Unabhängig davon, ob für diese Lizenzvereinbarung Übersetzungen in andere Sprachen vorliegen, wird nur
die in Englisch abgefasste Version als offizielle Version anerkannt. In Bezug auf die Interpretation und
Auslegung dieses Vertrages ist nur die englische Version dieses Vertrages gültig.

Vielen Dank, dass Sie sich für das Scannerprodukt ("Produkt") von fi Series entschieden haben.
Diese EULA ist eine Lizenzvereinbarung zwischen Ihnen und PFU LIMITED ("PFU"), welche die Benutzung
des mit dem Produkt zu verwendenden Error Recovery Guide ("Software") regelt.

DURCH DIE VERWENDUNG DER SOFTWARE VERPFLICHTEN SIE SICH ZUR EINHALTUNG DER
BEDINGUNGEN DIESER EULA. WENN SIE DIE BEDINGUNGEN DIESER EULA NICHT ANERKENNEN,
SIND SIE NICHT ZUR NUTZUNG DER SOFTWARE BERECHTIGT. SIE VERSICHERN, DASS SIE IM
NAMEN IHRES ARBEITGEBERS HANDELN UND ZUR ANERKENNUNG DIESER BEDINGUNGEN UND
KONDITIONEN IN SEINEM NAMEN BERECHTIGT SIND (DIESER ARBEITGEBER WIRD NACHSTEHEND
"SIE" GENANNT). SIE ERKLÄREN, DASS SIE DIESE EULA GELESEN UND VERSTANDEN HABEN.

WENN SIE DIE BEDINGUNGEN UND KONDITIONEN DIESER EULA NICHT ANERKENNEN
INSTALLIEREN, KOPIEREN ODER VERWENDEN SIE DIE SOFTWARE IN KEINER WEISE.

1. Lizenzberechtigung; Installation und Benutzung

(1) PFU berechtigt Sie mit einer nicht-exklusiven, nicht übertragbaren Lizenz gemäß den Bedingungen und
Konditionen dieser EULA zum Besitz und zur Verwendung der Software. Sie erklären sich bereit, die
Software nur zu Ihrer Benutzung und weder zum Verkauf noch zur Weitergabe verwenden. Alle Ihre
Rechte unterliegen hiermit und werden Ihrerseits bestimmt von der Einhaltung aller Bedingungen und
Konditionen dieser EULA.

(2) Sie sind berechtigt, die Software nur jeweils ein Mal auf Ihrem Computer zu installieren und zu verwenden.

(3) Sie erklären sich bereit anzuerkennen, dass die Bedingungen und Konditionen dieser EULA auch für alle
Updates, Upgrades oder Ergänzungen dieser Software gültig sind.

2. Sicherheitskopie

Sie sind berechtigt, Sicherheitskopien in angemessener Anzahl von dieser Software zu erstellen. Diese
Berechtigung unterliegt allerdings der Voraussetzung, dass diese Sicherheitskopien ausschließlich zu
Archivierungszwecken erstellt werden.

3. Einschränkungen

(1) Es ist Ihnen das Verkaufen, Verleihen, Übertragen sowie das Weitergeben der Lizenz untersagt. Weiterhin
ist Ihnen das Verbreiten, Modifizieren, Übersetzen, Vervielfältigen, Reproduzieren, Kopieren oder
Veröffentlichen der Software (bzw. das Erteilen einer Berechtigung zum Ausführen zuvor genannter
Tätigkeiten) nicht gestattet, ausgenommen mit ausdrücklicher und schriftlich festgehaltener Zustimmung
von PFU. Sie dürfen die Software nicht dekompilieren, Reverse Engineering vornehmen oder auf andere
Weise versuchen, den Quellcode der Software zu ermitteln.
Sie erkennen die Software als ausschließliches Eigentum von PFU oder seiner Lizenzgeber oder
 Zulieferer an.
Es ist Ihnen die Vermietung, Verpachtung, der Verleih untersagt oder sonstige kommerzielle
Dienstleistungen mit dieser Software durchzuführen.

(2) SİE ERKENNEN AN, DASS DİESE SOFTWARE NİCHT FÜR DİE BENUTZUNG İN UMGEBUNGEN
ENTWİCKELT, ENTWORFEN UND HERGESTELLT WURDE, İN DENEN ERHEBLİCHE RİSİKEN UND
GEFAHREN, WİE ZUM BEİSPİEL TOD, PHYSİSCHE UND PSYCHİSCHE VERLETZUNGEN ODER
ANDERE SCHÄDEN (İM FOLGENDEN "NUTZUNG İN HOCHSİCHERHEİTS-ANWENDUNGEN"
GENANNT) DURCH DİE BENUTZUNG AUFTRETEN KÖNNEN UND DAHER
HOCHSİCHERHEİTSBESTİMMUNGEN GELTEN. ZU DENEN ZÄHLT OHNE EİNSCHRÄNKUNGEN DİE

HOCHSİCHERHEİTS-ANWENDUNGEN ZU GEBRAUCHEN. PFU ÜBERNİMMT KEİNE
VERANTWORTUNG UND HAFTUNG FÜR JEGLİCHE SCHÄDEN, DİE DURCH DİE NUTZUNG DİESER
SOFTWARE İN HOCHSİCHERHEİTS-ANWENDUNGEN VERURSACHT WORDEN SİND.

(3) Sie erkennen an, dass die Software nicht dafür hergestellt wurde, um Computer oder
Computernnetzwerke gegen einen unautorisierten Zugriff oder Computerviren zu schützen und dass PFU
nicht für jegliche Schäden der Software, Ihres Computers der Ihres Netzwerks verantwortlich ist, die durch
einen unautorisierten Zugriff oder durch Computerviren entstanden sind.
Es obliegt Ihrer Verantwortung Maßnahmen zu treffen, um unautorisierte Zugriffe auf Ihren Computer oder
das Netzwerk zu verhindern.

4. Rechte an Geistigem Eigentum

(1) Sie erkennen an, dass keinerlei Betriebsgeheimnisse und vertrauliche Informationen sowie das
Urheberrecht, Patent oder Warenzeichen der Software in welcher Form immer an Sie übertragen werden.
Ausgenommen der vorliegenden Ausführungen, gewährt Ihnen dieser Vertrag keinerlei geistige
Eigentumsrechte von PFU an der Software und deren Technologie.

(2) Sie sind nicht berechtigt, in der Software oder in einer Kopie derselben enthaltenen urheberrechtliche
Anmerkungen zu ändern oder zu.

5. Rechtsübertragung

Sie verpflichten sich die Software weder in Teilen noch im Ganzen an eine dritte Partei zu übertragen,
ausgenommen in Verbindung mit der Übertragung des Produkts. Ist dies der Fall unterliegt eine Übertragung
oder Zuweisung den Bedingungen und Konditionen dieser EULA. Weiterhin ist es Ihnen nicht gestattet, nach
einer solchen Übertragung oder Zuweisung Kopien der Software zu behalten.

6. Exportbestimmungen

Die Software unterliegt den Exportbestimmungen und-gesetzen der USA und kann auch auf Import- und
Exportbestimmungen der Rechtsprechung in Gebieten außerhalb der USA angewendet werden. Sie sind
verpflichtet, alle auf die Software anzuwendenden Exportbestimmungen und –verordnungen zu befolgen. Sie
erkennen an, dass Sie die Software weder exportieren, re-exportieren oder übertragen, sei es in Teilen oder im
Ganzen, in Länder, an Personen oder Einheiten, die anzuwendenden Exportbeschränkungen der USA
unterliegen. Im Besonderen erkennen Sie das Verbot des Exports, Re-Exports oder der Übertragung der
Software an:
(i) in Länder, in denen ein Embargo oder Exportbeschränkungen bei Gütern oder Dienstleistungen besteht
oder an Staatsbürger dieser Länder, die den Transport oder das Verbringen des Produkts in diese Länder
beabsichtigen;
(ii) an Personen oder Einheiten, die beabsichtigen die Software oder Teile derselben für die Planung,
Herstellung, Entwicklung oder Verwendung von nuklearen, chemischen oder biologischen Stoffen,
Einrichtungen oder Waffen zu verwenden; oder
(iii) an Personen oder Einheiten, die seitens der Bundesbehörden der USA oder einer assoziierten Regierung
von Exporttransaktionen ausgeschlossen sind.

7. Software Support

Support für die Software wird von PFU oder seinen Tochtergesellschaften nur über den Erwerb der Support-
Dienste für die Software zur Verfügung gestellt. Wenden Sie sich für den Erwerb der Support-Dienste bitte an
Ihrer Zulieferer.

8. BESCHRÄNKTE GEWÄHRLEISTUNG

(1) Sollten Sie einen Defekt am Datenträger oder den Drucksachen dieser Software feststellen, können Sie
diese innerhalb des auf dem im Lieferumfang dieses Produktes beinhalteten Garantiescheins
angegebenen Garantiezeitraumes dieses Produktes bei Ihrem Händler umtauschen lassen.
DIE SOFTWARE WIRD “WIE SIE IST” ZUR VERFÜGUNG GESTELLT: PFU UND IHRE LIEFERANTEN
ÜBERNEHMEN KEINE GEWÄHRLEISTUNG JEDWEDER NATUR, EINSCHLIESSLICH DER
IMPLIZIERTEN GEWÄHRLEISTUNG DER MARKTFÄHIGKEIT, EINER NICHT- VERLETZUNG ODER
ZWECKMÄSSIGEN EIGNUNG.

(2) MIT AUSNAHME DER AUSSCHLIESSLICHEN HIER BESCHRIEBENEN RECHTSBEHELFE,

ÜBERNEHMEN PFU,TOCHTERUNTERNEHMEN ODER IHRE LIEFERANTEN KEINE HAFTUNG FÜR
VERLUST, SCHÄDEN, ANSPRÜCHE ODER KOSTEN JEGLICHER ART EINSCHLIESSLICH
FOLGESCHÄDEN, DIREKTE, INDIREKTE, ZUFÄLLIGE SCHÄDEN ODER FOLGESCHÄDEN
JEGLICHER ART, SCHÄDEN, DIE AUS BETRIEBSSTILLSTAND HERRÜHREN EINSCHLIESSLICH
ENTGANGENEN GEWINN ODER ENTGANGENE ERSPARNISSE ODER DATENVERLUST, AUCH
WENN EIN VERTRETER VON PFU ÜBER DIE MÖGLICHKEIT SOLCHER VERLUSTE, SCHÄDEN,
ANSPRÜCHE ODER KOSTEN UNTERRICHTET WAR. DIE VORGENANNTEN BESCHRÄNKUNGEN
UND AUSSCHLÜSSE GELTEN NUR SOWEIT NACH ANWENDBAREN ZWINGENDEN
VORSCHRIFTEN DER JEWILIGEN RECHTSPRECHUNG.

9. Verschiedene Bestimmungen

(1) Wenn Sie zuwider den Bedingungen und Konditionen dieser EULA handeln, führt dies zu einem sofortigen
Erlöschen Ihrer Lizenz und der Benutzerberechtigung dieser Software.
Ist dies der Fall, sind Sie angehalten, alle in Ihrem Besitz befindlichen Kopien dieser Software und deren
Komponenten zu zerstören.

(2) Dieser Vertrag (EULA) unterliegt dem geltenden materiellen Recht Japans.
Ausgeschlossen wird die Anwendbarkeit gesetzlicher Kollisionsnormen und des Abkommens der
Vereinten Nationen über Verträge für den Internationalen Verkauf von Waren (United Nations Convention
 on Contracts for the International Sale of Goods). Die Anwendung dieser Bestimmungen ist ausdrücklich
ausgeschlossen.

(3) Dies ist der vollständige Vertrag zwischen Ihnen und PFU bezüglich der Software. Er ersetzt alle
bisherigen Erklärungen, Besprechungen, Zusicherungen, Mitteilungen oder Werbungen mit Bezug zur
Software und darf nur mit ausdrücklicher Zustimmung der betreffenden Parteien in irgendeiner Weise
verändert werden.

(4) Wenn es sich herausstellt, dass ein Teil des vorliegenden Vertrags (EULA) ungültig oder nicht
durchsetzbar ist, so wird die Gültigkeit und Durchsetzbarkeit des übrigen Vertrags davon nicht berührt.

(5) Die Nichtgeltendmachung der Bedingungen und Konditionen dieser EULA durch eine der Parteien wird bei
zukünftigen Rechtsfällen nicht als Verzicht auf eine der Bedingungen und Konditionen des Vertrags
aufgefasst.
Der Verzicht auf eine der Bedingungen und Konditionen dieser EULA wird nicht als schriftliche Erklärung
seitens der verzichtenden Partei angesehen.

Thank you for purchasing fi Series scanner product ("Product").

This EULA is a license agreement between You and PFU LIMITED ("PFU") governing the use of the Error
Recovery Guide (“Software”), which is to be used with the Product.

BY USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO
NOT AGREE TO THE TERMS OF THIS EULA, YOU ARE NOT PERMITTED TO USE THE SOFTWARE.
YOU REPRESENT THAT YOU ARE ACTING ON BEHALF OF YOUR EMPLOYER AND ARE AUTHORIZED
TO ACCEPT THESE TERMS AND CONDITIONS ON ITS BEHALF (SUCH EMPLOYER BEING
HEREINAFTER REFERRED TO AS “YOU”). YOU AGREE THAT YOU HAVE READ AND UNDERSTAND
THIS EULA.

IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS EULA, DO NOT INSTALL, COPY, OR
USE THE SOFTWARE IN ANY MANNER.

1. Grant of License; Installation and Use

(1) PFU hereby grants You a non-exclusive and non-transferable license to possess and use the Software in
accordance with the terms and conditions of this EULA. You agree that You are licensing the Software for Your
end use only and not for resale or redistribution. All Your rights hereunder are subject to and conditioned upon
Your complying with all of the other terms and conditions of this EULA.
(2) You may install and use the Software on any one (1) computer at a time.
(3) You acknowledge and agree that the terms and conditions of this EULA also apply to any updates,
upgrades, supplements for the Software.

2. Backup Copy
You may make a reasonable number of backup copies of the Software solely for archival purposes.

3. Restrictions
(1) You shall not sell, lease, assign, transfer, sublicense, disseminate, modify, translate, disclose, duplicate,
reproduce or copy the Software (or permit any of the foregoing to be done by any other party), except as
expressly stated herein, without the prior written consent of PFU. You shall not, except to the extent expressly
permitted by applicable law, reverse engineer, reverse compile or reverse assemble the Software or otherwise
attempt to create the source code from the Software. You agree to treat the Software as the confidential and
proprietary information of PFU or its licensors and suppliers. You may not rent, lease, lend or otherwise provide
to others commercial hosting services using the Software.
(2) YOU ACKNOWLEDGE AND AGREE THAT THE SOFTWARE IS NOT DESIGNED, DEVELOPED OR
MANUFACTURED FOR ANY USE THAT MAY GIVE RISE TO FATAL RISKS OR DANGERS OR FOR ANY
USE THAT COULD LEAD TO DEATH, PERSONAL INJURY, SEVERE PHYSICAL DAMAGE, OR OTHER
LOSS IN THE ABSENCE OF EXTREMELY HIGH SAFETY REQUIREMENTS BEING FOLLOWED (EACH OF
SUCH USES BEING HEREINAFTER REFERRED TO AS A "HIGH SAFETY REQUIRED USE"). HIGH
SAFETY REQUIRED USES SHALL INCLUDE WITHOUT LIMITATION, NUCLEAR REACTION CONTROL IN
NUCLEAR FACILITIES, AIRCRAFT FLIGHT CONTROL, AIR TRAFFIC CONTROL, MASS TRANSPORT
CONTROL, MEDICAL LIFE SUPPORT SYSTEMS, AND MISSILE LAUNCH CONTROL IN WEAPON
SYSTEMS. PFU DISCLAIMS ANY LIABILITY FOR DAMAGES CAUSED BY USE OF THE SOFTWARE IN
ANY HIGH SAFETY REQUIRED USE. YOU AGREE NOT TO USE THE SOFTWARE IN ANY HIGH SAFETY
REQUIRED USE. PFU DISCLAIMS ANY AND ALL LIABILITY FOR DAMAGES CAUSED BY YOUR USE OF
THE SOFTWARE IN ANY HIGH SAFETY REQUIRED USE.
(3) You acknowledge and agree that the Software is not designed to protect computers or computer networks
against unauthorized access or computer viruses and that neither PFU nor any of its affiliated companies,
suppliers or resellers is liable for any damage to the Software, or to Your computers or computer networks,
caused by such unauthorized access or computer viruses. You shall take proper security measures to avoid
such unauthorized access or computer viruses.

4. Reservation of Rights and Ownership

(1) You agree that no title to, or intellectual property rights in, including, without limitation, any trade secret,
copyright, patent and trademark, or any other interest in any Software, is transferred hereunder to You, with the
exception of the licenses granted to You in this EULA. You agree that You will not take or cause to be taken
any action that would challenge the validity or enforceability of any of PFU’s intellectual property rights to
Software or any technology included therein.
(2) You shall not change or remove any copyright notices contained within the Software and its copy.

5. Assignment
You may not transfer or assign the Software to a third party, except in connection with transfer of the Product,
and in such case a transfer or assignment shall be subject to and conditioned upon your ensuring that the
transferee or assignee agrees to all of the terms and conditions of this EULA and, in addition, You shall not
retain any copies of the Software after such transfer or assignment.

6. Export Control
The Software is subject to U.S. export control laws and regulations and may also be subject to import and
export laws of the jurisdiction in which it was obtained, if outside the U.S. You shall abide by all applicable
export control laws, rules and regulations applicable to the Software. You agree that You will not export, re-
export, or transfer the Software, in whole or in part, to any country, person, or entity subject to U.S. and any
applicable export restrictions. You specifically agree not to export, re-export, or transfer the Software to: (i) any
country to which is embargoed or restricted to export of goods or services, or to any national of such country,
wherever located, who intends to transmit or transport the product back to such country; (ii) any person or
entity who You know or have reason to know will utilize the Software or portion thereof in the design,
development, production or use of nuclear, chemical or biological materials, facilities, or weapons; or (iii) any
person or entity who have been prohibited from participating in export transactions by any federal agency of the
U.S. government or any applicable government.

7. Software Support
Support for the Software is not provided by PFU or its affiliates unless You purchase support service for the
Software. For purchase of support service for the Software, please contact Your supplier.

8. LIMITED WARRANTY
(1) In the event that you find any defects on the media or printed material included in the Software package,
you may return it to your place of purchase for replacement, if within the warranty period of the Product stated
on the warranty document bundled with the Product. THE SOFTWARE IS PROVIDED BY PFU “AS IS”. PFU
ON BEHALF OF ITSELF AND ITS AFFILIATES HEREBY DISCLAIM ALL WARRANTIES OF ANY NATURE,
WHETHER EXPRESS, IMPLIED OR OTHERWISE, AND WHETHER ARISING FROM TRADE OR CUSTOM,
INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS
FOR A PARTICULAR PURPOSE.
(2) EXCEPT AS EXPRESSLY PROVIDED HEREIN, UNDER NO CIRCUMSTANCES SHALL PFU, ITS
AFFILIATES, LICENSORS OR SUPPLIERS BE LIABLE TO YOU OR TO ANY OTHER PERSON UNDER
TORT, CONTRACT, OR ANY OTHER LEGAL THEORY, FOR ANY DIRECT, INDIRECT, SPECIAL,
INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER ARISING FROM THE USE,
PERFORMANCE OR NON-PERFORMANCE OF THE SOFTWARE, INCLUDING, WITHOUT LIMITATION,
DAMAGES FOR LOSS OF PROFITS, LOSS OF GOODWILL, OR LOSS OF DATA, EVEN IF PFU HAS BEEN
INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE
EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THESE
LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.

9. Miscellaneous Provisions
(1) If you fail to comply with the terms and conditions of this EULA, this license and your rights in the Software
shall terminate immediately. In such event, you must destroy the Software, including all copies of the Software
and all of its component parts.
(2) This EULA will be governed by and construed in accordance with the substantive laws of Japan, without
regard to conflict of laws principles. This EULA will not be governed by the conflict of law rules of any
jurisdiction or by the United Nations Convention on Contracts for the International Sale of Goods, the
application of which is expressly excluded.
(3) This EULA sets forth the entire agreement and understanding between You and PFU relating to the
Software, and it supersedes all prior or contemporaneous oral or written communications, proposals and
representations with respect to the Software. It may not be modified or changed in any way without the express
written consent of the parties hereto.
(4) If any provision of this EULA is held to be invalid or unenforceable for any reason, the other provisions shall
continue in full force and effect.
(5) The failure of either Party to enforce, in any one or more instances, any of the terms and conditions of this
Agreement shall not be construed as a waiver of the future performance of any such term or condition. Waiver
of any term of condition of this Agreement shall only be deemed to have been made if expressed in writing by
the Party granting such waiver.
