander upon completion. SUSTAINED. Officer Mueller’s actions constitute a violation of the Ohio Revised Code Section 2917.21 A (1) ‘Telecommunications Harassment which states, in part: 2917.21 Telecommunications harassment. (A) No person shall knowingly make or cause to be made a telecommunication, or knowingly permit a telecommunication to be made from a telecommunications device under the person's control, to another, if the caller does any of the following: (1) Makes the telecommunication with purpose to harass, intimidate, or abuse any person at the premises to which the telecommunication is made, whether or not actual communication takes place between the caller and a recipient Officer Mucller’s actions also constitutes a violation of the Ohio revised Code Section 2911.21 A (3) Criminal Trespass which states, in part: 2911.21 Criminal trespass. (A) No person, without privilege to do so, shall do any of the following: (3) Recklessly enter or remain on the land or premises of another, as to which notice against ‘unauthorized access or presence is given by actual communication to the offender, or in a manner prescribed by law, or by posting in a manner reasonably calculated to come to the attention of potential intruders, or by fencing or other enclosure manifestly designed to restrict access UCPO Internal Correspondence Memo Form 5 Pagelof2 Reva. Conformance to Laws a. Employees shall obey ali laws of the United States and of any state and local jurisdiction in which they may be present. Employees shall obey all applicable administrative regulations promulgated pursuant to local, state, or federal law. 2. 1 through 4" degree misdemeanor traffic law or criminal law conviction. Officer Mueller was the subject of at internal investigation’ in June, 2019. As a result of Officer ‘Mueller’s action on June 20, 2019, Officer Mueller was found in violation of UCPD Policy 4.1.101 Section 17. Conformance to Laws. He was subsequently given a five-day suspension without pay and removed from a specialty assignment. Both of these incidents have shown that Officer Mueller has a propensity for poor decision making while consuming intoxicating beverages. Given consideration that this is the second such incident within the past six-month period, I recommend Office Mueller attend a fitness for duty evaluation to be conducted by a department appointed licensed clinician that specializes in law enforcement and fitness for duty. Additionally, if the clinician determines that further treatment or evaluation is recommended, he shall attend all such ‘treatments, evaluations, appointments, etc. until the clinician deems them no longer required.
