COUNTERCLAIMS Counterclaim Plaintiff Amber Laura Heard (“Ms, Heard”), by counsel, hereby asserts the following ageinst Counteiclaim Defendant John C. Depp II (“Depp’ Nature of Action 1. Before he was even married to Ms. Heard, Mr. Depp threatened to kill her and otherwise harm her in private messages to fiends, These threats were realized in the form of the rampant physical violence and abuse Ms. Heard suffered at Mr. Depp’s hands before and during their marriage. Once Ms, Heard escaped her marriage — only after obtaining a domestic violence Restraining Order from a California Court — Mr. Depp was not satisfied simply to allow Ms. Heard. to move on with her life. Instead, he continued to victimize her by repeatedly telling friends in profanity-laced messages that he would destroy her, would never stop, and wanted her replaced on an upcoming film. This frivolous lawsuit Mr. Depp has filed against Ms. Heard continues that abuse and harassment. Not content to let a jury decide this lawsuit, Mr. Depp and/or his agents acting on his behalf have orchestrated a false and defamatory smear campaign against Ms. Heard that has included false and defamatory statements to reporters repeatedly accusing Ms. Heard of being a liar and a hoax artist and accusing Ms. Heard of the crime of perjury. This stream of falseand defamatory accusations against Ms. Heard is all in an attempt to ruin her life and career, simply because she was a victim of domestic abuse and violence at the hands of Mr. Depp, and had the audacity and temerity to finally come forward to end the abuse and violence. Ms. Heard has been the victim throughout this relationship and during these ensuing attacks by Mr. Depp. Through this Counterclaim, Ms, Heard is finally, after all these years, fighting back. Ms. Heard asks this Court to hold Mr. Depp fully and finally accountable for his conduct and to end Mr. Depp's abuse, lodged from a position of wealth and power. Parties 2. Ms. Heard is a natural person who is domiciled in California. 3. Mr. Depp is a natural person who is domiciled in California. Jurisdiction and Venue 4, This Court has previously determined that it has specific personal jurisdiction over the dispute between Heard and Depp, and Ms, Heard’s Counterclaims herein arise out of the and relate to the same transactions or occurrences upon which the Depp’s claim is based. See, eg, Va. Sup. Ct. R. 3:9; Va. Code Ann. § 8.01-277.1; see Va. Code Ann. § 8.01-233. Eacts, 5. OnMay 27, 2016, Ms. Heard walked into California state court with bruises on her face to seek the protection of a domestic violence restraining order (“DVRO”) against Depp. Compl. 2. Ms. Heard submitted photos and affidavits reflecting Depp’s acts of domestic violence against her, and the court granted Ms, Heard a temporary restraining order on the strength of that showing. 6. Since that time, Mr. Depp has unlawfully targeted Ms. Heard in an ongoing harassment and online smear campaign in order to damages her both reputationally and financially.In particular but without limitation, Mr. Depp has initiated, coordinated, overseen and/or supported and amplified two change.org petitions: one to remove Ms. Heard as an actress in the Aquaman movie franchise, and one to remove her as a spokeswoman for L’Oréal. 7. Asearly as 2016, Mr. Depp admitted his intention to destroy her carcer, stating, for example, that he “want{ed] her replaced on that WB [Warmer Brothers] film,” referencing the blockbuster hit Aquaman, 8. Toaccomplish this task, he, individually and through his representatives and agents in Virginia, has created, coordinated, controlled, and/or manipulated social media accounts created specifically for the purpose of targeting Ms. Heard, computer-controlled social media accounts, and/or groups of inauthentic accounts controlled by a single agent to amplify content misleadingly. ‘These accounts exhibit behavior which includes but is not limited to the following: they have high ‘tweet-to-retweet ratios in numbers implausible for authentic human users; they are created, attack Ms. Heard, then are set to inactive to avoid suspension; they utilize common language, patterns, and timing indicating broad coordination; they often offer little or no personal information, suggesting computer-control or a single individual controlling more than one account at a time (and often many more); and they republicize the content of one another at rates and consistencies that bely authentic human control. 9. These accounts are designed to damage Ms. Heard and her livelihood without being directly traceable to Mr. Depp. For example, it appears that a significant number of the accounts signing the petition to remove Ms. Heard from the Aquaman franchise are conspicuously fake or highly suspicious. The use of fake signatures on these petitions is well outside the skill set of the average internet troll or disgruntled fan. ‘They reflect a concerted effort to damage Ms. Heard. Inaddition, the change.org petitions were modified to make it appear that far more people signed the petitions than actually did. 10, As part of his ongoing smear campaign, Mr. Depp and/or his agents acting on his, behalf have directed both authentic and inauthentic social media accounts, and/or non-human controlled “bots,” to target Ms. Heard’s Twitter account and attempt to interfere with her contracts and/or business expectancies. In particular, many of these accounts both smear and harass Ms. Heard while simultaneously promoting and praising Mr. Depp’s agent and attomey, Adam Waldman, The talking points in these accounts are strikingly similar but use slightly different text and content to evade Twitter’s anti-spam and platform manipulation guideline, which bars harassing, abusive, and intimidating behavior except “when viewed in the context of a larger conversation.” A herd mentality helps mask predatory behavior. 11. There are a number of newly created foreign language accounts specifically or predominantly designed to damage Ms. Heard, Many of these accounts have Cyrillic signatures, reflecting Russian origin. Mr. Waldman, Mr. Depp’s agent and attomey, is publicly associated with Russian individuals with the capability to organize such attacks. 12. Two accounts, JFOD_NET and MY GRINDELWALD, are responsible for approximately 50% of the targeted attacks on Ms, Heard, The MYGRINDELWALD account uses its platform to amplify anti-Heard bashtags and false information being disseminated about Ms. Heard, It has also amplified the change.org petitions described above, repeating calls for Ms. Heard to lose contracts or business expectancies. And, as evidence of its origin, it routinely tweets the statements of Mr. Depp’s agent and attomey, Mr. Waldman, on a near-daily basis and often praises the otherwise unknown attorney, even going so far as to say “i love you waldman!13, Intotal, there are at Jeast dozens if not hundreds of inauthentic accounts that impugn Ms. Heard while praising Mr. Waldman. This messaging further evidences the origin of Mr. Depp’s unlawful campaign and demonstrates that these inauthentic accounts are actively coordinating content to manipulate the Twitter platform and avoid detection, 14, As examples, these inauthentic accounts include the following: ReemDepp, MyGrindelwald, mdemdarkwizard, pomtaS426, depp_soldier, PerspectiveDepp, depphead_, RayRayDepp, Depplyyours, ILoveGellert, Jackiedepp1963, IDeppS_girl. Investigation has revealed hundreds of others, 15, The above conduct via ‘Twitter appears to be conducted in concert with a reporter named Catherine Armecin on behalf of a publication called the International Business Times. Ms. Armecin, an apparent freelance writer in the Philippines, published 30 negative articles about Ms. Heard in February alone. Notably, Ms. Armecin has almost no other identifiable publishing history outside of the International Business Times (which has been criticized for operating as a “content farm”), aside from a few articles about penis enhancement and erectile dysfuunction.! Ms, Armecin’s anti-Heard articles are a deliberate part of a strategy to generate content, which inauthentic accounts (including many of the above) then amplify, which further evidence a coordinated smear campaign against Ms. Heard by and through Mr. Depp and/or his agents. 16. Mr, Depp, through his agents and attomeys in Virginia, including specifically ‘Waldman, have engaged in a campaign to harass and damages Ms. Heard through the use of computers and computer accessible vehicles. | Catherine Armecin, Quora, https://www.quora.com/profile/Catherine-Armecin/questions. 517, This campaign of haressment is consistent with comments Mr. Depp made to friends regarding his intentions to ruin Ms, Heard’s career, or worse. For example, in 2013, Mr. Depp texted his friend, actor Paul Bettany, the following: “Let’s bum Amber.” The same day, he texted Bettany again with plans to murder her: “Let’s drown her before we burn he Iwill fk her burnt corpse afterwards to make sure she is dead.” 18. Such vile comments from Mr. Depp continued, and laid the groundwork for the smear campaign he spearheads today, and reveal Mr. Depp’s true personality, filled with anger, hatred and violence. 19. In 2016, Mr. Depp texted his friend Christian Carino (Ms. Heard’s former agent and now Mr. Depp’s agent) the following about Ms. Heard: “She’s begging for total global humiliation . . . [] Ihave no mercy, no fear and not an ounce of emotion, or what I once thought was love for this gold digging, low level, dime a dozen, mushy, pointless dangling overused flappy fish market... T'm so fucking happy she wants to go to fight this out!!! She will hit the wall hard! And I cannot wait to have this waste of a cur guzzler out of my lifel!! I met a fucking sublime little Russian here... Which made me realize the time I blew on that 50 cent stripper wouldn't touch her with a goddam glove, I can only hope that karma kicks in and takes the gift of breath from her... Sorry, man... But, NOW, I will stop at nothing 20. This is only the tip of the iceberg reflecting Mr. Depp’s misogyny, deep inner anger and hatred of Ms. Heard, and his attendant “justification” in his mind, of his violence and abuse towards Ms. Hear. 21. Inother texts over the years, Mr. Depp repeated threats to harm Ms. Heard. He told his nurse in 2019 that Ms. Heard was “gonna go down... Hard.” He threatened that “i’m about totake the lot of them down, once and for all! He called Ms. Heard the most horrendous of names, including “cunt,” an “inhuman scum filled suckfish,” a “disgusting pig,” and “whore.” 22. Mr. Depp threatened in early 2019 that “i am taking the fucking gloves off!!! this shit ends SOON!!! there’s no way I’m gonna allow this cunt to continue her perverse hypocrisy any fucking longer!!! I’ve really had it! fa 23. In 2018, before Ms. Heard published her op-ed, Mr. Depp stated that “But, when the boom gets lowered on Scam-ber(which is VERY soon), the world will receive the proper image of who i am and what i have had to stay silent about for 3 fucking years!!!!!!!" He stated that “the only thing I feel for her now, at best, is pure disgust and hatred!!! She’s such a predictable, see through, disposable, sick fuckin’ whore!!! Truly a pig to me now!!! No better than any junkie hooker with bad intentions...” 24. Importantly, this lawsuit is the lynchpin in the scheme to destroy Ms. Heard’s career. As this Court well knows, a California court awarded Ms, Heard a Domestic Violence Restraining Order against Mr. Depp in 2016, Their contentious divorce generated extensive press coverage. 25, Indeed, itis part of Mr. Depp's narrative that Ms. Heard “lied” about being abused by Mr. Depp, and that Ms, Heard referenced his abuse implicitly in her 2018 op-ed to somchow gain notoriety (never mind that public opinion has never rewarded a woman for telling her story of surviving domestic abuse or violence), 26. Tokeep the same story from growing stale after four years of coverage «an eternity in the celebrity news eycle - requires more than the errant leak. By filing this case (and his companion case against the Sun Newspaper in the UK), Mr. Depp gives this four-year old drama new legs. Every filing, every hearing, every piece of evidence leaked by his team not properlyproduced in diseovery, is another opportunity to remain relevant as his star otherwise wanes. This is not a characterization; Mr. Depp’s team has freely admitted it on the record in this case. 27. Without this case, Mr. Depp’s attempts to keep this matter in the press would amount to nothing more than a four-year old stale story that has been rehashed ad-nauseum. He would be wholly unable to generate any interest from the public, and thus without recourse to pursue his bitter obsession with destroying Ms. Heard. Movie studios and brands do not tend to care about issues they have no reason to think the public cares about. But if Mr. Depp can generate the impression that viewers and consumers do care — by fomenting a fantasy of online outrage and hatred for Ms. Heard, and its relevance animated by press coverage and “news” around this case —his fixation ean continue to gain ground, 28. Mr. Depp’s out of court use of this lawsuit as the basis for the conduct alleged herein is manifest, Rather than simply allow this lawsuit to be fairly tried within the bounds of the law and proper ethical and professional court procedures, Mr. Depp has elected through his agents to attack Ms. Heard about this lawsuit, and about the judicial actions she took against him for his domestic violence and abuse, with vulgar and profane threats and language in an attempt to damage her career, This conduct also has the potential effect of polluting the jury pool who will decide the actual issues in dispute in this lawsuit. 29. Mr. Depp, through his agents and attorneys, has also attempted to intimidate and threaten witnesses to attempt to influence their testimony in a manner adverse to Ms. Heard, claiming that they will have to spend significant sums for attorneys if they do not cooperate and sign declarations prepared by Waldman, suggesting that without their cooperation people will be arrested and charged with crimes, and the like.30. Mr. Depp, through his agents and attomeys, has also prepared Declarations with the caption from this litigation, and released these to the press, suggesting that these were Declarations filed in this Court and used in these proceedings, in an attempt to manipulate the press and mislead the public. 31. Another step in Mr. Depp's plan to harass and intimidate Ms. Heard is evident in his recent joining of Instagram on or about April 17, 2020. Although a typical user, even a celebrity, typically builds up a follower base rather slowly, Mr. Depp reported that he had over 176,000 followers within 15 minutes and 3 million followers within 24 hours of joining Instagram. 32. Unsurprisingly, Mr. Depp’s first video message on Instagram addressed Ms. Heard and this lawsuit. Agein, while Mr. Depp's decision to join Instagram is not the basis for Ms. Heard’s counterclaim, itis further evidence that his unlawful conduct described herein is part of concerted effort to harm Ms. Heard, and his use of fake accounts to bolster his follower numbers is further evidence of the sophistication that Mr. Depp and his agents have employed to engage in the unlawful conduct described herein. 33, More than two years after Ms. Heard filed for a Protective Order, and a month before Ms. Heard’s Op-Ed, in November 2018, Depp invited a GQ journalist, Jonathan Heath, to interview him to provide “the truth Johnny Depp wants you to hear” because, according to Mr. Heath, Depp was “angry ~ angry about a lot of things — and he’s vengeful.” Depp’s interview with GQ was published in November 2018 and is attached hereto as Exhibit A and incorporated by reference. 34. In his GQ interview, Depp falsely alleged that he never injured Ms, Heard: “To harm someone you love? As some kind of bully? No, it didn’t, it couldn’t even sound like me.” Ex. A at F1170. Depp further falsely alleged that there was “no truth to [Ms. Heard’s judicialstatements of abuse] whatsoever” and alleged that Ms. Heard fabricated the bruising on her face and perjured herself in connection with the 2016 DVRO. Jd. “Depp [was] emphatic about his version of events [alleging] ‘[Ms. Heard] was at a party the next day. Her eye wasn’t closed. She had her hair over her eye, but you could see the eye wasn’t shut. Twenty-five feet away from her, how the fuck am I going to hit her? Which, by the way, is the last thing I would've done.”” Id. 35. As Mr. Heath acknowledges in his article: “To suggest that a woman, a man or anyone might have made up such a serious allegation is a tremendously dangerous and damaging thing to do, If we as a global community are striving for equality and acceptance to run through every part of our lives, through all races, cultures and genders, then we need to believe those who stand up and claim to have been subjected to physical or verbal abuse.” Jd. 36. Mr. Heath then disclaimed any attempt on his part to verify the accuracy of Depp's false and defamatory allegations that he never injured Ms. Heard, that Ms, Heard committed perjury and that Ms. Heard fabricated evidence of bruising in 2016, stating: “Let me be clear: this is not a piece of investigative reporting.” Jd. Mr. Heath was merely publishing the false and defamatory statements that Depp, angry and vengeful, wanted the public to hear and believe were true, 37. In December 2018, Ms. Heard published an op-ed in the Washington Post calling for “changes to laws and rules and social norms” so that “women who come forward to talk about violence receive more support.” She warned that such reform is necessary because powerful men who have been accused of violence will spare nothing to punish and harass their accusers. 38. Ms. Heard’s op-ed is true and accurate, and plainly relates to matters of public concem that are protected under the First Amendment to the United States Constitution. 1039. Unlike Depp’s GQ article, Ms. Heard’s op-ed does not mention Depp at all. It said nothing about their relationship and made no claims about his conduct. Fundamentally—and contrary to the premise of Depp's defamation claim—the op-ed was not about Depp or his violent conduct against Ms. Heard. It was about Ms, Heard and what happened to her after she came forward. Based on her experiences as @ woman who had reported a man for violence, the op-ed described how “institutions protect men accused of abuse”—and how society reacts wrathfully to “women who speak out.” 40. Months later, Depp proved Ms. Heard’s point about powerful men accused of violence, sparing nothing to punish and harass their accusers when he filed his defamation lawsuit on March 1, 2019, alleging that Ms. Heard’s op-ed in the Washington Post defames Depp. It does not, 41. Depp's defamation and harassment of Ms. Heard did not stop when he filed this lawsuit, In fact, it has continued though the present, as Depp has authorized and conspired with his attorney, Adam Waldman (acting on Depp’s behalf), to attempt to destroy and defame Ms. Heard in the press, accusing her of being a serial liar who created the abuse she endured from Depp, which is not true, 42. On April 12, 2019, Depp, through Waldman, accused Ms. Heard of committing “defamation, perjury and filing and receiving a fraudulent temporary restraining order demand with the court” falsely accusing Ms. Heard of not being attacked by Depp. Exhibit B. 43. Depp, through Waldman, continued to defame Ms, Heard in June 2019, stating to Blast that “Ms, Heard continues to defraud her abused hoax victim Mr. Depp, the #metoo movement she masquerades as the leader of, and other real abuse victims worldwide.” Exhibit C. u44, On July 2, 2019, Depp, through Waldman, told Blast that Ms. Heard, “went to court with painted on ‘bruises’ to obtain a Temporary Restraining Order on May 27.” Exhibit D. The next day, Waldman continued Depp’s defamation of Ms, Heard when he stated to People magazine that “Ms, Heard?s ‘battered face’ was a hoax.” Exhibit K, 45. Depp, through Waldman, continued to claim that Ms. Heard was committing perjury to the Daily Mail, when he stated on April 8, 2020 that “Amber Heard and her friends in the media use fake sexual violence allegations as both a sword and shield, depending on their needs, They have selected some of her sexual violence hoax ‘facts’ as the sword, inflicting them on the public and Mr. Depp.” Exhibit F, 46. Then on April 27, 2020, Depp, through Waldman, again told the Daily Mail that “Quite simply this was an ambush, a hoax. ‘They set Mr. Depp up by calling the cops but the first attempt didn’t do the trick. The officers came to the penthouses, thoroughly searched and interviewed, and left after seeing no damage to face or property. So Amber and her friends spilled alittle wine and roughed the place up, got their stories straight under the direction of a lawyer and publicist, and then placed a second call to 911.” Exhi 47, On June, 24, 2020, Depp, through Waldman, falsely accused Ms. Heard in the Daily Mail of committing an “abuse hoax” against Depp. Exhibit H. 48. On July 22, 2020, Depp, through Waldman, tweeted the following with a picture: This photo was taken March 23, 2013 ONE DAY AFTER Ms. Heard alleges Johnny Depp backhanded her in the face with heavy rings on his fingers. 49. On July 26, 2020, Depp, through Waldman tweeted the following with the same pictures: 12Nice Photo taken March 24, 2013 one day after she [Ms. Heard] claimed Johnny smashed her in the face with heavily ringed fingers. Confronted, Amber testified she sees swelling in the pic. Whitney then testified she sees sealing and a SPLIT LIP. Do you Believe(sic] them or your own lying 50. These tweets contained false and defamatory information, including the date of the picture. 51. This elaborate plan to defame Ms. Heard was willful and malicious. 52. Contrary to his allegations and efforts to rewrite history, Depp did in fact engage in acts of domestic violence and abuse against Ms. Heard, and Ms. Heard did not perjure herself, fabricate evidence, defraud, or create a hoax. Depp’s statements and allegations, both through Depp and his agent Waldman (acting on Depp’s behalf), are false and defamatory. 53. In this Counterclaim, Ms. Heard secks a judicial declaration that her op-ed is not actionable, is protected by Virginia’s Anti-SLAPP statute, Virginia Code § 8.01-233.2, and Ms. Heard is entitled to reasonable attomey fees and costs pursuant to Virginia Code § 8.01-233.2. 54. Ms, Heard further secks to restore the balance of truth and fight back, as the victim of domestic abuse and violence, and take a stand against this continuing and unrelenting abuse. Ms. Heard seeks compensatory damages and punitive damages from Depp for his false and defamatory statements and for the harassment and abuse of computers and computer accessed media, as set forth in this Countereiaim. COUNT ONE - DECLARATORY JUDGMENT UNDER VA CODE. 184, et se 55. Ms, Heard repeats and incorporates by reference each and every allegation set forth in the above, as if fully set forth herein. 56. There is an actual and immediate controversy between Depp and Ms. Heard, within the meaning of Virginia Code §§ 8.01-184, ef seg. 1357. This controversy is concrete and capable of judicial resolution, 58. Justiciable issues exist for which declaratory relief is appropriate under Virginia Code §§ 8.01-184, et seq., and all parties to the controversy are before this Court. 59. Ms, Heard requests that this Court, pursuant to Virginia Code §§ 8.01-184, et seg., eclare that she is immune from civil liability for Depp’s claims in his Complaint and for her statements in her op-ed because Ms. Heard’s op-ed is “regarding matters of public concer that would be protected under the First Amendment to the United States Constitution made by [Ms. Heard] that are communicated to a third party.” See Virginia Code § 8,01-233.2(A) 60. Ms. Heard further requests and demands, consistent with a procedure set forth in Rule 3:25(d) of the Rules of the Virginia Supreme Court, her attorneys’ fees and costs, pursuant to Virginia Code § 8.01-233.2(B). 61. Mr. Heard further requests this Court declare the respective rights and legal relations of the parties as permitted by law. COUNT TWO DEFAMATION AND DEFAMATION PER SE 62. Ms, Heard repeats and incorporates by reference each and every allegation set forth in the above, as if fully set forth herein. 63, The GQ Article contains the following false and defamatory statements and implications concerning Ms, Heard: (@®) Depp falsely alleged that Ms. Heard committed a crime by perjuring herself in connection with the 2016 DVRO proceeding stating there was “no truth to [Ms. Heard’s judicial statements of abuse] whatsoever.” Exhibit A at F1170. (b) Depp further falsely alleged that Ms. Heard fabricated the bruising on her face and otherwise perjured herself in connection with the 2016 DVRO by stating, “Depp [was] 14emphatic about his version of events ‘[Ms. Heard] was at a party the next day. Her eye wasn’t closed. She had her hair over her eye, but you could see the eye wasn’t shut. Twenty-five feet away from her, how the fuck am I going to hit her? Which, by the way, is the last thing I would've done.” Id. (©) Depp further bolstered his false claim of perjury by alleging that he never committed domestic violence against Ms. Heard: “To harm someone you love? As some kind of bully? No, it didn’t, it couldn’t even sound like me,” and “Twenty-five feet away from her, how the fuck am I going to hit her? Which, by the way, is the last thing I would’ve done.”* Jd. 64. These allegations and implications in the GQ article are demonstrably false and constitute defamation in claiming, implying and insinuating that Ms. Heard lied, fabricated bruising, and falsified her claims of domestic violence and abuse, and that the accusations were a hoax. 65. Even the GQ journalist recognized the reputational harm and damage that would be caused by Depp’s allegations in his article stating: “To suggest that a woman ... might have made up such a serious allegation is a tremendously dangerous and damaging thing to do.” Id. 66. Depp also committed defamation through his agent, Adan Waldman, in a series of false and defamatory statements and implications concerning Ms. Heard statements from 2019 through the present: (@) On April 12, 2019, Depp, through Waldman, is quoted by Page Six, accusing Ms. Heard of committing “defamation, perjury and filing and receiving a fraudulent temporary restraining order demand with the court” falsely accusing Ms. Heard of not being attacked by Depp. 15(©) Im June 2019, Depp, through Waldman, told the Blast that “Ms, Heard continues to defraud her abused hoax victim Mr. Depp, the #metoo movement she masquerades as the leader of, and other real abuse victims worldwide.” (©) On July 2, 2019, Depp, through Waldman, told Blast that Ms. Heard, “went to court with painted on ‘bruises’ to obtain a Temporary Restraining Order on May 27.” The next day, Waldman continued Depp’s defamation of Ms. Heard when he stated to People magazine that “Ms. Heard’s “battered face” was a hoax.” (@) Depp, through Waldman, continued to claim that Ms. Heard was committing perjury to the Daily Mail, when he stated on April 8, 2020 that “Amber Heard and her friends in the media use fake sexual violence allegations as both a sword and shield, depending on their needs. Such statements are also defamatory and defamatory per se because the statements ‘would tend to harm Ms, Heard’s reputation as an actor, spokesperson and representative of entities and public interest groups, and lower her reputation in the estimation of the community and/or deter third persons from associating or dealing with her. 69. By publishing these false and defamatory statements, Depp caused, and intended to cause, harm to Ms. Heard’s reputation, 70. At the time of publication, Depp (and Waldman acting on Depp's behalf) knew these statements were false. 71. Asa direct and proximate result of Depp's false and defamatory statements, Ms. Heard has suffered damages including damages to her reputation, harm to her ability to work in her profession and as a spokesperson, pecuniary and non-pecuniary damages, embarrassment, humiliation, inconvenience, and emotional distress in an amount to be proven at trial and determined by a jury. 72. Mr. Depp's actions were willful, malicious and wanton and demonstrate a reckless and conscious disregard for the truth or falsity of his statements and of Ms, Heard’s right to be free from statements that defame her and wrongfully impair her right to work in her profession, and further constituted actual malice. 7COUNT THREE - VIOLATION OF THE VIRGINIA COMPUTER CRIMES ACT 73. Ms. Heard repeats and incorporates by reference each and every allegation set forth in the above, as if fully set forth herein. 74, The Virginia Computer Crimes Act, Virginia Code § 18.2-152.7:1, proscribes “Harassment by computer,” which occurs when any person “with the intent to coerce, intimidate, or harass,” uses a computer to communicate “obscene, vulgar, profane, lewd, lascivious, or indecent language, or make[s] any suggestion or proposal of an obscene nature, or threaten{s] any illegal or immoral act[.]” 75. Virginia Code 18.2-152.12 provides a private, civil right of action for violations of this statute. 76. Through the conduct describe above, Mr. Depp, cither directly or through his agents including Waldman, acting on his behalf in Virginia, has launched a nationwide campaign, including from or through Virginia, using this Virginia litigation, to harass, abuse, and discredit Ms. Heard, and to cause harm to her economically, Mr, Depp, individually and through his agents, is attempting and threatening to defame Ms, Heard and to interfere with Ms. Heard’s reputation, career and livelihood, and cause financial damages, and he and his agents are doing so through this online smear campaign that he has organized and orchestrated. Thus, he has explicitly threatened an illegal act against Ms. Heard. An intentional and necessary result of his actions is the transmission of this information electronically in Virginia. 77. The comments attributable to those acting on the behalf of and at the direction of Mr, Depp and/or his agents are also, in many cases, vulgar, profane, lewd, and/or make suggestions or proposals of an obscene nature, and/or threaten Ms. Heard explicitly. 18.78. As a result of Mr. Depp’s conduct, Ms, Heard has suffered pecuniary and non- pecuniary damages in an amount to be proven at trial and determined by a jury, 79. Mr. Depp's actions were willful, malicious and wanton and demonstrate a conscious disregard for the rights of Ms. Heard.
