The new Skilled Occupation List (SOL)
On 17 May 2010, the Minister for Immigration and Citizenship, Senator Chris
Evans, announced the list of occupations included in the new Skilled
Occupation List (SOL). The introduction of a new list of occupations is
part of a package of reforms that reflects the Government's commitment
to a labour market demand-driven Skilled Migration Program. [DIAC

 not based on needs of potential applicants
 targets specialised occupations that require a long lead time of
formal education and training

It is intended that the new list of occupations would be updated
annually, and would change in accordance with the needs of the
Australian labour market. While the new list would be expected to
stay relatively stable, there is no guarantee how long a particular
occupation may remain on it. [DIAC FAQ sheet]

 Minister will amend Migration Act to give him powers to set maximum
number of visas that may be granted to applicants in any one occupation-
capping by visa class and occupation

 Minister has asked DIAC to explore the feasibility of introducing a new


system where applicants initially put forward their claim for skilled
migration, and are then selected as candidates by employers, State and
Territory governments, or by the Commonwealth.

Transitional arrangements
The new SOL list will NOT apply to:

 GSM applicants who at 8 February 2010:


 held a subclass 485 visa or had a pending subclass 485 visa application

and who apply for a permanent or provisional onshore GSM visa by


31 December 2012 or at the date of the announcement (8 Feb?)
had a pending GSM visa application.
 international students who on 8 February 2010
 held a subclass 572 subclass 573 subclass 574 (postgraduate research
sector) student visa who apply for a subclass 485 (skilled graduate) visa
using the current SOL, as long as they lodge their subclass 485
application by 31 December 2012.

“The government intends to have in place very generous


transitional arrangements to allow most overseas students
affected by this proposed change time to remain in Australia
while considering their options. However, if you cannot meet
the requirements for a further visa in Australia, you would be
expected to leave Australia following the completion of your

18 months on the temporary skilled graduate visa after the
completion of their studies to gain valuable work experience
and the opportunity to secure an employer or state/territory
government to sponsor them.”

The concept of occupation

The categories at the most detailed level of the


ANZSCO structure are called 'occupations'. An
'occupation' is defined as a set of jobs that require
the performance of similar or identical sets of tasks.
As it is rare for two actual jobs to have identical
sets of tasks, in practical terms, an 'occupation' is a
set of jobs whose main tasks are characterised by a
high degree of similarity.
The concept of skill level

In ANZSCO, skill level is defined as a function of the range and


complexity of the set of tasks performed in a particular
occupation. The greater the range and complexity of the set
of tasks, the greater the skill level of an occupation.

 Skill level is measured operationally by:


 the level or amount of formal education and training

 the amount of previous experience in a related occupation,


and
 the amount of on-the-job training

 SKILL LEVEL 1 bachelor/5 years experience/
 SKILL LEVEL 2
AQF Associate Degree, Advanced Diploma or Diploma/3 years experience
 SKILL LEVEL 3
AQF Certificate IV or AQF Certificate III + 2 years on-the-job training.
 SKILL LEVEL 4
AQF Certificate II or III / 1 year relevant experience
 SKILL LEVEL 5
AQF Certificate I or compulsory secondary education.

What about Skills Assessments?

 especially in cases where there is no clear and direct


correspondence between ANZSCO and ASCO?
eg, Computing Professionals

 Can skills assessment based on ASCO be used after 1 July


2010 or do these clients need to reapply and obtain fresh
skills assessments before lodging their visa applications?
 Are there any transitional arrangements that DIAC has put in
for this purpose?
The answer:

 There is no clear answer yet

 Most skills assessing authorities have yet had no


guarantee yet as to what occupations they will
retain assessment authority for.
Australian Computer Society (ACS)

“ … subject to the approval of the Governor-General in


Council of the proposed amendments to the
Migration Regulations 1994 to give effect to the
framework in which new SOL would be applied, it is
intended that the ACS will make following
arrangements in regard to Pre-application Skills
Assessment (PASA):

outcome letter with an ASCO code issued by the ACS prior to 1
July 2010, are advised to apply for a review of assessment
outcome and follow application for review process that will

Department of Immigration and Citizenship (DIAC).” 1/7/2010?

This will only apply to people wanting to


make a visa application after 1 July 2010

Please note - For applicants who hold, or are about to hold, an


assessment outcome letter with an ASCO code issued by
this office prior to 1 July 2010, and who lodge an application
to DIAC within 12 months of the date of this letter:

DIAC have advised us that they will honour the ASCO code
assessment for a period of 12 months after the introduction
of the new SOL, or the expiry date of their 12-month validity
of the assessment outcome letter, whichever is the sooner.

This is for Engineers Australia only at this stage!


The new SOL

 has solved very little


 has given rise to further questions
 has not made your work as an adviser to clients any
easier, and it will not get any easier until the whole
new GSM program is revealed
