GROUNDS FOR TERMINATION

1. Gross and habitual neglect of duties


An employee who frequently failed to perform his duties and does this for not just once
but many isolated instances. For example, when an employee constantly report late,
abandons his shift and absents himself without just causes, then he can be terminated
under this ground.

2. Willful disobedience of company policies


An employee who intentionally, with bad faith, disregards an order by the management
is subjected to termination. It must be reasonable, lawful and must be related to his
performance on the duties of the employee.

3. Serious misconduct
An employee who purposely goes against company policies, such as destroying
company properties intentionally, bullying and maltreatment to customers, co-
employees and employer. This implies wrongful intent and not just mere error of
judgement.

4. Fraud or willful breach of trust


An employee who holds a position of trust and confidence in the company commits
fraud is a just cause for termination. The breach must be related in the performance on
his duties and must be done intentionally. Substantial evidences must be presented in
proving such cases.

5. Commission of a crime or Offense


An employee who is guilty of committing crime on nay other actions which is in contrary
to the laws of the Republic of the Philippines can be terminated under this ground.
These acts may be against the employer, his family or representatives.

6. Other Analog Cases


Such cases may be are those enumerated under the governing rules and regulations on
the termination employment in the Labor Code of the Philippines.
SANCTIONS AND POLICIES

An employee who committed any violation of the rules and regulations of the company shall be
given rightful sanction. They will undergo further monitoring and investigation within equivalent
sanctions.

FIRST OFFENSE – ORAL REPRIMENAND

SECOND OFFENSE – WRITTEN REPRIMAND

THIRD OFFENSE – SUSPENSION / SALARY DEDUCTIONS

FOURTH OFFENSE – TERMINATION OF EMPLOYMENT

OFFENSES:

1. Three (3) consecutive late or absence without just cause or notice to the manager
2. Using cellphones during duty hours
3. Maltreatment to customers, co-employees and employer
4. Dishonesty of work
5. Infliction of injury to the company
6. Reporting in duty under the influence of alcohol or in possession of deadly weapons
7. Illegal possession or use of prohibited drugs
8. Sexual harassment
9. False statement, unauthorized disclosure of information and any act for own or personal
convenience that will put the business at risk
