2. The Motionto ComPelIs granted basedon the Court's previousorder

allowing Mr. Frazieradditional time to produce the discovery responses,

and his failure

to produce them by February 25,2009.

3. Basedon the admissionof Mr. Frazier in his Answer flied on February20,

2009, Mr. Frazier"isfound to be the legal and biological father of Ella Dlan Hughes,date

of birth February17, 2004, for aUlegal purposes,includingthat of Inheritance,and the

relationship of parent-child shall be establishedas If the child had beenborn in lawful

Court found, basedon Mr. Frazier'sstandard of living and earning capacity, he has the ..
ability to earn $150,000.00 per year ($12,500.00 per month). The Court found Ms.

Hughes'cholce,to stay at home with her children Is reasonableunder the circumstances

due to the expense of child care for the children. The Court Imputed Ms. Hughes'

Incomeat minimumwage or $1,135.33per month. SeeChildSupportWorksheet

attached herem as Exhibit A.

. 5. Ms. Hughes shall provide health Insurance for the minor child, and the

child support worksheet shalt refted: a credit for $284.88 per month. Mr. Frazier and

Ms. Hughes shalt each pay their pro-rata share of all medical bilts not covered by

Insurancebeginning March 1, 2009 (930/0for Mr. frazier and 7% for Ms. Hughes). Ms.

Hughesshalt send the bills to Mr. frazier within ten (10) days of her receipt of the bill

after Insuranrehas paid Its portion. Mr. Fraziershall pay his portionto Ms. Hughes

within thirty (30) days of receipt of the bill.

6. Mr. frazier did not appear to assert any defensesor present any proof as

tx> any child support related Issues. Further, ExhibitOne which was admittedInto

evidence without objection Indicated that Mr. Frazier's ex-wife filed a Petition for

Contempt against Mr. Frazier regarding child support In the OlVOrcecase In MIssissippi.

(A(TIVAtwood frazier vs. Harris Oaibome Frazier,evIl Action, Ale No. 2007-802 In the

Chancery Court of Madison County, MississippI). Therefore, the Court Is not allowing

any creditsfor childsupportpaidto other chil~ren.

7. A judgmentshaHbe enteredagainstMr. Frazier In the amountof

$106,800(sixty (60) monthsat $1,780per month)backto the child'sdate of birth of

February17, 2004, pius statutory Interest, for retroactivechild support, for which

executionmay Issue,If necessary. Mr. Fraziershall pay an additional$220.00per-

month toward the retroact1vejudgment until paid In full, for a total paymentof

$2,000.00per month,beginningMarch6, 2009.

8. A judgment shall be entered against Mr. Frazier In the amount of

$3,900.06for medicalbills and birthing expenses,for which executionmay Issue,If

necessary.
9. A judgment shall be entered against Mr. Frazier In the amount of

$9,000.00for attorney'sfees,for whichexecutionmayIssue,tf necessary.
