A N O RDER
E STABLISHING THE G ENDER AND D EVELOPMENT F OCAL P OINT
FOR THE M UNICIPAL G OVERNMENT OF B USTOS , B ULACAN ,
P RESCRIBING R ULES T HEREFOR , AND F OR O THER P URPOSES

WHEREAS, pursuant to the Convention on the Elimination of All Forms


of Discrimination Against Women (CEDAW), the Beijing Platform for Action,
the Republic Act 7192 (Women in Development and Nation-building Act), and
the Millennium Development Goals, the Philippines has committed to pursue
women's empowerment and gender equality in the country;

WHEREAS, in accordance with Executive Order (EO) No. 273


(Approving and Adopting the Philippine Plan for Gender-Responsive
Development, 1995-2025), agencies are mandated to institutionalize Gender
and Development (GAD) in government by incorporating the GAD concerns in
their planning, programming and budgeting processes. EO No. 273 also
mandates agencies to incorporate and reflect GAD concerns in their agency
performance commitment contracts, annual budget proposals and work and
financial plans;

WHEREAS, as declared by the United Nations, it shall be the policy of


this Municipal Government to treat women’s rights as human rights, and
therefore will work towards the full protection and guarantee of the following:

1. Women have the right to prevention of and protection from all forms
of violence and coercion against their person, their freedom, their
sexuality and their individuality;

2. Women have the right to freely and fully participate individually or


collectively – in the political process prevalent in their communities
and nations;

3. Women have the right to the knowledge and means necessary for the
full exercise of their reproductive rights according to their beliefs
and preferences;

4. Women have the right to the means of ensur ing their economic
welfare and security;

5. Women have the right to choose their spouses in accordance with


their values and preferences, and obtain adequate support for the
rearing and caring of their children;

6. Women have the right to an adequate, relevant and gender fair


education throughout their lives, from childhood to adulthood ;
7. Women have the right to adequate nutrition and proper health care.

8. Women have the right to humane living conditions;

9. Women have the right to nurture their personhood, collec tively and
individually, to secure an image of themselves as whole and valuable
human beings to build relationships based on respect, trust and
mutuality; and

10. Women have the right to equality before the law in principle as well
as in practice.

WHEREAS, in response to these, the Municipal Government of Bustos,


Bulacan aims to institutionalize gender-responsive programs to protect and
promote women’s rights and uplift their welfare through the
institutionalization of a Gender and Development (GAD) Focal Poi nt pursuant
to DBM-NEDA-NCRFW Joint Circular No. 2004-01;

NOW, THEREFORE, I, ARNEL F. MENDOZA, Municipal Mayor of the


Municipality of Bustos, Province of Bulacan, by virtue of the powers vested
upon me by law, do hereby order:

S ECTION 1. I NSTITUTIONALIZATION OF THE G ENDER AND D EVELOPMENT


(GAD) F OCAL P OINT . – There is hereby established a Gender and Development
(GAD) Focal Point for the years 2010 to 2013, which shall be composed of the
following:

S ECTION 2. D UTIES AND R ESPONSIBILITIES OF THE G ENDER AND


D EVELOPMENT (GAD) F OCAL P OINT . – The GAD Focal Point shall:

1. Serve as catalyst for gender-responsive planning and programming;


2. Oversee and coordinate the planning and implementation of GAD
Programs;
3. Facilitate GAD-related activities and establish sex-disaggregated
data;
4. Serve a key informant on gender issues; and
5. Prepare the Annual GAD Plan and Budget Accomplishment Report.

S ECTION 3. GAD P LAN AND B UDGETING . – ( A ) In response to Republic Act


No. 7192, otherwise known as the ―Women in Development and Nation-
Building Act,‖ the Municipal Government, through the GAD Focal Point , shall
prepare the GAD Plan following the procedures set forth under DBM -NEDA-
NCRFW Joint Circular No. 2004-01 and such other rules and regulations that
may be promulgated from time to time.
(B) To operationalize the Annual GAD Plan, the GAD Focal Point, with
the assistance and advice of the Local Finance Committee, shall prepare the
budget therefor which shall emanate from not more than five percent (5%) of
the total annual appropriations.

S ECTION 4. A NNUAL G ENDER AND D EVELOPMENT A CCOMPLISHMENT


R EPORT . – On December of every year, the GAD Focal Point — through the
Municipal Social Welfare and Development Officer, the WCPC of the Bustos
Police, and the Municipal Accountant — shall submit to the Office of the
Municipal Mayor the Annual Gender and Development (GAD) Accomplishment
Report.

S ECTION 5. P ROHIBITIONS ON GAD B UDGETING . – Pursuant to the


guidelines prescribed by the Department of the I nterior and Local Government,
it is hereby reiterated that the GAD Budget shall NOT be appropriated for the
following:

1. Social and recreation activities;


2. Physical health and mental fitness programs;
3. Organization of employees’ groups and their projects;
4. Religious and cultural activities;
5. Meetings, workshops or consultations beyond the scope of women -
related concerns;
6. Skills training, entrepreneurial or livelihood projects for women
employees;
7. Construction for infrastructural projects that do not relate to ge nder
development issues; and
8. Payment of power and energy services and the like.

S ECTION 6. E FFECTIVITY . – This Executive Order shall take effect upon


approval.
