WITNESSETH;
WHEREAS, the LESSOR is the absolute owner of the land and building with an area of
________________ situated at Manghinao Proper, Bauan, Batangas covered and embraced by
Transfer Certificate of Title No. ___________________with corresponding Tax Declaration No.
___________________;
NOW THEREFORE, for and in consideration of the foregoing premises, the LESSOR leases
unto the LESSEE and the LESSEE hereby accepts from the LESSOR the LEASED premises,
subject to the following terms and conditions:
1. PURPOSES: That premises hereby leased shall be used exclusively by the LESSEE for
commercial space only and shall not be diverted to other uses. It is hereby expressly agreed
that if at any time the premises are used for other purposes, the LESSOR shall have the right to
rescind this contract without prejudice to its other rights under the law.
2. TERM: This term of lease is for ONE (1) YEAR commencing on ________________to
___________________. Upon its expiration, this lease may be renewed under such terms and
conditions as my be mutually agreed upon by both parties, written notice of intention to renew
the lease shall be served to the LESSOR not later than thirty (30) days prior to the expiry date of
the period herein agreed upon.
3. RENTAL RATE: The monthly rental rate for the leased premises shall be TEN THOUSAND
PESOS ONLY (Php 10,000.00),Philippine Currency, with five(5%) percent increase of annual
rental upon renewal and which the total Monthly payment shall be remitted on or before the last
day of the each calendar month at _____________, without need of demand. All rental
payments shall be payable to the LESSOR.
4. DEPOSIT: That the LESSEE shall deposit to the LESSOR upon signing of this contract an
amount equivalent to the sum of THIRTY THOUSAND PESOS ONLY: (Php 30,000.00), non-
taxable, as one month advance and two months deposit to be applied as rental payments
toward the end of this contract, after deducting any unpaid bills from public utilities such as
water and electric services, payable in Philippine Currency.
11. RETURN OF THE UNIT: Upon the expiration of the Lease Period, or upon the termination of
this contract, the LESSEE shall immediately and peacefully return to the LESSOR the
possession of the Unit in as good, clean, sanitary and tenantable condition as when the
LESSEE received it from the LESSOR, reasonable and ordinary wear and tear excepted,
devoid of all occupants, furniture, and personal articles, and effects of any kind.
12. LOSS: The LESSOR is not liable to any occupant, customer or guest for injury, damage, or
loss to person or property, from any cause including fire, smoke, rain, flood, water leaks,
lightning, wind, explosions, interruption of utilities, pipe leaks, theft, negligent or intentional acts
of occupants, staff, employees, customers, guests or criminal conduct of other persons
including theft, burglary, assault, vandalism or other crimes.
13. SUB-LEASE. Sub-letting of the Unit or any portion or space therein is prohibited.
14. ASSIGNMENT: This Contract or any leasehold rights or interest herein cannot be assigned
by the LESSEE.
15. PRE-TERMINATION: LESSEE cannot pre-terminate the lease. Pre-terminating the lease
will result in the automatic forfeiture of LESSEE’s security deposit
16. RULES & REGULATIONS: LESSEE shall faithfully comply with and abide by the Rules &
Regulations promulgated, updated, or revised by the LESSOR and/or the Building Association
from time to time. These Rules & Regulations shall form an integral part of this Contract such
that any violation thereof will constitute a breach of this Contract.
17. JUDICIAL RELIEF: Should any one of the parties herein be compelled to seek judicial
relief against the other, the losing party shall pay an amount of One Hundred (100) % of the
amount clamed in the complaint as attorney's fees which shall in no case be less than Php
50,000.00 pesos in addition to other cost and damages which the said party may be entitled to
under the law.
