DIRECTIVE BY THE CITY OF CLEARLAKE DIRECTOR OF EMERGENCY


SERVICES REGARDING PARK CLOSURES
WHEREAS, on March 13, 2020 the Director of Emergency Services (City Manager) for the
City of Clearlake issued a Proclamation of Local Emergency due to COVID-19, which was
ratified by the City Council on March 19, 2020; and

WHEREAS, the Director of Emergency Services (City Manager) is empowered to make and
issue rules and regulations on matters reasonably related to the protection of life and
property as affected by such emergency; and

WHEREAS, on March 22, 2020 the Director of Emergency Services ordered the closure
of Redbud Park, based on the advice of the Lake County Health Officer, in the interests
of public health and safety; and

WHEREAS, on March 23, 2020 the Lake County Health Officer issued Addendum (A2)
Order, which orders the closure of parks, including skate parks and basketball courts.

WHEREAS, on March 24, 2020 the Director of Emergency Services ordered the closure
of Redbud Park, based on the advice of the Lake County Health Officer, in the interests
of public health and safety; and

WHEREAS, on April 23, 2020 the Lake County Health Officer issued Addendum (A4)
Order, which lifts certain restrictions including, but not limited to, permitting fishing from
the shore of the lake in areas where parks are open and allowing hiking and jogging in
open parks.

NOW, THEREFORE, IT IS PROCLAIMED AND ORDERED by the City Manager of the City of
Clearlake that the Clearlake Emergency Orders issued on March 22, 2020 and March
24, 2020 are rescinded; and

IT IS FURTHER ORDERED by the City Manager of the City of Clearlake that, in the
interests of public health and safety, that the playground area at Austin Beach (APN #
039-530-38), the portion of Austin Park, including the skatepark and basketball court
(APN #039-530-32 and 039-530-33) bound by Olympic Drive to the north, Lakeshore
Drive to the west, Austin Road to the south and Uhl Avenue to the east, and the Thompson
Harbor Boat ramps at Redbud Park (APN#040-240-10) are closed.

No person shall enter any closed park or park area. No person shall remain in a closed
park or closed area of a park after having been notified of the closure and having been
requested to leave by any peace officer or other person so designated by the City
Manager or Chief of Police.
1. Notice of the park or park area closure, to include barriers, shall be posted at
appropriate locations during the period of closure, if feasible. However,
failure to post such notices shall not invalidate such closure nor shall it
invalidate any exclusion for violating this Section.

2. No person shall operate a vehicle or park a vehicle in the park during the
closure.

3. This order shall not apply to peace officers, fire and rescue personnel or
other government officials acting in the course and scope of their duties to
enforce this order or perform other official duties as directed by their
employer.

4. This order shall not apply to electrical, sewage, utility workers, construction
workers or contractors thereof, when acting in the course and scope of their
official duties to perform work, repairs or maintenance necessary to maintain
critical infrastructure or otherwise provide essential community services with
the prior approval of the City of Clearlake.

5. The City of Clearlake may provide temporary written authorization for use of
facilities under this order if determined by the City Manager/Emergency
Services Director that the use is necessary for providing essential supplies or
services to the community.

IT IS FURTHER ORDERED that the rescinding of the prior orders shall not in any manner
affect the prosecution for violations of the orders, which violations were committed prior to
the effective date of this order, nor be construed as a waiver of any penalty at the
effective date due and unpaid under such orders.

NOW, THEREFORE, IT IS FURTHER ORDERED by the City Manager of the City of


Clearlake that this order shall take effect on April 24, 2020 at 8:00am.
