DARUSILLA SUAU’S DEFENCE AGAINST A DEFEMATION OF CHARACTER CHARGE LAID BY

MS MARLENE KRAHWAZI.

1.Your Worship I appear before you to answer a charge of defamation of character brought against
me by Marlene Krahwazi.

Yes, Your Worship, I did post those comments on face book. However, I did not tagged 22 friends as I
only have 19 friends and tagged those 19 not more and not less.

2.Your Worship the complainant has told you one side of this incident but I believe she has left out
pertinent details, whether purposely it is not for me to say but for her to explain to Your Honour.

I do not intentionally go on face book to post comments that are derogatory against other people.
As a God fearing person I am mindful of the dangers of the use and abuse of social media platform
such as face book as I have no control of how my comments would be misconstrued.

3.On the morning of the 27th July 2020 my sister friend Linda Singavi who was working for GFI PNG as
a cleaner was not feeling well enough to go to work and requested me if I can assist her by taking
their ration store key with me I agreed to help since I lived with her in the same house same area.
Her intention was to call their office and let them know that she had given the key to me so the
admin driver do not drive all the way to Bumayong for the key by just drive to top town where I work
and pick up the key however couldn’t get in touch with their office that morning. I also intended to
call GFI PNG office when I got to my office to let them know that I am in the office now and that they
can come and collect the key. On arrival in the office I proceeded direct to attend our weekly
meeting which took nearly an hour. When we finished from the meeting the GFI admin driver was
already waiting for me and I handed over the key.

I had no intention of purposely holding on to the key it was with sympathy I did to help

4.Your Worship, I am an adult and a mother and have feelings as well as all other human being. I
must also let your Honour know that I know the complainant as I was a former employee of GFI PNG
and the complainant Marlene Krahwazi was my former supervisor. I no longer work for GFI PNG and
have been for some time.

5.Your Worship, as I stand before you in your chamber, may I humbly request that the complainant
be honest before you and let Your Honour know exactly what she said to the HR coordinator Sharon
Nenggai and the GFI office about me on the morning of the 27 th July 2020. This is her exact
comments in pidgin “ Sharon yu recruitim niupla meri name blo em Darusilla na Lin givim key long
em?” Her comments are very sensitive and provocative Your Worship. The complainant Marlene
Krahwazi uttered and made what I believed to be derogatory and very hurtful comments about me.

6.Your Worship my sister friend Linda Singavi told me about those hurtful comments after I went
home from work on the 27th July 2020. I could not understand why this was so the complainant
Marlene Krahwazi make those comments about me to others in the office to hurt me and tarnish my
integrity and reputation was not acceptable to me and uncalled for. I felt angry but very hurt. I
believed that was on purpose and I felt that perhaps she still habours some hard feelings towards
me from my days of working before at GFI PNG.

7.Your Worship my sister friend Linda Singavi, reception staff Martina and the HR coordinator
Sharon Nenggai of GFI PNG must also appear to testify before Your Honour about what the
complainant Marlene Krahwazi also said about me which left me so up sat and made me felt so
humiliated. After enduring the complainant’s hurtful and abusive stand over tactics as an employee
at GFI, I was happy to depart when my service was terminated. On hearing the same hurtful and
derogatory remarks being made by the complainant Marlene Krahwazi about me, I felt that I had no
other option but to share my feelings with my 19 friends on face book.

Your Worship attached as part of my defense is a Statement from Linda Singavi.

8.Your Honour the complainant also has not disclosed the fact that I did asked her for forgiveness
ten days after the incident. Spiritually the incident troubled me. I knew it was wrong to pay back a
wrong by way of another wrong and so I reached out to her to seek forgiveness. Perhaps she can
confirm that to Your Honour. As far as I was concern she is the instigator she instigated the incident
but I wanted to make peace and reached out to her. I received no response and so we are here now
in your Chamber which the complainant Marlene Krahwazi want to prove her innocence Your
Worship.

9.Your Worship I lost my means of earning a living when I was terminated from GFI and have
recently have been blessed to be employed by a small and recently established PNG company. Given
my situation now, I have no money to pay compensation of K5,000.00.

I genuinely believe that the claim by the complainant Marlene Krahwazi is without basis and an
abuse of process. Obviously it is a criticism from both the complainant Marlene Krahwazi and me.
She made hurtful and derogatory remarks and comments about me first and left me with no option
for a recourse hence I took to face book.

10.Your Worship I believe no one is perfect. I also believe that the complainer has no heart to
reconcile with those she has issues with. I believe she only think about herself but not others.

It is my humble opinion that the complainant Marlene Krahwazi has no basis to seek compensation
for defamation. I genuinely believe she defamed me first.

Your Worship given the foregoing, I humbly submit that Your Worship dismiss the case and order
both the complainant and I to seek, give and receive forgiveness.
