My comments from last month:
As we go to press with this issue of New Mexico Liberty, the LP's National
Convention in Portland, Oregon will be in progress. The conventional wisdom
was that there will be some interesting events in various committee meetings
there, namely the Platform and Bylaws Committees. I'll include any reports
about those events from attending LPNM members in the August issue.
By this time, you've probably seen some of the changes (and the commentary
back and forth about those changes) on various websites and the LPNM's
email lists, particularly the Forum.
I will admit to having mixed emotions about these changes. On one hand, this
could make Libertarians “more electable” as candidates. Our best prospects
for electing Libertarians to office will be in local-level races, such as for State
Representative, State Senator, City Council and County Commissioner. At
press time, the LPNM's flagship candidate is Paul Trujillo, running for re-
election to the Valencia County Commission after switching to the LPNM from
the Democratic Party. (The LPNM has been offered Ø200K in financial
support, along with another Ø200-500K in in-kind donations, media support,
etc., from a group looking to run a libertarian-minded candidate against
Commissar “Representative” Heather Wilson. Bill Koehler has received that
nomination, but no word has come about those piles of Federal Reserve Notes
. . .)
At the same time, I'm firmly in the “anarchist” or “purist” wing of the LP, and
not likely to change my affiliation much in that respect. While I'm disappointed
in the Reform Caucus' attempt to change the LP's national platform,
remember that I'm not likely to change my rhetoric much to appease those
who would disavow the Zero Aggression Principle (ZAP). In my opinion, the
ZAP is libertarianism's core idea – without it, the LPNM would be rudderless,
adrift on a sea of ideological possibilities. (Apologies to J. Michael Straczynski
for my paraphrasing a line from the Babylon 5 episode “Passing Through
Gesthemane.”) Someone (the name escapes me at the moment) once said,
“If you don't stand for something, you will fall for anything.”
For those in the Reform Caucus who want to make the stripped-out portions of
the platform into some sort of “vision statement,” pointing the way to the
ultimate destination – I can support that (to a degree).
For those in the Reform Caucus who want to disavow the ZAP and Pledge
entirely and sanction some initiation of force, I ask the following questions –
How much force is too much?
Are there any issues for which that sanction doesn't or shouldn't apply? If so,
what are they, and why should that sanction not apply?
Check out page 5 for an example of successful promotion of libertarian
principles – an favorable op-ed piece in the Farmington Daily Times was
written in response to the SJCLP's recent campaign against the anti-smoking
ordinance, mentioning Joseph Knight and Derril Gleim in particular.

ACLU Lawsuit Would Even Playing Field
(Condensed slightly from the ACLU Press Release)
On Tuesday, July 11th, 2006, the ACLU challenged a New
Mexico law that makes new political parties work much
harder to put their candidates on general election ballots
than existing parties. The law first requires new parties to
gather signatures to petition for formal party status, and
then requires new party nominees to gather signatures on
a second petition to put their names on the ballot. No such
requirement holds for Republican and Democrat
nominees.
“No other state in the country has such onerous and lop-
sided requirements for new parties to participate in the
electoral process," said Peter Simonson, Executive
Director for the ACLU of New Mexico. “The law serves no
real purpose except to protect the existing parties from
competition and limit the options that New Mexico voters
have for electing candidates with diverse political
perspectives.”
The ACLU's suit also claims that the New Mexico law
violates rights of political association by forcing new
parties to seek signatures from non-party members in
order to appear on the ballot. The ACLU brought the
lawsuit on behalf of the Libertarian Party of New Mexico
and several individual aspirants to political office who say
that the law will prevent them from running as Libertarians
in the November 2006 elections.
Jay Vandersloot, Chair of the Libertarian Party of New
Mexico, said, “This law effectively gives people who are
not members of our party the ability to veto our nominees.
Why should Libertarian nominees have to convince
Democrats and Republicans to sign petitions allowing
them to run for office? Party status alone should suffice
for them to get on the ballot. What’s good enough for
majority parties should be good enough for all others.
Vandersloot said, “This lawsuit aims to protect the voting
rights not just of Libertarians, but also of any other new
party, including Green and Constitutional Party
candidates.”
The suit was filed in federal court by both the ACLU of
New Mexico and the national ACLU Voting Rights Project.
If successful, the suit could allow Libertarian nominees to
run for office this November.
LP Platform Undergoes Major Change
As most, if not all of you know, there were major changes
to the LP National Platform passed at the Convention in
July. Mainly, it eliminated the majority of the planks. I
envision a flurry of efforts between now and the next LP
Convention in 2008 to reinstitute as many of the planks as
possible. Watch the various forums on the internet to get
an idea of the activity in this direction. If you have any
input, be sure to contact someone on the new Platform
Committee to let them know your input. Let’s take a quick
look at what remains of the LP Platform.

No conflict exists between civil order and individual rights. Both
concepts are based on the same fundamental principle: that no
individual, group, or government may initiate force against any
other individual, group, or government.
Now, let’s take a look at the first of the remaining planks
from our LP National Platform.
I.1 – Freedom and Responsibility
The Issue – Personal responsibility is discouraged by
government denying individuals the opportunity to exercise it. In
fact, the denial of freedom fosters irresponsibility.
The Principle – Individuals should be free to make choices for
themselves and to accept responsibility for the consequences of
the choices they make. We must accept the right of others to
choose for themselves if we are to have the same right. Our
support of an individual's right to make choices in life does not
mean that we necessarily approve or disapprove of those
choices. We believe people must accept personal responsibility
for the consequences of their actions.
Solutions – Libertarian policies will promote a society where
people are free to make and learn from their own decisions.
Transitional Action – Repeal all laws that presume government
knows better than the individual how to run that person’s life.
Encourage private sector dissemination of information to help
consumers make informed decisions on products and services.
Enforce laws against fraud and misrepresentation.

Rio Grande Foundation Calls Attention to
Unnecessary “Pork-barrel” Spending in New Mexico
New Mexicans and All Americans Would
Benefit from Needed Reforms

(Albuquerque, New Mexico) In cooperation with the
Washington, DC-based grassroots organization
Americans for Prosperity, the Rio Grande Foundation
called for New Mexico’s elected officials to stop abusing
earmarks. The “Ending Earmarks Express,” sponsored by
Americans for Prosperity, stopped at Albuquerque’s
Wheels Museum today to highlight the need for
Congressional earmark reform. The Wheels Museum
received a $225,000 earmark in the FY 2004 Omnibus
Appropriations Bill and a $300,000 earmark in the FY 2000
Veterans Affairs / HUD Appropriations Bills.
“Museums are certainly nice things, but just as New
Mexicans shouldn’t be forced to pay for useless bridges in
Alaska, taxpayers in other states, some of whom may
never step foot in New Mexico, should not be forced to pay
for our museums. Ideally, the costs of such museums
should be borne by those who actually attend them or
charities with an interest in promoting cultural
advancement,” said Rio Grande Foundation President
Paul Gessing.
As Gessing noted, “Our elected officials and those who
support rampant earmarking, would love to convince us
that through the hard work and leadership positions of our
elected officials, that New Mexicans come out ahead in
Congressional ‘earmark-wars,’ but that is not the case. Not
only do New Mexicans lose out when we have to foot the
bill for similar projects in other states, but as the Rio
Grande Foundation publicized earlier this year, despite
receiving $2 for every $1 it sends to Washington, New
Mexico is a relatively poor, undeveloped state,” Gessing
argued.
While failing to help New Mexico’s economic situation,
federal spending on earmarks has caused the national
budget picture to worsen. The national debt is nearly $8.5
trillion and each citizen’s share of this debt is more than
$28 thousand and growing daily. The number of earmarks
rose from 958 in 1996 to 15,877 last year, tallying up to
$47.4 billion in the 2005 budget, according to the
Congressional Research Service.
The goal of the “Ending Earmarks Express” tour is to
educate taxpayers about the problem of earmarks and
mobilize them in support of more transparency and
accountability in the appropriations process. Such reforms
would also build momentum for the larger goal of reining in
all forms of wasteful government spending. Find out more

Museum” [ www.wheelsmuseum.org ] where this event
happened. Since this is an outfit that received about
Ø2,000,000 from Sir Spend-It-All and the 110 Stooges, I
figured that this place would be somewhat nice-looking,
spiffy, shiny, that sort of thing. Instead, it looked like a few
of the older auto repair shops adjacent to it on 1st Street
NW – dingy walls, chipped and fading paint. I drove by it
three times – it wasn't until I saw Paul and the AFP people
standing on the curb with an easel that I found it.
What I did not know was that the Ø2,000,000 from Wild
Bill Richardson isn't nearly enough – the “Wheels
Museum” Board is looking for another Ø40,000,000 to
build their white elephant. – MWB ]
Stanhope For President

Due to circumstances well within my control, my July 4th
announcement was postponed until now, July 9th at 4:14
a.m.
As earlier stated, I will be running for the Presidency of the
United States of America in 2008.
An unexpected outpouring of support from factions of the
Libertarian Party has solidified my decision to run for the
nomination as the Libertarian candidate.
I am as serious about this campaign as I am the material I
present on stage. Don't let the comedy divert from the
message.
I'd rather die laughing in the fight than suffer the lesser of
two forms of forced sodomy.

Hooray for Joseph Knight, San Juan Voices, of Flora
Vista, Lee Pitts, Syndicated Columnist, Bill Sharer, District
1, State Senator of Farmington, B.J. Bayles of Aztec,
Janet La Selle of Farmington, Derril Gleim of Aztec, and
Ken Shields, former City Councilor! All of these have hit
the nail on the head (and so far, the point of that nail was a
sharp one) concerning the “smoke-free society” issue.
Mr. Knight, I, too am not in this fight primarily for “smoker’s
rights.” I am in this fight for the limits of the power of
government. Smoking is indeed healthier than fascism.
America is not a free country anymore. Our founding
fathers are rolling over in their graves. Isn’t fascism one of
the worldwide “problems” our America is trying to “fix?”
Senator Sharer, I, too, am offended by the very thought
that free (well, sort of free) Americans need a nanny to
think for them.
B.J. Bayles, you are right. We have not heard much about
the matters of choice. No, the Surgeon General and all of
the other “Smoking Police” cannot prove that smoking is
the one and only cause of every ailment known to
mankind. So, smokers and non-smokers alike, please
choose to frequent the establishments and businesses of
your choice. If the smoking issue is such an important one
to you, choose. Don’t lobby against the rights of others’
choices. Respect them.
Ms. La Selle, BINGO! All of this hoopla over the smoking
issue is just another attempt by insurance companies to
take over, and indeed, this attempt is not given to them by
our Constitution. It’s all about the dollar bill!
My father was a physician in our great state for years, and
I remember him beginning to complain about his
profession about 30 years ago because the insurance
companies were beginning to tell him how he could take
care of his patients. They did this by denying payment to
him and/or to the patient if, in their opinion, a certain test,
exam, or surgery was warranted or not. And, I have two
neurosurgeon friends in Texas who have told me, “It’s just
not any fun anymore” (for the same reasons). I feel certain
that there are countless doctors in our country today who
feel the same way. And I know for a fact that the quality of
patient care has suffered at the hands of insurance. So
you think we should just take a vote on this? Ok, then, let’s
vote, but let’s include the smoking issue in a list of other
health related issues designed to “protect” “free” people,
and there shall be no line item veto. Mr. Pitts has some
great ideas for the list. While I am not a rodeo fan, he
makes some valid suggestions. I’ll not mention them all,
but how about air bags for horseback riders, bulletproof
vests for farriers, anti-kick-back devices on horses,
breathalyzers to prevent mounting a bull or bronco while
intoxicated? How about we also require cowboys to wear
those plastic teeth protectors like they do in the NFL and in
boxing?
What’s next? How about government mandated
sunscreen and hats while outdoors all year long, UV eye
protection for everyone, even those who do not require
corrective lenses, government mandated food choices and
laws for when one can eat and how much, and required
gym membership with punishment for poor attendance
and/or failure to “improve” personal health.
Mr. Gleim, DITTO! Do I hear the Bill of Rights ringing? I
can’t say that I do, but I just felt the rumble of the earth
again as our founding fathers took another turn, and I
certainly can’t hear the Liberty Bell ringing. The
Communist Party of the USA (yikes!) thinks government
should control private business, the Nazi Party of Germany
took total control of private business (and more), and we
are at war with Socialist/Fascist countries around the world
to make them stop doing exactly what government is trying
to do here.
Alcohol abuse, also now known as a “disease,” in my
opinion causes much more harm, economic, and
emotional loss than smokers do. Obese people put a
strain on the health care system as well, but they are
protected under the “laws” of discrimination. Smokers
have simply become an easy target for those with attitudes
of intolerance and these attitudes have also made the
issue a moral one.
Some employers will not hire smokers – even those who
smoke only on their own time in their own homes. This is
discrimination, and an invasion of privacy. It makes
recruitment difficult. Some of these employers have
realized the error in this thinking and have eliminated this
discriminatory act, and the ranks of good employees have
grown. Other employers don’t mention the subject until the
recruit is hired on, at which time the new employee learns
of a smoking “policy,” either in place already or soon to be.
Good employees are either fired with no recourse or move
on to a more tolerant employer. This is also a costly event.
And the non-smoking mediocre to downright dangerous
employees stay on – another example of economic loss
and opportunity for harm done to others. And, all the while,
Big Brother is watching with cameras and recorders,
similar to how our government does in the name of
“national security.”
Austin, Texas – Live Music Capital of the World – voted on
a similar smoking ordinance. I lived there for about 15
years and, as a musician, played in and around Austin.
One of the attractions there for musicians and listeners
(smokers and non-smokers alike) is 6th Street, where
there are many clubs and bars. Austin voted and passed a
no-smoking ordinance where no smoking was allowed in
any public building unless the smoker was at least 15 feet
from the door of the establishment. In the case of 6th
Street, this placed the smoker standing out in the street. I
wonder which is the greater danger – being hit by a car
while standing in the middle of the street smoking a
cigarette, or simply smoking a cigarette – say, on the
sidewalk? I didn’t and don’t like the stench of smoke on my
clothes after a gig, and I don’t frequent bars today (by
choice) but it is of no issue to me because a long time
ago, I put my big girl panties on and began to respectfully
respect the rights and free will of the general public and
business owners to make their own decisions and choices
on smoking.
Mr. Knight, care to join me for a big heaping bowl of
“Libertarian salad?”

Congratulations to the business community of Farmington
– you all have new business partners!
The gang-of-five from city hall is about to elect themselves
to your Board of Directors. Don’t expect any venture
capital to be forthcoming from your new partners, but at
least they will help with the burden of management (like
determining your policy on smoking by owners, managers,
employees, and customers).
Since I’m not a scientist and have been nicotine-free
myself for over ten years (except for a little second-hand
smoke I voluntarily expose myself to), I’ll leave arguments
challenging the science of the smoke-ban proponents to
others. I’m not in this fight for “smokers’ rights” but for
limits on the power of government.
You say you have a right to clean air? Fair enough. But
your right to swing your fist ends where my nose begins. In
this case my nose begins at the front door of my home or
business.
The choices concisely stated
The City will choose between two basic philosophies.
The first is simply stated by the Communist Party: “We
believe that all employers must provide a safe working
environment for their employees. Where restaurants are
filled with second-hand smoke, the workers are
endangered.” (Source: Ask the Communist Party at

The second is stated by the Libertarian Party of San Juan
County: “In a free market, we have a choice. If we are
concerned about second-hand smoke, we can choose to
work or dine in a non-smoking restaurant. If we enjoy
smoking after a meal, we can choose a place that allows
smoking. Let businesses set their own policies, let workers
and customers choose.”
Normally, local politicians don’t get away with
implementing the Communist Party line, but they can do it
while the people cheer if they invoke one or more of the
“holy mantras.”
Holy mantras of the omnipotent state
You’ve heard them before. “National security.” "For the
children." "The common good." "Public safety." "Public
health." "Public morality."
Under the guise of a holy mantra, the omnipotent state can
crush any freedom with impunity.
The wielders of power would discriminate against the
smoking minority to curry favor with the clean-breathing
majority. Yet non-smokers, if concerned about second-
hand smoke, can simply choose to work for, or patronize,
one of the vast majority of businesses whose current
policy is to prohibit smoking.

Such a breadth of options is apparently not good enough
for some. They campaign and lobby endlessly, with the
fervor of a crusade, to stomp out every last place where
smokers might congregate to socialize, or merely enjoy a
smoke with a cup of coffee or after a meal. Such
discrimination is petty, populist pandering of the worst
kind.
Those who would postulate such prohibitive ordnances
while at the same time trying to convince us that they are
motivated solely by issues over the health of the workers
or “for our own good” insult our intelligence. Such
condescending concern is merely another pathetic,
pestilent, pungent ploy in the ongoing quest for the
almighty vote and the abusable power that comes with it.
Worst of all, they will impose yet another unreasonable
and unnecessary restriction on our right to freely exchange
goods and services in the market place under peaceful
conditions that we voluntarily agree to. And thus, yet
another nail will be driven into the coffin of a free market
serving a free people.
Smoking is healthier than fascism
I claim that smoking is healthier than fascism. When we
expose ourselves to either first-hand or second-hand
smoke we may indeed kill off a little piece of our body. But
when we surrender another little bit of freedom, we kill off
a little piece of our soul.
The ultimate objective of the ban-smoking movement is a
“smoke free society.” I heard a city councilor lauding this
goal on a local radio program. So the current ban proposal
is just another step in that direction. When tobacco is
finally driven from a free market to a black market, will
nicotine addicts have to buy tobacco on street corners?
Maybe. Or maybe their kids can get it for them at school.
In the meantime, another precedent of the City (or State or
feds or County) managing your business has been
established.
So come on citizens, show up for those city council
“hearings” on July 11 and August 8. If enough people
grovel for freedom, maybe, just maybe, they will allow a
few places to serve “libertarian salad” (let us alone).

Re: The Torch of Liberty

Somehow, I doubt that you expected your Ten
Commandment comments to be taken as I took them.
However, I quite agree that the "Gang of Nine" needs to
deal with displays of the ten commandments, and other
religious gestures and symbolisms in their own house
first of all. These items need to be removed from and kept
out of all secular undertakings and venues. Perjury is
perjury and punishable as such whether committed "under
oath" or under a solemn promise to tell the truth. Money
will buy just as much (or as little) without In God We Trust
stamped on it. It might even be argued that the purchasing
power of our money was greater before that useless
phrase was added to it. The ideals of our country
(Constitution and Bill of Rights) will be equally as
compelling at home and abroad, without the phrase "under
god" in the pledge of allegiance. I think the case could be
made that the United States of America were more highly
regarded/respected by other nations before this phrase
was added than they have been since the phrase was
added.
Whether the buck stops at the oval office or at the bench
of the justices, a clean sweep needs to be made in this
matter so that the effect can trickle down once and for all.
Otherwise, skirmishes will continue to be fought, tying up
and/or wasting time, thought and resources until this
artificial premise sustains enough cracks to collapse on its
own.
In the meantime and in perpetuity, all those who care to do
so may display the ten commandments on the front lawns,
the back parking lots and both sides of each an every
church in the land. You'll get NO argument from me.

Purposefulness and Objectivity
Boost Image of National LP

I have attended several national Libertarian Party
conventions over the years, and have enjoyed them all.
However, the one held recently in Portland, Oregon struck
me as especially positive and effective. This was a result
of the air of purposefulness and objectivity that was
evident throughout the sessions. The delegates engaged
in lively debates, but had little appetite for the "in-your-
face" aggressiveness to which some Liberatians resort out
of frustration that no one understands or appreciates their
arguments. Such gravitas is especially effective when
Libertarians engage in debates with our opponents, who
would like nothing better than to be able to dismiss us as a
"nut group." I hope to see more of such maturity on the
part of our supporters in both casual and organized
encounters with Libertarians and others.

When sending your submission as an MS Word (or Open
Office Text) file, send it single-spaced in 10-pt Arial – like
this is. Margins should be half-inch (0.5”) around, with no
headers or footers. If you send it in a text-only format,
make it clear to me if you want anything in bold type,
underlined, in italics, struck-through, different colors, etc.
I’m not telepathic here, so help me out.
Graphics (pictures, cartoons, etc.) – send the highest
quality graphics you can – email them to me at the
address above, and I’ll do what I can to get them in the
next issue. In particular, what I want are pictures of YOU
the LPNM members, either at LPNM-sponsored events or
at other peoples' events.
Submission deadline for each issue – midnight, third
Tuesday of the month.
Articles
As for writing your article, It should be concise (no longer
than a full page) and topical. A bit of humor helps,
especially for op-ed pieces.
What I'm really looking for in the way of articles is what's
going on in the LPNM – what YOU the membership are up
to in spreading the message. For example, an article
about the stupidity, insanity and evil of the UN might get
put in, depending on available space and the quality of the
article. A group of LPNM members counter-protesting the
raising of a UN flag by the city council WILL get put in, and
probably will get first priority.
Letters to the Editor
The editor will publish letters on a space-available basis.
The same standards apply for letters that apply for articles
– keep them concise and topical. The editor will NOT
publish letters in response to other letters – New Mexico
Liberty is NOT a message board – use the message
section of NML's Yahoo! group for that purpose. Or post
your traffic to the LPNM's other email lists – LPNM-discuss
or LPNM-forum.
Editorial Viewpoint
The basis for libertarian thought is the Zero Aggression
Principle –
A libertarian is someone who believes that no
human being has the right – under any
circumstances – to initiate force against another
human being, nor to threaten, incite or delegate its
initiation.
New Mexico Liberty holds that Libertarian candidates,
officeholders or appointed spokespersons at all levels of
government or the Party should refrain from advocating
new or more restrictive laws, new or more expensive
spending programs, or new or higher taxes. To
paraphrase from the medical profession, “First, do no
harm.”
