PETITIONER STATEMENT

I Mr. Venkatesh, S/o Venkatesh reddy,

#714,1st floor , Venkateshwara nilaya,
15th main HSR Layout, Bangalore560034

The petitioner submits that My marriage with the respondent was solemnized on 14-05-2015 at
VR function hall, vinjamour, Nellore dist Andhra Pradesh

It is respectfully submitted that the petitioner, Under the circumstances it’s impossible for the petitioner
to lead a happy married life as a husband with the respondent and there is no possibility of
reconciliation and re union. The act of the respondent clearly amounts to mental cruelty to the
petitioner.

In the first week of July 2015, Respondent /wife moved to her parent’s house due to Aashada,

Wherein the elder sister of the respondent and her brother In –law were residing in the same house
along with the parents of the respondent.

After completion of Aashada the petitioner ( I) called my wife to return back to the matrimonial house,
the respondent postponed the same for one or the other reasons and finally the responded stated that
if the petitioner sets up a separate house leaving his parents she will come back with the petitioner.

Though the petiotner has requested the responded to come to the matrimonial house, the responded
has not porpertly responded for the same and continues residing in her parents house showing her
adamant nature. In the mean time while the petitioner requested the respondent to come with him to
mysore has he will set up a house in mysore. The responded agreed for the same and moved with the
petitioner and stayed there.

During the stay at mysore the responded conceived and moved to her parents house at Bangalore for
delivery.

There after the respondent gave birth to a male child on 9-3-2017 now named as Hardhik Reddy,
though the petitioner was in mysore he was looking after the well being of the respondent and the child.

After the completion of 5 months of the baby, the responded moved to mysore but at the instigation of
her mother and elder sister the respondent started to behave rudely, and pressurized.
 The petitioner hoping changes from his wife yielded to her words and moved to Bangalore. After
coming back to Bangalore again the mother and elder sister of the respondent used to talk with her
frequently through phone and started missguiding her on various issues. The respondent was also
dancing to the tunes of her mother and sister and started picking up quarrels in the house unnecessarily
and always insisting to make separate house by leaving the parents of the petitioner or to live in her
parents house. Inspite the attitude of the respondent, the petitioner had tolerated the same with view
to lead a happy martial life and tried to convince her throughout his marital life

The respondent has continued her adamant and arrogant attitude, on so many occasions she left the
matrimonial house with the child for unnessary reasons with the view to create big scene and on many
occasions she threatened the petitioner that she will commit suicide if the petitioner does not yield to
her words but the petitioner with the fond hope of changes in the respondent, at the intervention of
the other elders of the family as well as relatives managed to get back the respondent and the child to
the matrimonial house.

Since the day of marriage the responded showed scant respect towards the petitioner and his parents.
From the beginning the respondent is feeling the superiourity complex and not bothered to take care of
petitioner as a dutiful wife.

The respondent was also in the habit of going to her parents house frequently without prior information
to the petitioner. Though initially the petitioner tried to make the respondent understand she started
creating impossible situations at home, the petitioner being a respectable person in the locality had
tolerated all the acts of the respondent with a view to lead a happy martial life. Hoping that she will
change her attitude in future. The respondent started behaving in a manner that was being extremely
difficult to the petitioner and his entire endevour to make her understand failed. Infact it was becoming
impossible for the petitioner to carry on with his day to day affairs.

It is respectfully submitted that in the last 3 and half years of marriage the responded has lived mostly in
her parental home. She would live the house for any and every reason.

Many a times she would demand the petitioner to take her to the parental home. In all the years of
marriage, almost every forth night the respondent has been in her parental home. Every visit of her to
the matrimonial home was a short lived affair. Even on those days she would make the life impossible.

It is respectfully submitted that the petitioner is the only son to his parents, and as a son the petitioner
has the duty to take care of his aged parents. From the day of the marriage the responded has being
abusing and treating the parents of the petitioner with such indignities and they have been tolerating
the same as the petitioner is the only hope in their life.
The respondent had been abusing them in such a manner that the parents of the petitioner had told him
that they would move to another house to please the respondent. Given the kind of health as well as
age of his parents the petitioner has requested the respondent not to treat his parents in such a manner
and permit them to leave with them.

When things stood thus, on 05-07-2018 the responded created a big scene in the house and picked up a
quarrel with the petitioner unnecessarily stating that the petitioner should give all his earnings to the
hands of the parents of the respondent and she also transferred the hard earned money of the
petitioner to the parents of the respondent. apart from that, the respondent called her mother and
sister to the house and all of them picked up a big quarrel with the petitioner , that if he does not
yielded to their words they would lodge false complaint with the police against the petitioner and his
family members

Along with respondent and the child the respondents mother moved to their house. having no other
alternative the petitioner also moved to the house of his parents.

Since july 2018 the respondent is living at the residence of her parents not allowing the petitioner to see
the child.

Under the circumstances its impossible for the petitioner to lead a happy married life as a husband with
the respondent and there is no possibility of reconciliation and re union. The acts of the respondent
clearly amounts to mental cruality to the petitioner.

Hence the petitioner is presenting this petition to bring quietey to the relationship that has miserably
failed due to the acts of cruelty committed by the respondent on the petitioner.

Therefore the petitioner prays that this honorable court be pleased to pass the judgement and decree in
favour of the petitioner granting the decree of divorce dissolving the marriage of petitioner with the
respondent solemnized on 14-05-2015 at VR function hall, vinjamour, Nellore dist Andra Pradesh and
allow this petition and pass such other reliefs as this honorable court deems fit to pass in the
circumstances of the case to meet the ends of justice.
