GUIDELINES

ASSIGNMENT SUBMISSION:

 You are required to register for examinations / assignments within the above given
period. Assignments will not be accepted if you have not registered for the
exam/assignment.
 Assignments should be submitted to SLIM within the Assignment Submission Periods
indicated above.
 Assignments will not be accepted after the late submission period under any
circumstances.
 SLIM will issue an acknowledgement slip upon the submission of your assignment and
it must be retained by the student as proof of submitting the assignment.

ASSIGNMENT COVER PAGE:


 Attached cover page format should be used, printed in the relevant colour (Stage 1-
Blue/Stage 2-Green/ Stage 3-Pink).

THE ASSIGNMENT MARKING SHEET should be attached after the cover page followed by the
Assignment checklist & declaration form.

A SOFT COPY of your assignment should be sent to the above mentioned email address for
which you will receive an automated reply of receipt of the assignment. If you have
not received the automated reply, please verify with course coordinator. The soft copy
is only a reference document that will not be considered as an assignment submission.

IMPORTANT NOTES

 If you have not submitted the assignment" your results for the respective subject will
appear as “Fail” in the final grading.

 In case of absence at the examination, the student has to re-do the assignment in order
to pass the subject in the next examination.

 If you are a student of an Accredited Study Centre, you can submit the assignment to
the accredited study centre and presentation date and time will be notified to the
centre once all assignments are received by SLIM Home and SLIM web site.
 Present university students are allowed to submit the assignment without attending
lectures since they register as self-study students. However, they have to attend
individual presentation sessions.

Bio Pharmaceuticals
BACKGROUND

Bio Pharmaceuticals (Pvt) Ltd. is a pharmaceutical company in Sri Lanka which is very popular
among general physicians, specialists, surgeons and patients as it covers most of the branded
pharmaceutical products. All their pharmaceutical products are up to expected quality standards
and have achieved many awards including SLIM Brand Excellence, for their commendable service
towards the nation.

As emerging trends, they have recently introduced a new mechanism in order to market their
pharmaceutical products. Customers can now pick drugs off the shelves in their pharmacies and
pay for them at the counter. Consequently, very serious/ hazardous/ dangerous antibiotics and/
or other drugs could also be issued to patients/ individuals, through the new mechanism of
‘customers could pick drugs off the shelves’.

The research team of Bio Pharmaceuticals has decided to launch their research articles as a series
of articles in magazines. In addition to that, they have come up with new experiments to prevent
serious viruses such as HIV.

However Bio Pharmaceuticals’ experiments and the new mechanism of ‘customers could pick
drugs off the shelves’ have been criticized by many individuals as well as a large number of
companies within the pharmaceutical industry of Sri Lanka.

TASK ONE

‘Bio Pharmaceuticals’ had just inaugurated a new method for its consumers to buy
certain medicines/ medical products. Customers could now pick drugs off the shelves in their
pharmacy and then pay for them at the counter (the till).
Before then, the usual mechanism was all medicines were stored behind a counter meaning a
pharmacist would get what was requested. The Pharmaceutical Authority of Sri Lanka objected
and argued that under the Pharmaceutical Laws of Sri Lanka, this was an unlawful practice. In
terms of specific provisions of the aforesaid law/s, a pharmacist is needed to supervise at the
point where "the sale is effected".
The Pharmaceutical Authority of Sri Lanka argued that displaying goods were an "offer" and when
a consumer selected and put the drugs into their shopping basket, that an "acceptance" was
made at the point when the "sale is effected" as no pharmacist had supervised the transaction at
this point. Therefore ‘Bio Pharmaceuticals’ is in breach of the Pharmaceutical Laws of Sri Lanka.
a) Hiru put a very dangerous drug into her shopping basket, on her own. This drug can only
be issued under a prescription of a Medical Specialist
b) Amal who is an underage put two condoms to his shopping basket
Discuss the issues at hand in light of the laws of obligation.

Guideline Note 01

A higher degree of proficiency in the understanding of the concepts of law of contract and Sale
of Goods in invitation to treat, offer, acceptance, etc are expected. Students are required to
cite significant facts from case law in order to achieve higher marks. All issues should be
identified and answer should be evaluated with reasons and justifications.

TASK TWO

Bio Pharmaceuticals has recently decided to launch a Research magazine named ‘Tips for a
Healthy Life’. They are in need of obtaining protection under the Intellectual Property Act of
Sri Lanka. Suggest the best category or categories for their requirement in light of Intellectual
Property laws of Sri Lanka.

Guideline Note 02

Comprehensive understanding on the law of Intellectual Property is needed when attempting


this task. A clear, comprehensive and cogent elaboration for each area is mandatory.

Answer should be supported by correct and appropriate statutory provisions and other
examples if any. Students are required to discuss international standards on the respective
category or categories.

TASK THREE

Bio Pharmaceuticals needs to find out relevant/ applicable laws pertaining to the
pharmaceutical industry of Sri Lanka. As being their Market Investigation and Research Officer,
advise them with reference to consumer protection laws of Sri Lanka.

Guideline Note 03

Relevant statutes, case law, regulations, etc need to be discussed. Students are advised to discuss
salient features of the pharmaceutical industry of Sri Lanka in order to achieve a higher grade.
GENERAL NOTE

Answers should be supported by relevant statutory provisions, case law and practical examples
of Sri Lanka. Students are free to discuss the laws of other jurisdictions however, in such incidents
appropriate references are mandatory.

With reference to the given scenarios; self-evaluation, analysis and critical analysis is mandatory
in order to achieve a minimum Pass.
