Investigated in closed session the claim of Reaboi Vladislav as regards the approval of adoption,

ESTABLISHES:

Reaboi Vladislav submitted the claim to the court as regards the approval of the adoption.
As grounds for the claim he indicated that in 2006 he created a family with the minor child
Adamova Victoria and her mother Adamova Tatiana. The natural father Adamov Oleg was
deprived of the paternal rights concerning his daughter Adamova Victoria, in conformity with
the court decision of Rezina from August 04, 2006. For this period he was considered that the
father of this child, actively participating in the process of sustaining and education of this child.
Between the child and him were established family relationships, the child calls him ‘father’ and
he calls her ‘daughter’.
He holds a permanent job and a salary in amount of 2500 rubles a month, possesses
housing space. From the point of medical view he is in good health, was not previously
condemned, and was not deprived of the parental rights or limited of the tutor’s obligations.
The claimant Reaboi Vladislav requests to approve the adoption of the minor child
Adamova Victoria, born on July 31, 2001 in the village Garaba, district of Ribnita, Republic of
Moldova, to confer the name Adamova, and the patronymic Vladislav, the date, month, year,
remain without any modifications.
In the court sitting, the claimant Reaboi Vladislav, confirmed the claim and requested to
satisfy it, giving the explanations that confirm that from 2005 he lives with Adamova Tatiana
and with her minor daughter Adamova Victoria. In 2006 they registered officially their marriage.
The natural father of the minor child was deprived of the parental rights by the court decision of
Rezina from 2006. In 2007 he adopted the minor child Adamova Victoria, but these documents
are not valid because are issued by the instances of the unrecognized Republic of Transnistria.
Between the child and him were established family relationships and he possesses sufficient
conditions for sustaining this child and educating her.
The interested person Adamova Tatiana, in the court sitting confirmed the claim of the
claimant and that she is the mother of the minor child Adamova Victoria and from 2006 she got
married to Reaboi Vladislav. For the period of these two years the minor daughter considered the
last one her father and the relationships between them are like between a father and his daughter.
In 2007 the spouse Reaboi Vladislav adopted the minor child, but these documents are not valid
because were issued by the unrecognized Bodies of the Republic of Transnistria. They have good
conditions and Reaboi Vladislav agrees to adopt the daughter Adamova Victoria.
The representative of the Section of Social Support and Protection of the Family in Rezina,
Veaceslav Naduh, in the court sitting, confirmed the claim of the claimant and explained that
examining the conditions and the relationship between the claimant and the minor child there are
no obstacles as regards the approval of the adoption. Resulting from the interests of the child,
with the purpose of integration of the family, the adoption by Reaboi Vladislav of the minor
child Adamova Victoria, born on July 31, 2001 is accepted.
Hearing the claimant, the interested persons, examining the materials of the files, the court
consider that it is necessary to admit the claim on the following grounds:
 In conformity with the articles 279 item 1, letter b) of the Civil Procedural Code of the
Republic of Moldova the court examines in a special procedure the grounds as regards the
approval of the adoption.
In accordance with the article 291 of the Civil Procedural Code, the claim of adoption is
examined in closed session with the obligatory participation of the adopters, representative of the
tutorial body of the child, if this child has achieved the age of 10 years.
The adoption of the child is approved by the court at the request of the person who solicits
the adoption, on the grounds of the article 119 item 1 of the Family Code of the Republic of
Moldova.
In the court sitting has been found that the claimant Reaboi Vladislav from 2006 got
married to Adamova Tatiana, who is the single mother of the minor child.
The presented documents prove the fact that the claimant Reaboi Vladislav, who is 28
years old, has the capacity to act, by virtue of his moral values and his health is able to sustain, to
educate the child and possesses housing space with the property right, the claimant and the minor
child have father-daughter relationships for more than two years.
Adamova Tatiana the single mother of the minor child, in the court sitting, confirmed her
agreement as regards the adoption of the child by Reaboi Vladislav.
According the court decision of Rezina from August 04, 2006, Adamov Oleg was deprived
of the parental rights concerning his minor daughter Adamova Victoria.
In conformity with the notification of the Section of Social Support and Protection of the
Family in Rezina from December 26, 2008, that has been confirmed in the court sitting by its
representative, the adoption of the minor child Adamova Victoria, born on July 31, 2001, by
Reaboi Vladislav.
Consequently, on the grounds of the abovementioned information, taking into
consideration the major interests of the minor child, the court makes the conclusion that it is
necessary to satisfy the claim of Reaboi Vladislav as regards the approval of the adoption of the
minor child Adamova Victoria, born on July 31, 2001, with the inserting of the claimant’s data in
the certificate of birth of the child as her father.

D E C I D E S:
To satisfy the claim of Reaboi Vladislav as regards the approval of the adoption.
It is approved the adoption of the minor child Adamova Victoria born on July 31, 2001, in
the village of Garaba, district of Ribnita, Republic of Moldova, by Reaboi Vladislav Victor, born
on November 02, 1980, residing in the city of Ribnita, 13, Pugaciov Street, the last one being
registered in the certificate of birth of the child as her father.
The surname of the child remains Adamova, the patronymic is changed into Vladislav, the
date, and month and year of birth are not modified.
The certified copy of the final decision of the court, within 5 (five) days from the date of
issuing the final decision of the court as regards the adoption, is posted to the Registry Office of
Rezina in order to make the state registration of the adoption.
The decision may be appealed in the Court of Apeal in Chisinau within 20 days, by means
of the court of Ribnita.
