RESOLUTION AUTHORIZING THE EXECUTION OF AN AMENDMENT TO THE
COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY OF JERSEY CITY
AND THE JERSEY CITY POLICE OFFICERS BENEVOLENT ASSOCIATION JANUARY
1,2009- DECEMBER 31, 2012

Council Offered and Moved Adoption of the FollowingResolution:

WHREAS, pursuant to a Resolution adopted by the Municipal Council at its meeting of May 12, 2010,
the Mayor or Business Administrator executed a Collective Bargaining Agreement Between the City of
Jersey City and the Jersey City Police Offcers Benevolent Association for the period Januar 1, 2009
through December 31,2012; and

WHREAS, thereafter, as the result of a severe economic doWntown and budgetary shortalls, the City of
Jersey City submitted a plan to the Civil Service Commission to layoff 82 police offcers, which plan was
approved by letter dated December 22, 2010; and '

WHREAS, in order to avert the implementation öf the layoff plan, the paries engaged in extensive
negotiations to amend the agreement and reduce the cost of certin contractual terms and conditions under
the agreement; and .
WHREAS, a tentative settlement has been reached with the administration to avert the layoffs for this
fiscal year and to amend the existing Collective Bargaining Agreement Between the City of Jersey City and
the Jersey City Police Offcers Benevolent Association, which Settlement and Amended Agreement is
attached hereto as Exhibit A.

NOW THEREFORE, Be it Resolved by the City of the City of Jersey City that:

1.) The Settlement and Amended Agreement Between the City of Jersey City and the Jersey City Police
Offcers Benevolent Association Januar 1, 2009 - December 3 1, 2012, is hereby approved and

Agreement Between tte City of Jersey City and the Jersey City Police Offcers Benevolent
Association January 1,2009 - December:3 1,2012, attched hereto as Exhibit A.

. SETTLEMENT AGREEMENT AN ADDENDUM

The Jersey City Police Offcers :Benevolent Association ("POBA")and the City of Jersey
. City hereby agree to the termsofthe followingsettlertent agreement and addendum to the curently
. executed (J ariuar i, 2009 '" December 3 i ; 20 i 2) ColleCtive Bargaining Agreement. This document
is made for the sole pllose of rescinding the lay-off plan of approximately eighty-two (82) police
. offcers in calendar year 201 i.

1. PAYROLL LAG: The Jersey City Police Officers BenevolentAssociation agrees to a:

3. SALARY GUIDE INCREMENT "LAG": The City ofJersey City hereby agrees to pay
the eighty-two (82) officers in receipt of a lay-off notification the scheduled contractual step
increase for calendar year 2011 effective October 1,2011.

4. ADDITIONAL COMPENSATORY DAY: The City of Jersey City shall provide each
current member of the POBA an additional compensatory day payable upon retirement~

resciIid the approved layoff of members of the Jersey City Police Officers Benevolent-Association
for calendar year 2011.

This Agreement is an amendment to and shall become part of the curent, executed
. Collective Bargaining Agreementbetween the.parties. The contractual amendments contained in.
this Agreement-are limited to items one(l) through five (5) above. The paries agree that-no other
contract language is tö be addressed or amençed as part ofthisAgreement.
