1. Introduction
900 MHz and 35/ 43 MHz. Described below: also for ITS. The benefits of multi-band,
multi-protocol ITS wireless systems is briefly discussed below. However, we focus herein on
the 200 MHz due to various increasing demands for this spectrum by US government entities
including metropolitan railroad agencies.
Cost: As discussed below, some of the spectrum is at no cost, and additional is available
at little or no cash cost and modest in-kind cost to advanced ITS in the public interest to advance
Federal goals of ITS (reduction of accidents, congestion, pollution, fuel use, etc.).
Applications: The ITS applications include “Positive Train Control” (“PTC”) and other
wireless data and voice for train operations, and other government transportation purposes,
including high-accuracy location (“HALO”) (consistent sub-foot accuracy for moving vehicles)
primarily by use of corrections of GPS readings, including by use of Network RTK (“N-RTK”).
Skybridge is the first and only nonprofit organization in the nation with substantial FCC
license assets and programs for nationwide public interest wireless.

2.1. 220-222 MHz set aside for government. Spectrum in red in Chart 1 above. No
cost: this is by direct application to the FCC: not in an auction and not secondary market
purchase. Skybridge can assist with license applications fro bona fide ITS applications. There is
150 kHz available (channels 161-170, and 181-185) and potentially another 100 kHz (channels
111-120).1
Of this spectrum in red in Chart 1 above, in only minor parts of the nation has the
spectrum been substantially or fully licensed. A rough estimate is that only approximately 12%
of the total of this spectrum has been licenses on MHz-Pops basis, and less by MHz-Area basis.
What has been licensed is shown in Exhibit 1 in the list at the end.
2.2 Additional 217-222 MHz spectrum for government. First, see the channels in
green and burnt-orange in Chart 1 above. As indicated in the Chart, much of this spectrum is
currently held by Skybridge (and associates). Skybridge is seeking cooperation of other
spectrum holders to obtain more of this spectrum for this government program.
Skybridge is not seeking profit (or any fees) in performing this consolidation role, and not
seeking to control the spectrum of other licensees, but to provide a service to consolidate into
wider channels the non-adjacent 5 kHz channels in the green blocks, and to secure these for
government for a reasonable period of time. Associated FCC relief will be sought.
See Exhibit 2 hereto: this includes a list of Skybridge’s current 220-222 MHz spectrum,
and its associate sponsors’ spectrum in 217-222 MHz (and other bands). For bona fide
government ITS programs, Skybridge will make available substantial amounts of its 220-222,
and 217-220 MHz to add to the spectrum noted in 2.1 above, at little or no cost.
In addition, its associates will make available additional spectrum in 217-220 MHz:
AMTS spectrum, and some spectrum they have in 220-222 MHz, at little or no cash cost and
modest “in-kind” cost: namely, non-exclusive use of certain wireless facilities to support ITS
wireless (and broader smart transport, energy, environment and emergency wireless).
3. 35, 43, and 900 MHz also for ITS, and SDR, DMR+ broadcast, etc.
- 900 MHz: 6+ MHz nearly nationwide: (1) 6 MHz in the Part-90 M-LMS lower
900 MHz band: a high-power licensed band designed by the FCC for ITS wide-area services, (2)
40-350 kHz of very high power (a) MAS licenses in 929 to 960 MHz, along with (b) nationwide
Part-22 very high power licenses in lower 900 MHz;
- 43 and 35 MHz: 180-500 kHz nationwide. This is primarily for Meteor Burst
Communications (“MBC”). Regarding MBC, see our MBC Collection at:

It is far more effective and cost-efficient to design, deploy and maintain and expand new
wide-area wireless for ITS (and any purpose) using a combination of spectrum as listed above:
the substantial multiple-MHz of 900 MHz is ideal for urban areas and other high-traffic areas,
the lesser amounts of 200 MHz is ideal for the more rural areas, and the low-band VHF using
MBC is ideal for the widest areas coverage (and backing up the 200 and 900 MHz everywhere).
Also, software defined radio (“SDR”), and cognitive radio (“CR”) should be used. The
technology is available, and for vehicular ITS uses (trains, road vehicles, ships, planes and cargo
containers) it can be practical and cost effective (the size and power is not an issue, as compared
to handheld devices).
SDR and CR will allow for multi-band and multi-protocol radios, and also support
advanced GPS-GNSS using Network RTK for high-accuracy location (under 1 foot accuracy)
(“HALO”) which will enable many ITS applications long planned but not otherwise attainable.

In addition, DRM-Plus (Digital Radio Mondiale- Plus) works in 174-230 MHz (“Band
III”: http://en.wikipedia.org/wiki/Band_III). It is a new ETSI- standard OFDM digital broadcast
technology for efficient long-range broadcast (including of IP data)—part of the DMR family2 to
replace narrowband analog broadcast. In a well designed new wireless network for ITS or other
critical-infrastructure purpose, data broadcast should be used with two-way voice and data,
since broadcast is far more spectrum-, power-, and cost-efficient vs. two-way for transmitting
data from the network to all, or may, mobile units. Some DMR-plus information is at:

In sum, while Skybridge an associates will assist government with lower 200 MHz by
itself, they strongly advocate and will provide additional assistance in far more intelligent and
capable wireless using multiple bands, protocols, and broadcast+ 2-way mode, and employing
high accuracy location (HALO, discussed elsewhere herein). Government and other private- or
professional mobile wireless in the US clearly lacks good long-term planning, and even use of
currently available best technologies. This should be pursue in any major new wireless network,
and especially in wireless for Intelligent Transportation Systems--including PTC, Smart Grid,
environmental monitoring and protection and emergency-response: the most critical wireless.

above, the plan to use some of the channels for DRM data casting for smart transportation, energy, and
emergency wireless.

Legitimate legal and business “due diligence” is easy regarding the following.
The “geographic”-licensed A-block (217.5- 218, and 219.5-219 MHz) currently held by
Maritime Communications/ Land Mobile LLC (“MCLM”) in parts of the US3 is subject to
current FCC Investigations, and FCC “restricted proceeding” challenges, for rule violations in
obtaining the spectrum, and to court proceeding. The details are public.4
“Spectrum Bridge” (no relation to Skybridge), the spectrum broker for MCLM and
MCLM downplay the risks, and from FOI-obtained documents, avoid these facts. However, the
facts and law show clear, major rule violations and fraud.5 There are other parties aiding and
also liable in this.
Two of the Skybridge associates, Intelligent Transportation & Monitoring Wireless LLC
and Environmentel LLC, were the lawful high bidders for that AMTS spectrum (in addition to
the greater amounts of AMTS these two entities and other Skybridge Associates won in this and
the earlier AMTS auction) and are pursuing claims to receive it before the FCC and in court.

The rest of the geographic A-block is licensed to Skybridge and associates in the Northeast, Southeast,
Northwest parts, and Alaska, and under contract or the Mountain area). Skybridge and associates also
hold most of the AMTS B-block in the US. The B-block is 217-217.5 and 219-219.5 MHz. We sold
some of the B block and some of the A block in parts of the US where we held both blocks, to power
utilities: Northeast Utilities Service Company, VELCO-TRANCO, Avista, and Puget Sound Energy,
maintaining sufficient AMTS for our long-term ITS plans in the areas of those sales.

In addition, MCLM with regard to AMTS A-block, and Paging Systems Inc. (“PSI”) with regard to
AMTS B-block, hold alleged-valid AMTS site-based stations. However, both MCLM and PSI are in
clear violation of two FCC orders to provide the technical details of these alleged-valid stations to the
geographic co-channels licensees, which are Skybridge and its associations. See FCC Orders DA 10-664
and DA 09-793. These violations are matters in court including under 47 USC §§ 401(b), 313, 206-207.
FCC Orders DA 10-664 and DA 09-793 require MCLM and PSI to provide to the co-channel geographic
licensees (Havens entities) their alleged site-based station tech details under 80.385(b), and cited the
80.475(a) coverage requirement. They refuse do that, thus the matter is in court. In addition, neither has
reported any actual operating stations construction details to FCC on Form 601, or on FCC Form 499A as
required, or to State law authorities, and only nominal signal has been measured at some. Also, these
alleged-valid stations (even if at operated at much higher ERP) failed to meet the overlapping-site
requirement of AMTS at the construction-coverage deadlines years ago: they all thus “automatically
terminated without specific Commission Action” under FCC rules §§ 80.475(a)* then in effect (see DA
10-664), 80.49, 1.464, and 1.955, and the condition stated on each station license. Thus, these stations are
not valid under law. Other defects than stated above also apply. *(Single-stations with no overlap
prohibited: AMTS construction-coverage required service overlap over entire applicant defined
waterway, in this case, PSI defined the entire Atlantic Coast, but not meet the requirement.)

in the areas depicted on the following map.
In joint ventures with State and/ or local government, Skybridge may also obtain use of FCC
licenses for any region in which the hold M-LMS licenses for N-LMS spectrum depicted above, as
well as in the other regions.
The Sky-Tel entities may also use substantial amounts of 5.9 GHz DSRC spectrum, in the range of
20-30 MHz, under Part 90, Subpart M (this is the sister ITS band to LMS). Among other uses:
vehicle to vehicle, and vehicle to roadside (in dual mode with other spectrum indicated above), but
also point-to-point backhaul (5.9 GHz, in P-t-P use, matches in distance LMS in mobile use).

“AMTS” stands for “Automated Maritime Telecommunications Systems.” This spectrum was
originally designated for ship-to-shore maritime communications, but is now used for land as well
as maritime services, at option of the licensee, with limited maritime obligations in situations.

In addition to the AMTS licenses depicted on the next page, we have pending before the
FCC petitions for grant of the A-block AMTS in the areas we do not already hold it (or have
not purchased it, pending closing): that is based on evidence we found that shows that we
were the lawful high bidder for that in FCC Auction 61 (the FCC has an investigation of that
pending at this time- end 2009 / early 2010).
