I. INTRODUCTION
A. BACKGROUND:
The 2019–20 coronavirus pandemic is an ongoing pandemic of coronavirus disease 2019 (COVID-19) caused by severe acute
respiratory syndrome coronavirus 2 (SARS-CoV-2). The outbreak was identified in Wuhan, China, in December 2019. The World
Health Organization declared the outbreak a Public Health Emergency of International Concern on 30 January, and a pandemic
on 11 March. As of 27 April 2020, more than 3.04 million cases of COVID-19 have been reported in 185 countries and territories,
resulting in more than 211,000 deaths. More than 894,000 people have recovered.
The virus is primarily spread between people during close contact, often via small droplets produced by coughing, sneezing, or
talking. The droplets usually fall to the ground or onto surfaces rather than remaining in the air over long distances. People may
also become infected by touching a contaminated surface and then touching their face. In experimental settings, the virus may
survive on surfaces for up to 72 hours. It is most contagious during the first three days after the onset of symptoms, although
spread may be possible before symptoms appear and in later stages of the disease.
Further, the common symptoms include fever, cough, fatigue, shortness of breath, and loss of smell. Complications may
include pneumonia and acute respiratory distress syndrome. The time from exposure to onset of symptoms is typically around
five days, but may range from two to fourteen days. There is no known vaccine or specific antiviral treatment. Primary treatment
is symptomatic and supportive therapy.

Last March 16, 2020, the Philippine government has issued directives that Luzon-wide including the National Capital Region
(NCR) will be under the Enhanced Community Quarantine (ECQ) and Stringent Social Distancing Measures effective March 17,
2020 originally until April 15, 2020. These measures were implemented by the Philippine government primarily to prevent further
spread of the said virus.

Moreover, the Philippine government has also declared extensions effective April 16, 2020 up to April 30, 2020, and latest was
from May 1, 2020 up to May 15, 2020, due to increasing number of infected cases as well as deaths. It has also stated that
enhanced or general community quarantine measures throughout the country will be implemented until proven
coronavirus/COVID-19 antidote and/or vaccine has put into place.

“ADAPTATION TO THE NEW NORMAL DURING THE GENERAL COMMUNITY QUARANTINE”

In the incoming period, every person in the National Capital Region (NCR) and some other parts of the Philippines who are placed
under the Extended Enhanced Community Quarantine until May 15, 2020 shall be expecting liberation. Thus, Archipelago Builders
is in support with the government and across the world in fighting COVID-19.

The word “new normal” became the talk of the town and precautionary measures should be considered once the lockdown is
lifted.

Thus, Archipelago Builders is adapting to the New Normal with stipulated guidelines and procedures in preventing possible
transmission of the virus.

B. .OBJECTIVES: Once the established norms and protocols are properly communicated, implemented, and adhered by
all the concerned persons working inside the company and project premises, it aim:

 To reassure the Archipelago Builders’ employees, construction managements, developers and its subcontractors that
the Archipelago Builders’ Management is appropriately adjusting, monitoring and pro-actively responding to the latest
occupational health hazard – COVID-19 pandemic situation;
 To safeguard the safety, health and well-being of all the concerned so as to maintain the company’s harmonious and
standard operational flow.

C. REFERENCES, EFFECTIVITY AND SCOPE: The established safety and health guidelines and norms:

 Are aligned and developed according to the occupational health & safety and labor standards/advisories as listed
below, but not limited to the following:

 Applicability of these guidelines were consolidated through the collective efforts, based on related best practices, and
factual inputs of the Archipelago Builders’ Management Committee;
 These implementations shall take effect immediately before and upon the work and operations resumption of Archipelago
Builders’ through the usual means of communication (includes e-communication, social media, etc.). Should there be
any questions on the contents, the concerned may direct them to his/her immediate superior so that they may properly
be addressed;
 It shall be applicable and adhered by all concerned persons before entering and while inside the company and project
premises. Concerned persons shall not be limited to all Archipelago Builders’ employees (regardless of rank or
category), consultants/retainers, construction management, project owners, subcontractors and all company
guests/visitors.

D. .MATRIX OF RESPOSIBILITY: It shall be the responsibility of:

1. ALL employees (regardless of rank or category), consultants/retainers, construction management, project


owners, subcontractors and all company guests/visitors: to be aware and work in accordance with said safety and
health guidelines;
2. Health and Safety Committee: This group is consist of the Project/Occupational Nurses, Occupational Physicians,
Safety Unit, Company and Outsourced Guards and HCES staff. They are considered as the main persons or the
“workplace frontliners’ in-charge the communication, implementation, continuous education and recommendations of
necessary revision from time to time;
3. Managers and Heads: as the supporting person in-charge of the communication, implementation, continuous education
and recommendation of necessary revisions from time to time. Managers and heads also make sure that the provisions
are being properly implemented and complied in their respective unit/department/project;
4. Logistics Committee: Leaded by the Property, Accounting and Motorpool Departments as the three main departments
who are in charge of (purchase, budget allocation, delivery, etc.) the needed logistics and ensure
timely/sustainable/continuous availability of the material needed in these implementations.
5. Management: As over-all in-charge in monitoring the effectiveness of the implementations. It also holds the prerogative
to suspend, supersede, mitigate and aggravate related decisions to protect its business operations.

E. DEFINITION OF TERMS:

TERMS DEFINITION

Flexible Working Arrangements An arrangement is one that doesn't have the normal constraints of a traditional job. For example,
employers who offer flexible work arrangements may allow employees to come
into work earlier than normal and leave earlier than normal, or an employee may work longer
days three days per week rather than five.
Work-From-Home is a work arrangement in which employees do not commute or travel (e.g. by bus or car, etc.) to
a central place of work, such as an office building, warehouse, or store.

II. SAFETY GUIDELINES

1. Prior to start of work


A. Clean and disinfect the Worksite, Staging, Temporary Facilities, Materials, and Equipment
 Materials: (e.g. rebar, tie wire rolls, containers et.al.)
 Equipment: (e.g. tower crane, mobile crane, fork lift, skid loader, construction lift, cradle/gondola and other
equipment;
 Temporary facilities: (e.g. site offices, pantry, conference rooms, comfort rooms, barracks, storage rooms, and
others);
 Worksites: (construction lift/elevators, hallways, work areas and walkways)
 Provide Equipment and materials for disinfection work in each project.
a. Sprayer machine
b. Personal Protective Equipment (Rubber clothing, Rubber boots, safety hand gloves (latex and cloth type),
Mask, Eye Protection) bleach

B. Screen all Employees


 All employees must complete the Health Assessment Form to be validated by the site nurse;
 All workers must undergo covid-19 testing once testing kit is available;

C. Personal Protective Equipment (Rule 1080 of OSHS as amended, 1989, D.O. No. 13 Section 6)
 Provisions of uniforms, head protection, foot protection, eye protection, mask, hand protection, and safety vest to
all workers;
 All workers must have a minimum of 3 washable mask and AB uniforms;
 Perform daily inventory on the availability of PPE’s at the warehouse to ensure that the supply is adequate and
enough to supply the needs of the workers;

D. Training and Education


 Mass reorientation of all workers about the procedures and guidelines;
 Train all workers how to properly put on, use/wear, and take off protective clothing like disposable/washable
mask, how and when to clean tools and equipment;
 Provisions of information to all workers on how to wash hands properly;

E. Isolation Room
 All project site should have a 20 footer convan isolation room with AC Unit and Comfort Room;

2. Implementation

A. JOBSITE

1. Entry and Exit Guidelines


Frontliners: Site Nurse, First Aiders, Security Guards, Safety Officers
a. All Contractor Employees, Suppliers and Guest
 Assigned front liners at the entrance gate of the jobsite;
 All employees, suppliers and guest coming to jobsite are advised to formed a queue and maintained a 1.5-2
meters physical distancing;
 All employees, suppliers and Guest coming to jobsites should wear their masks at all times, and remove only
when eating/drinking;
 Non-essential guest and visitors are strictly prohibited inside the jobsite;
 Monitor all persons’ temperature daily upon entry and exit of the jobsite and record them. Anyone with a
temperature of =>37.6 is not permitted to enter but instead advised to proceed to the site clinic immediately
for validation/confirmation;
 Upon entering the jobsite, all employees should disinfect their shoes and spray alcohol on their both hands;
 Provision of wet cloth with bleach solution (bleach mix with water) as foot sanitizer and alcohol at the entry
and exit point of the jobsite;
 Strictly observed a 1.5 - 2 meters physical distancing upon entering and exiting the jobsite;

 Install polyethylene/clear plastic sheet barrier to separate the front liners taking the temperature of workers
entering and exiting the jobsite;
 Limit the access to only one for entrance and exit of the workers provided that there is another access ready
for emergency use only;
 Strictly implement the “No Mask, No Entry” policy;
 All employees entering and exiting the workplace should be recorded for easier contact tracing in the event of
an outbreak;
 Control the employees going out of the jobsite during break time/working hours;
 Stay-out workers are advised to stay at the barracks and to follow the routine of barracks to worksite and vice
versa only once they enters the worksite;
 Non-essential employees/visitors are strictly prohibited inside the jobsite;
 All employees are advised to follow work routine from barracks/staff house to worksite and vise versa only;

b. Equipment/Vehicles entering the jobsite


 All Equipment/vehicles entering the jobsite must go through a disinfection using spray machine or
wash bay with bleach solution;
 Check also the temperature of all drivers and helpers before entering the jobsite. Anyone who has a
temperature of =>37.6 is not permitted to enter the jobsite;

2. Personal Protective Equipment


Workers (AB Admin and Subcon)
 Long sleeves (blue for AB Admin and orange for Subcon), long pants, safety shoes, hard hat,
disposable/washable mask, safety hand gloves, safety)

Technical and Office Staffs (Admin and Subcon)


 For AB Staff – AB uniforms (Monday – Friday), safety shoes, hard hat, safety vest, cloth gloves and
Mask;
 For Subcon – their issued uniforms, hard hat, safety shoes, mask, safety hand gloves and safety vest;
Front Liners (Site nurse, Security guards, First aiders and Safety officer/safety marshall)
 Mask, Face shield, cover-all protective suit and latex hand gloves

3. Workforce
 Implement 50% workforce on-site, 50% work from home for staff;
 Implement workforce skeletal for workers;

4. Site Operations
 Reduce the workforce in one work area to prevent congestion;
 All work areas and frequently handled objects such as door knobs and handles shall be cleaned and
disinfected regularly;
 All employees must wear their cloth mask in the workplace at all times, and remove only when eating/drinking;
 All workers should maintain a 1.5 – 2 meters physical distancing in the workplace at all times;
 Perform housekeeping that includes materials storage/segregation before and after work;
 Avoid physical contact and group conversation while working/resting;
 Lending and sharing of belongings is strictly prohibited; e.g. PPE, phones, etc;

5. Deliveries of materials guidelines


 All deliveries shall be planned ahead and monitored before delivery;
 Disinfect all delivery trucks/vehicles/motorcycles entering the project site using spray machine or wash bay
with bleach solution;
 The security guard on duty should monitor the temperature of all the drivers and helpers coming to jobsite and
record them. Anyone who has a temperature of =>37.6 degrees is not allowed to enter the project site;
 Disinfect all delivery truck/service vehicle/motorcycle coming inside the project site using spray machine or
wash bay upon entering the project site;
 Delivery areas must be identified and only selected personnel(e.g. warehouse crews) is allowed to do the
unloading task;

 Disinfect all materials before use;

6. Welfare and Facilities;


 Provisions of lavatory with bar soap and alcohol at the entry and exit point of the jobsite;
 Provisions of a mess hall/rest area with washing station with sufficient water and bar soap ;
 All employees should clean-up their dining table after eating;
 Group conversation and physical contact is strictly prohibited at the jobsite;

7. Monitoring;
 All line managers and safety officers are to continuously monitor and educate workers the prevention of covid-
19 while conducting their daily work routine;
 Everyone in the workplace are to abide on this guidelines for their own safety and protection;

B. BARRACKS

1. Entry and Exit


Front liners: Security guard, first aider and Safety Marshall
 Assign Front Liners at the entrance gate of the barracks;
 Provide a wet cloth with bleach solution (bleach mix with water) as foot sanitizer and alcohol at the entry and
exit point of the barracks;
 All stay-in workforce entering the barracks must wear their cloth mask and maintained 1.5-2 meters physical
distancing at all times;
 Enforced the “No Mask, No Entry” policy;
 Monitor the workers temperature daily upon entry and exit. Any worker entering the barracks with a
temperature of =>37.6 is advised to proceed to site clinic for validation/confirmation;
 All workers should sanitize their shoes and spray alcohol on both hands upon entering the barracks premises;
 Strictly observed a 1.5 - 2 meters physical distancing upon entering and exiting the barracks premises;
 Strictly no visitors allowed inside the barracks premises;
 Provide polyethylene/clear plastic sheet barrier to separate the front liners taking the temperature of workers
entering the barracks premises;
 Limit the access to only one for entrance and exit of the workers;
 Strictly implement the “No Mask, No Entry” policy;
 All employees entering and exiting the workplace should be recorded for easier contact tracing in the event of
an outbreak;
 Leave your used clothing and safety shoes outside of the convan;

2. Convan
 Decrease the number of workers in one convan or provide clear plastic barrier;
 Maintain good housekeeping inside and outside of all convan;
 Used clothes are strictly prohibited inside the convan;
 Strictly no visitors allowed inside the barracks premises and convan;
 Provide new convan for the newcomers;

3. Going out of the barracks premises for work purpose (for stay-in workers)
 All workers must formed a queue while going out of the barracks premises for ppe inspection, checking of
temperature and maintain 1.5-2 meters physical distancing;
 All workers going out the barracks premises for work must wear their uniforms, hard hat, safety shoes and
mask;
 Monitor all workers’ temperature upon exiting the barracks premises for work. Anyone with a temperature of
=>37.6 is advised to proceed in site clinic for validation/confirmation;

4. Welfare and Facilities (D.O No. 13, Section 8)


 Provision of additional washing area and toilets with sufficient water and soap;
 Maintain good housekeeping at personal hygiene at all times;
 Maintained 1.5-2 meters physical distancing at all times;

5. Curfew Hour: 10pm


 All stay-in workers must follow the 10pm curfew hour;
 Workers entering the barracks premises on or before 10pm is not permitted except workers with valid reasons
(e.g. overtime work, coming from vacation with nurse consent or approval);

6. Waste Disposal
 Dispose all waste regularly;
 Strictly observed waste segregation before disposal;
 Maintain cleanliness and good personal hygiene;

C. AB OFFICE

1. Entry and Exit


Frontliners: Security guards, office nurse, first aiders
 Assign Frontliners in the entrance gate;
 All persons entering the office must wear their face mask, AB uniform, company I.D. and maintained 1.5-2
meters physical distancing at all times;
 Monitor all persons’ temperature entering the entrance gate and record them. Anyone with a temperature of

D. PREVENTIVE MEASURE AND REMINDERS:

1. No Mask, No Screening, No Entry” – wearing of mask will decrease the probability of contagion of virus or viruses from
ourselves, others and the environment.

2. Maintain Social Distancing – of not less than 1.5 meters / 5 feet distance from each other. Avoid mass gathering such
as personal meetings or conferences, celebration of birthdays and other special occasions.
Speaking / Laughing – small particles of saliva drops up to 1-1.5 meter
Sneezing / Coughing – saliva drops up to 1.5-2 meters or 6 ft.

3. Hand Washing – it prevents the large scale of contamination. Apply the 20 seconds of hand washing through using
water and soap. In hand washing also observe the cutting of long nails.
• Install lavatory beside the main door access of offices and barracks. Make a habit of often hand washing as we enter the
office or barracks.
a. “Wash hands before and after eating” – practice so that bacteria will not enter to our gastro-intestinal system (mouth-
esophagus-stomach)

• Before you eat your lunch or merienda just pull down your mask unto your neck through inserting your index finger on
your face mask. After eating do hand washing then reinsert your index finger inside of your face mask upper part ten pull up and
fix it properly without compromising to touch the front area of your face mask that is considered as unsterile or contaminated part.
b. “Wash hands after using Comfort Room” – strictly observe practicing hand washing after using CR.
4. “Do not share your personal things/items”
a. Cloth – the virus may stay in your cloth about 24-48 hours or 1-2 days

a.1 Upon arriving at your home sanitize your safety shoes at your soiled door mat with disinfectant solution then remove it and
secure it outside in your house.
a.2 Prepare a soaking solution like chlorine with water or zero with water.
a.3 Do not remove yet your face mask and goggles while removing your uniforms/clothes. Do not “pampag” your clothes after
removing it then soak it to your soaking solution immediately. If you wish not to wash immediately better secure it to a cellophane
or container with cover.
a.4 Remove your face mask and goggles. Hold the string on the back considering as sterile. DO NOT TOUCH any part at the
front area of your face mask and goggles. After removing the face mask and goggles then soak it immediately about 20-30 minutes
then hang and dry then reuse it.
Reminder: If ever that you are accidentally splashing in your body while doing the laundry especially in your mouth, nose and
eyes then wash it immediately with soap.
a.5 Perform hand washing and taking a bath as possible before you mingle with your family member.
b. Cellphone / headsets – virus may live 4-7 days
c. Spoon/Fork /drinking cups –
d. Money – paper bills should keep at the envelop within 24-48 hours before we spend it. Additional paper bills should
separate it from the old. Coins must be soaked to a disinfect solution before we spend it.
5. “Do not spit anywhere” – virus may live on the surfaces about 4-7 days.
Install shoe rack and foot sanitation like door mat with disinfectant solution then practice “pagpupunas ng paa” with a soiled door
mat soaked with disinfectant solution. Disinfect the shoes and secure it into the shoe rack.
6. “Sanitize before and after using the telephone” – wipe the “C” telephone part with sanitation wipes or spray with
alcohol and wipe it with tissue paper or cotton balls before and after using it.
7. “Clean as you go” – make a habit of cleaning your working area especially the office table, office chair, laptop or
computer, office shelves and others.
8. “Disinfect barracks, offices twice a day” – disinfect the barracks and offices while workers and staff working at site in
the morning and afternoon so that after working at site the offices and barracks are well sanitized.
• Ventilation should be observed always inside the barracks and offices because it helps to eliminate pollutants and
viruses.

9. “Have check your body temperature regularly” – the project nurse is in charge in monitoring body temperature of all
staff and workers. Do it in the morning before they will start to work and in the afternoon after they log out.
10. “Be responsible if you are sick” – you need to take a rest if you are sick, but you need to inform your superior. You
are obliged to isolate/quarantine yourself for the welfare of your health and the welfare of others.
11. “Treat everyone as carrier” – consider everyone as carrier of COVID 19 so better wear mask, goggles, gloves and
perform social distancing than saying sorry at the end after contracting the corona virus.
12. “Increase physical and mental resilience”
a. Eat nutritious and well-cooked food;
b. Drink plenty of fluids and avoid alcoholic beverages;
c. Increase the body’s resistance by having adequate rest and at least eight (8) hours of sleep;
d. Exercise regularly.
13. “Mental Health Concerns” – Provide referral for workers needing counselling through direct referrals and coordination
with the National Mental Health Association.

IV. MANPOWER GUIDELINES


The following details shall clarify resumption of work requirements, arrangements and other related measures in line of the health
hazard brought by the COVID-19 pandemic. Incorporation of labor laws and company prerogatives were also applied to ensure
health and safety of the workers/employees.

A. MANPOWER NOTICE OF BACK-TO-WORK


HCES shall be in-charge of sending the back-to-work notice at least five (5) days before the resumption of work. Official notice
through SMS and other social media means (Messenger, Viber, etc.) will be sent to all staff and workers.

B. HEADCOUNT PROJECTION
Each department and project should maintain the advance daily headcount projection for the company to align operations
during the first two weeks according to manpower availability. Example:

1. As per community quarantine guidelines, employees under 21 years old and over 60 years old are allowed to go
back to work, provided that they are not part of high-risk population.
High Risk Population includes:
 Employees who are pregnant (are encouraged to take their maternity leave, coordinate with HC)
 Employees who care for or living with pregnant women
 Employees caring for or living with elderly and/or small children
 Employees who have comorbidities
 Employees with combinations of conditions listed above
2. Check your local area curfew if you are already allowed to go outside.
3. Check yourself if you are not feeling well.
4. Secure your things and your food and beverage for the day, wrap your bag in disposable plastic if you want. Bring
a disposable plastic for your shoes when you reach the office.
5. Prepare your own clean slippers or appropriate footwear that will only be used inside the office.
6. Prepare your personal face mask, alcohol/alcohol wipes, hand sanitizers/disinfectant and handkerchief or
disposable tissue.

D. LEAVING YOUR BARANGAY


1. Get necessary information from your Barangay if you can pass through their checkpoints and barricades, whether
you are just walking, riding a motorcycle or a vehicle.
2. Should the Barangay deny you passage even if you gave proper information, please comply immediately and
return home. Inform HC and your Supervisor that you were denied to leave.
3. Work from home at whatever capacity you can and stay connected.

E. CROSSING CITY BORDERS


1. Get necessary information from your City Government if you can pass through their checkpoints and barricades,
whether you are just walking, riding a motorcycle or a vehicle.
2. Should public transport be present, observe all precautions implemented. Fall in line, have patience and be at your
best behavior. If falling in line entails late arrival to Office, provide information to HR and your Supervisor.
3. Should the City Government deny you passage even if you gave proper information, please comply immediately
and return home? Inform HC and your Supervisor that you were denied to leave.
4. Work from Home at whatever capacity you can and stay connected.

F. ENTERING THE OFFICE


1. Upon reaching the Office, compose yourself and prepare to remove your shoes. Sanitize your hands also.
2. Get your temperature checked, if your temperature reads 37.5degC and above, at all three (3) times you were
tested, you will be endorsed to the company or project nurse for further evaluation.

3. For Head Office: an area in lobby reception will be prepared for shoe-changing. This is where you will remove your
shoes, and place them in the disposable plastic you brought along. Deposit your shoes in the shoe depository or
rack. NO ONE MUST ENTER WITH THEIR SHOES ON, even if you came in a vehicle. Use your clean
slippers/presentable footwear inside the office. A wet rag or foam soaked in a disinfectant chemical will be
provided per office entry. Project offices are also encouraged to follow the same procedure.
4. Check whether your seat in the office has been relocated in observance of the on meter-meter physical distancing
requirement.

G. UPON REACHING YOUR WORKSTATION


1. Clean your workstation and sanitize the keyboard, mouse and immediate surfaces you will come in contact with,
before you use them.
2. Disinfection requires a mixture of bleach – to be provided per department.
3. Repeat disinfection as necessary.

H. INSIDE THE OFFICE


1. Be considerate, it is not only you who is going through this crisis.
2. Wear face mask even inside the department/unit/project office.
3. Avoid face to face conversations whenever possible. If required, maintain physical distancing precautions
4. Use the local intercom/LAN Messaging communicating with co-workers.
5. Observe coughing/sneezing etiquette.
6. Sanitize the door knob and/or handle of any door you will touch before and after touching them.
7. Inside the comfort room, again, sanitize the flush handle, the bidet and faucet before and after touching them.
Wash your hands properly with soap and water each time you use the toilet.
8. Bring your own beverage. Water dispenser use is suspended as this is one source of transmission between
employees.
9. Use, clean and properly safe keep your own food utensils.
10. Observe physical distancing even when eating.
11. Be productive as much as you can in the hours you are in the office.

I. GOING IN AND OUT THE OFFICE


Should you need to go out of office for any reason, put on your shoes first and stow your slippers in the depository.
1. Prepare your face mask, alcohol/alcohol wipes, hand sanitizers/disinfectant and handkerchief or disposable tissue.
2. Your temperature will again be checked before entering. Should you fail the temperature check, your things will be
gathered and you will be asked to immediately and seek medical attention.

J. VISITORS AND OTHER TRANSACTIONS


In accepting visitors, the concerned staff shall advise the company guards ahead of time to consolidate to limit the
numbers that is required to come at the office. If it is not as important, we are encouraging every employee/s to use video
conference meeting and other digital methods to address their concerns with their respective clients.

Collection shall be on the usual schedule at and do the transactions at the Head Office lobby only.

K. HEALTH AND SAFETY GUIDELINES OVERVIEW AND AB’S NEW NORMAL IN GENERAL:
All employees should be made aware that once they report for work, they should strictly follow clearance procedures as
implemented by the Health and Safety units. Orientation attendance should be well documented as basis that all concerned
were properly informed by the new sets of guidelines as well as acknowledgement to compliance.

Workers and staff will be required to follow arrangements such as: “work and staff house routine only” or “work and
barracks routine only” until further notice.

Screening days will start two (2) days before the resumption of work. Screening days or period of the Health and Safety
units are considered as unpaid hours for the workers and employees. Workers who stayed in the barracks are initial
workers to be screened accordingly. Staff are not allowed to time in without clearance from the frontliners. Allot time for
your screening process.

L. FLEXIBLE WORKING ARRANGEMENTS:


All staff who are authorized by their immediate and next level heads to “work-from-home” shall be required to submit daily
accomplishments as basis of their required output. Immediate heads should strictly analyze authorization before allowing the
staff in this kind of arrangement.

All project staff are not authorized to implement “work from home” arrangements, due to the nature of their work.

Flexible working arrangements to all employees will be imposed specifically following “longer working hours, lesser working
days” work schedule, completing the 48-hour work per week within the five-day work per week. This measure will time decrease
employee’s public access or contacts like transportations, common places, etc.

M. COMPANY SHUTTLE SERVICE AND ACCOMODATION


Company shuttle service and accommodation will be provided to all employees. Those who will be availing of the said services/
arrangement should directly notify the concerned department, Property Department for the accommodation and Motorpool
Department for the shuttle service. The advance notification of availment will be the basis for proper preparation and pooling (in
consideration also of the physical distancing measures) before the resumption of work. Guidelines will also be communicated by
the said departments.

N. WORKER’S RIGHT TO REFUSE TO WORK UNDER UNSAFE CIRCUMSTANCES


"The worker has the right of refusal to work without threat or reprisal from the employer if an imminent danger situation exists in
the workplace that may result in illness, injury, or death, and corrective actions to eliminate the danger have not been
undertaken by the employer." This also includes new sets of guidelines which are still considered in a trial state or period
especially upon resumption of work.

Employees cannot be forced to report for work during the month-long implementation of the “enhanced” community quarantine
in Luzon due to the coronavirus disease 2019 (Covid-19), Labor Secretary Silvestre Bello III said. “They do not have to report if
they don’t want to report. Or since they are under enhanced community quarantine, then they can really not report and they will
be excused. There will be no basis for them to be disciplined,” Bello said in a Palace press briefing late March 17, 2020.

After the enhanced and general community quarantine, employees and workers who refused to resume to work highlighting
their safety and other authorized reasons will not be given sanction but will be taken account against the “extra factor” on their
performance. Formal notice should be sent to the official email of the project site/department, HCES and immediate head’s
email. Absence on the said cause may be charged to the available credits. Exhaustion of leave credits will be considered as
authorized leave without pay. Since the absence of the concerned employee will greatly affect the department/project’s output, it
will be the responsibility of the immediate head to identify movements in his/her unit if the concerned employee will be replaced
temporarily or permanently. More than fourteen (14) days of leave under this category will mean reset of contract and
employment period, and “rehire” status will be subject for availability of position.

However, once declaration of normal working conditions are declared by the DOH and DOLE, all staff are expected to comply
with the usual company policies and procedures.

O. Retrenchment of Workers Due to Economic Effect of the Pandemic


Careful assessment on the retrenchment of workers/staff due to redundancy of position, lack of materials and other operational
equipment should be properly advised to the HCES Officer and Head. “Notice of Termination” following the 30-days rule shall be
given to concerned workers. Performance related and other violations of our company policy shall follow the usual twin notice
rule or due process.

 The right of management to dismiss workers on the ground of retrenchment to prevent serious losses is governed by Article 283 of the
Labor Code. This is one of the authorized causes of termination of employment. However, before one can dismiss employees on
the ground of retrenchment, four elements must be proven. Firstly, the losses expected should be substantial. Secondly, the
substantial loss apprehended must be reasonably imminent, and such imminence can be perceived objectively and in good
faith by the employer. Thirdly, because of the consequential nature of retrenchment, it must be reasonably and necessary and
likely to effectively prevent the expected losses. The employer should have taken other measures prior or parallel to
retrenchment to forestall losses such as cutting other costs other than labor cost. Lastly, the alleged losses if already realized,
and the expected imminent losses sought to be forestalled, must be proven by sufficient and convincing evidences. It bears
emphasis that serious business losses should be proven by financial statements duly audited by an independent external
auditor.
 If the grounds for retrenchment are not proved, the retrenchment will be declared illegal and of no effect. If the retrenched employee
signed quitclaims, they may be declared invalid. Even his acceptance of the retrenchment pay does not amount to estoppel which does
not bar him from contesting his separation.
 There must be fair and reasonable criteria to be used in selecting employees to be dismissed on account of retrenchment such as (a)
less preferred status (i.e. temporary employees); (b) efficiency rating; and (c) seniority. The “last in first out“(LIFO) rule indicates that as
between two or more employees affected by a retrenchment program, the last one employed will be the first to go; seniority of the ones
hired earlier therefore prevails. Such rule has its merits but its observance is not a statutory duty of the employer.
 In accordance with the Labor Code, for a valid implementation of a retrenchment program, the employer must serve written notices on
the employees and DOLE at least thirty (30) days prior to the intended date of retrenchment. Specifically, the purpose of such previous
notice to DOLE must be to enable it to ascertain the verity of the cause for termination of employment. Finally, the more important
aspect in the termination of employment is the payment of the employee’s separation pay equivalent to at least one (1) month pay or at
least one-half (1/2) month pay for every year of service, whichever is higher. A fraction of at least six (6) months shall be considered as
one (1) whole year.
 Thus, the employer must not arbitrarily or speedily implement a retrenchment program. The requirements discussed above must be
fully complied with so as to preclude any problems in the future. It bears great emphasis that failure to comply with the requirements
mandated by the Labor Code will render the retrenchment invalid and illegal.
