(Hereinafter called "the survey") are firmly held and bound unto the Municipal Council of
Mavoko (Thereinafter called" the Council" in the sum of shillings__________SHS
For the payment of which sum to the Council the tender and the guarantor bind
themselves jointly and severally by this bond.

3. WHEREAS by these presents and in consideration of the sum of ______________________

Above mentioned the tenderer binds unto the Municipal Council of Mavoko that
he/she/it shall not withdraw the tender/quotation until the expiry date and in breach of
this clause the amount of bond shall be fortified to the Council (only cash/bank cheques
acceptable).

4. The Council may not accept any tender/quotation which, having regard to all the
circumstances, appears to it to be the most advantageous, and shall take performance
bond equal to 5% or 10% of the contract price for the due and faithful performance of
every contract within fourteen (14) days of receipt of the Town Clerk's letter of
acceptance of the tender/quotation, falling which an amount equal to 5% or 10% of the
contract price shall be withheld by the Town Treasurer, or may decline to accept any
tender or quotation.

5. A tender or quotation may be disqualified for failure to comply with the following
formalities:-
a. Failure to sign the tender or quotation bond in this form
b. Failure to sign of Tender
c. Failure to attach Certified V.A.T. Registration Certificate Photo start copy.
d. Alteration, addition or amendments to the standard form of tender or quotation
documents. (Tender documents must be returned intact).
e. Inclusion of a price fluctuation clause or unfavorable terms and conditions against the
Council given by the Contractor and on separate letter.
f. Failure to comply with specifications or sample.
g. Failure to quote Kenya Legal Tender.
h. Disclosure of the identity of tenderer on the envelopes of the Tender/quotation.
i. Unless fortified or applied as part of the Performance bond, the amount of the bid
bond shall be refunded to the tenderer without interest at the expiry of the tender or
quotation.
