OUSTER COMPLAINT

Pursuant to KS.A. 60-1205 Grounds for Forfeiture of Office and Instituting Ouster Proceedings
against State Officers KS.A. 60-1206(a)(b). This is an Ouster Complaint against Frontenac Police
chief Cody Milligan and Frontenac Police officer Faucet of 199 N. Crawford street in Frontenac,
Kansas 66763 under KS.A. 60-1205 and KS.A. 60-1206(a)(b). Proceedings to oust a state officer
shall be commenced only by the attorney general.

This is a complaint against Frontenac Police Chief Cody Milligan and City of Frontenac police
Officer Faucet because chief Milligan failed to properly train Police Officer Faucet on the city
ordinances of sweeping out the sides of the road to avoid the gutters filling up and backing up
the street with water and the Kansas statutes of disorderly conduct which officer Faucet
threatened to arrest me for.

Frontenac police officer Faucet did not properly follow police standards and training on the
date of April 28, 2020 when he came out and talked to me because I was sweeping up tree
debris that piled up on the sides of the road and clogs up water because the city doesn't do their
job and clean it themselves.

This complaint was sent to this office because of the misconduct that Frontenac Police Officers
Cody Milligan and officer Faucet displayed on April 28, 2020.

The incident on April 28, 2020 at 9 am is where officer Faucet threatened to arrest me for
disorderly conduct if I ever sweep up the tree debris that piles up on the side of the road again.

Frontenac Kansas already has had a lot of misconduct by their city officials and the city council
and that is why they have a civil lawsuit filed against them by an attorney. They fired their
former city attorney Timothy Fielder and he filed a civil lawsuit against them which was on the
front page of the morning sun paper which is published in Pittsburg Kansas Morning Sun
newspaper.

It seems that Frontenac police think they can do whatever they want just like Frontenac city
council did which is not right and that is why the council has a lawsuit filed against them.
Officers Cody Milligan and officer Faucet were employed by the city of Frontenac Police at that
time the federal lawsuit was filed against the city council by former Frontenac city attorney
Timothy Fielder so I don't understand why they neglected to follow the proper training
sessions that police chief Cody Milligan should have had with his Frontenac police officers and
they all should be aware of the Kansas statute for disorderly conduct.

The court case of State ex rel. Hecht v. Felker, 2003 WL 22389087, at *1 (Kan. Dist. Ct., Oct. 17,
2003) stated that analysis of nearly all applicable ouster cases discloses that the misconduct of

the ousted public official either extended over lengthy intervals and involved numerous acts of
misconduct or the misconduct was particularly grievous and involved an evil motive of
personal gain for the ousted official." Id. At *2. In other words, ouster requires sufficiently
egregious conduct employed over a lengthy period of time or conduct employed with an evil
motive. In my opinion Officer Cody Milligan and officer Faucet need ousted from office
because they have continued to harass me just because my neighbor Yolanda Martin called the
police when I feel that she should actually be charged for filing a false police report against me.

Cody Milligan and officer Faucet need to be investigated on the proper protocol for charging
someone with disorderly conduct and the city ordinances for Frontenac for simply sweeping up
tree debris that piled on the side of the road and keeps the gutters from clogging up.

I'M ACTUALLY DOING THE CITY OF FRONTENAC A FAVOR BECAUSE THEY DON'T DO
THEIR JOB BY CLEANING THE DEBRIS THAT CLOGS GUTTERS AND WATER BACKS UP!

I've read where the Phelps Law Firm of Westboro Baptist Church in Topeka Kansas pickets
funerals of homosexuals and actually walks around with signs that say fag, and God hates fags.

Are you telling me that it is ok for someone to picket funerals with signs that say fag, and God
hates fags but yet I can't sweep the tree debris that clogs gutters and forces water to pile up on
our roads?

People don't have to agree with everyone's opinion on how the streets look as long as I am not
violating any city ordinance or Kansas state statute which I have not.

I have read a lot of complaints that were filed on conflict gate.com against city officials in
Pittsburg and that is what ignited me to file this complaint. I will not sit back and be arrested
for disorderly conduct just because Frontenac is a small town and the city officials feel they can
do whatever they want rather it is legal or illegal. That is the same reason that Frontenac city
council has a lawsuit filed against them by their former city attorney Timothy Fielder. I read a
previous ouster complaint on Noah Day getting arrested for disorderly conduct in Pittsburg
(which was later dismissed) and that is why I am filing this complaint against the Frontenac
police chief Milligan and officer Faucet because I am scared I will be arrested for disorderly
conduct and have to pay to bond out of jail for something that is RIDICULOUS and not
disorderly conduct.
Next time that I am sweeping the sides of the road after tree debris piles up and a neighbor calls
the police on me then I am going to have my phone out and video the entire investigation so
that I have video proof of the harassment that officer Faucett is giving me. I still don't
understand why Noah Day was charged with disorderly conduct by Pittsburg police (which
was later dismissed by his attorney Jason P. Wiske) but Pittsburg Police officer Adam Harrison
was never arrested by Pittsburg Police Department for possession of drugs? Why didn't Police
chief Brent Narges have his staff arrest Adam Harrison? Former Pittsburg Police officer Jesse
Davis was arrested and recently fired in 2017 so why wasn't Adam Harrison charged with a
crime? If the guy that filmed Adam Harrison did not get charged with disorderly conduct then
why did Officer Larry Warner tell Noah Day that he would get charged with disorderly
conduct if he filmed anyone? I would like to know if it is illegal to film people because I am
tired of being harassed by the Frontenac police department and I don't want to violate any city
ordinances or Kansas statutes by filming someone for my own protection.

Am I allowed to film the trash service if they drive down our streets in the morning or will I be
charged with disorderly conduct for filming them even though them driving the truck is more
of a disturbance than me sweeping streets or filming them and it is too noisy?

I am just curious because that seems to be more of a disorderly conduct than sweeping the sides
of the street from fallen tree debris to avoid the gutters clogging up and water going out in the
street which technically is the job of THE CITY OF FRONTENAC'S maintenance department!!!

Please investigate the above mentioned Frontenac Police officers Cody Milligan and officer
Faucet for the lack of proper training standards on the issues that have been addressed above so
that we don't have any mistakes made by Frontenac Police like we already had with the
Pittsburg police department with the recent resignations or firing of former Pittsburg Police
Officers Adam Harrison and Jesse Davis.

I appreciate an investigation into this matter as soon as possible.

P.5. I do not know officer Faucet's first name because I was to scared and intimidated to look at

his uniform when he threatened me with disorderly conduct and jail. I was so scared that I hit a

search on the internet on what to do when police officers harass you and conflict gate.com came

up with numerous ouster complaints against public officials. If I get arrested for disorderly

conduct for something that is not right I will be contacting former Frontenac city attorney

Timothy Fielder to get the same attorney he got who filed the lawsuit against Frontenac city

council to sue Frontenac police department for their harassment, lack of training and abuse they
are causing me which will lead to damages against me unless your office investigates what is

going on in Frontenac Kansas. I was just going to use the stuff I swept up for compost which I

told officer Faucet but he cut me off did not listen and yelled at me that if I did it again I would

go to jail for disorderly conduct.
