make ‘Shyam’ liable for injury? Discuss the provision and state your arguments. (Marks 5)
(b) Discuss, difference between pledge, lien and mortgage? (Marks 5)

2. ‘Raju’ a traveler, goes to Kolkata and stays at the inn of ‘Karan’. Next day morning, Raju goes to
Shanti-Niketan after locking his goods in the room. Meantime ‘Karan’ gives adjacent room to
‘Kalia’ a leader of gang of gamblers. ‘Kalia’ and his gang break lock of the room of ‘Raju’ and steal
the goods of ‘Raju’. After ‘Raju’ return from Shanti-Niketan he claims the cost of the goods from
‘Karan’. What remedy is available to ‘Raju’? Discuss with the help of provisions under the Indian
Contract Act, 1872 (Marks 10)

3. “The liability of the surety is co-extensive with that of the principal debtor, unless it is otherwise
provided” in the light of the above statement discuss the liability of surety when the original
contract is void and also in case of voidable contract. (Marks 10)

CG-FUNDAMENTAL RIGHTS AND ITS ENFORCEMENT (HONS.-I)

1. “A law may be constitutional even though it relates to a single individual if on account of some

2. The International Lunar Habitation Project is an international organization which has been set up
as a non profit research organisation by International Space Research Group (ISRG) to develop
technologies in order to make the moon habitable for humans and other flora and fauna. The
project has its head office in Aldrinton, Futurasia. The ISRG is an association of 30 governmental
and non governmental bodies such as the United Nations Environment Programme, NASA,
Futurasia Space Research Organisation, Rockefeller Foundation etc. The funding for the project
comes from these bodies and various governments including the host country Futurasia, which
contributes 3 – 5% of the entire funding. The project is governed by a board which is responsible
for operations and management and makes the budget related decisions. Three of the board
members are appointed by ISRG, three are nominated by the host country i.e. Futurasia and six
are appointed by the director based on their interest and qualifications from various countries.
People from various countries including Futurasia are employed with the project. P. Vikrama, who
is a renowned scientist from Futurasia is one such employee who was dismissed without any
opportunity of hearing at the disciplinary proceedings taken against him. He wishes to file a writ
petition before the Supreme Court of Futurasia challenging his dismissal as arbitrary. Kindly
advise him with respect to the maintainability of his petition with the help of relevant provisions
of the Constitution of Futurasia and any applicable persuasive precedents. The Constitution of
Futurasia is pari materia to the Constitution of India, 1950. (Marks 10)

3. “It is not the object of the authority making the law impairing the right of a citizen, nor does the
form of action taken that determine the protection he can claim, it is the effect of the law and of
the action upon the right which attracts the jurisdiction of the court to grant relief.” Discuss with

(b) Section 6(3) of the Income Tax Act, 1961 provides the test of Residence Status of Company in
India but soon that test shall change. What is that change? Do you support that amendment in the
given section which will be enforced from 1st April 2016? Give Reasons.
On the basis of new test, discuss that whether a Foreign Company “Logan Ltd” incorporated in
USA with majority business in USA and Ireland; who arranges every year Board of Director
meeting in 5 different countries- USA, UK, JAPAN, ITALY, and INDIA; will be taxed in India
or not? (Marks 5×2=10)
3. (a) Deadpool Ltd. is a Nidhi Company, whose shareholding has recently changed. Till April 2015
Ms. Duckling was holding 55% shares but now Mr. Harry is having majority shares that is 53%
share and Ms. Duckling is left with 47% share. This change is neither due to gift nor due to death
of any shareholder. Now company has to compute its tax liability for the previous year 2015-2016;
so while calculating the same, company wants to set off some losses of Rupees 4 lakhs which
were incurred on February 2015. Will they be allowed to do so? Give reasons with the help of
legal provisions.
(b) Section 115 JB of the Income Tax Act, 1961 in its Explanation 1 states – “For the purposes of
this section, "book profit" means the net profit as shown in the profit and loss account for the
relevant previous year prepared under sub-section (2), as increased by—
(a) the amount of income-tax paid or payable, and the provision therefore;
or…………………………………………………………………..if any amount referred to in clauses
is debited to the profit and loss account ”
What do you understand by this- increase of amount of income tax paid or payable in book profit
with respect to Minimum Alternate Tax? What does this term “income tax” include? Explain in

2. (a) X was an architect by profession and a play writer, dramatist and producer as well. He wrote
and produced a play, which received huge success and was re-staged numerous times. With the
increasing popularity, Y got in touch with X. During the X meeting with Y, X narrated the entire
play to Y, X had elaborate discussions regarding filming the play. However, there was no further
communication between X and Y after that discussion. Y commenced the making of the film,
which X believed to be based on his play. Nevertheless, Y guaranteed him that the movie had no
resemblance and was not remotely related to his play. But after watching the movie, X came to the
conclusion that the movie was indeed a copy of his play and consequently filed a suit for
permanent injunction seeking a restraint against the Y for infringement of his Copyright in the

2. Under Armed Forces Special Powers Act (AFSPA) the Governor of a state can declare an area as
‘Disturbed’, giving the armed forces extraordinary powers. This results in army personnel

According to Government, India has strong security issues which make it necessary to have the

Do you agree? In light of the above statement justify the concept of ‘Shareholders Democracy” and
also talk through the misleading metaphor relating to Shareholder ‘Ownership’ and ‘Control’ in a

2. “The Companies Act 2013 has made significant departures with regard to appointment of Directors as
well as the constitution of the Board. Companies that got too comfortable with the old system are now
going to have to change. High Performance with High Integrity are the foundational corporate goals.
The fusion of the two objectives is essential to avoid catastrophic risk that injures the company and its
stakeholders. The 2013 Act turns the spotlight of the BOD. The Board is given greater responsibility
and is made more accountable”.
Justify the above statement by identifying the persons that are somehow or the other involved in the
management of the company and then critically examining the scope, extent and their contribution
towards company management. Also discuss the highlights of the New Act and establish as to how the
2013 promises a harmony between the control and management mechanism within the company.

2. The Republic of Patronus is a parliamentary democracy. On January 17, 2016 the parliament was
debating on a matter of national security. Mr J. Parker, a member of parliament had requested the
Speaker that certain portions of his speech should be expunged as they contained defamatory
remarks pertaining to certain officers. His request was granted by the Speaker. His speech was
published with the expunged portions in the Patronus Times dated January 18, 2016. The
parliament committed the editor of the Patronus Times, Mr. R. Costner for contempt of the House
and punished him with imprisonment for seven days. A writ of habeas corpus was filed before the
constitutional court of Patronus in view of the right of the editor, Mr. Costner to free speech and
expression.

CONSTITUTIONAL GOVERNANCE-II

1. Explain the Jurisdiction and Powers exercised by the Supreme Court of India under the Indian
Constitution. (Marks 10)

2. Edgar is a Sovereign, Socialist, Secular, Democratic Republic State. Jack Dorsey, the Prime
Minister of the State commanded the Army to enter Sagrada Familia Church where some terrorists
were allegedly hiding. The Catholic population was enraged due to such action taken by the Prime
Minister and hence started protesting. David Hill was the body guard of Jack Dorsey, the Prime
Minister who happened to be belonging from the Catholic community. After two weeks of the
protest Jack Dorsey, the Prime Minister had to attend an inaugural ceremony of Pasanda Institute
of Technology. Earlier that very morning, Jack Dorsey, the Prime Minister was taking a stroll in
his garden and at that point in time his bodyguard David Hill shot him. Shortly, David Hill was
arrested and convicted for murder and treason. The appropriate court awarded him death sentence.
Stuart Hill son of David Hill presented a petition to the President of Edgar, Richard Berzowski, for
the grant of pardon to David Hill under Article 72 of the Constitution of Edgar on the ground that
the evidence on record of the criminal case established that David Hill was innocent and the
verdict of the courts that David Hill was guilty, was erroneous. In the petition, he also urged that it
was a fit case of clemency and prayed that David Hill’s representative may be allowed to see the
President, Richard Berzowski, in person in order to explain the case concerning him. His request
for hearing was not accepted on the ground that it was not in accordance with “the well established
practice in respect of consideration of mercy petitions”. Thereafter, in response to a further letter
written by counsel for David Hill to the President of Edgar refuting the existence of any
practice not to accord a hearing on a petition under Article 72, the Secretary to the President
wrote to counsel that the President is of the opinion that he cannot go into the merits of a case
finally decided by the highest Court of the land and that the petition for grant of pardon on behalf
of David Hill will be dealt with in accordance with the provisions of the Constitution of Edgar.
The President of Edgar thereafter rejected the said petition.
Stuart Hill has approached the Constitutional Court seeking review of the decision given by the
President. Kindly submit your opinion in light of the relevant constitutional provisions and case
laws.

6. (a) Buffey Plastics Pvt. Ltd. is a company registered under the Meeham Companies Act, 2006. It
has its manufacturing units in the State of Hamilton. The State of Hamilton has enacted the
Hamilton Labour Welfare Act, 2016 which contains several beneficial provisions with respect to
the working conditions of the labour class for example a five day week with maximum 8 hour
shifts, life and health insurance to be provided for by the employer, dispute resolution provisions
etc. Buffey Plastics has filed a writ petition challenging the constitutionality of the said Act
alleging that as citizen-employers they have fundamental freedoms under Article 19 and the Act
infringes their freedom of trade, business and profession under Article 19(1) (g) of the
Constitution of Meeham, 2000. The Constitution of Meeham, 2000 is pari materia to the
Constitution of India, 1956.
If the Act is declared unconstitutional, will it be void ab initio with respect to all persons including
Buffey Plastics? Kindly give your opinion with the help of relevant provisions of the Constitution

country neither such requirement was expressly agreed between the parties the noodles were in
conformity with the basic minimum standards required for sale of food items and also were in
conformity with the sellers country and most other countries’ laws where they are sold. With the
help reference to appropriate case law decide who shall be liable for the conformity of goods.
