Dear Governor Abbott:

Thank you for your letter of December 23, 2020 regarding the M.D. v. Abbott lawsuit, and for
your leadership since the onset of this case. At my very first briefing as Commissioner a year
ago, it was made clear to me that you set the bar for the direction of this case, and the agency has
worked diligently to reflect your priorities. I share entirely your expectation of compliance with
the federal Court’s remedial orders and understand your directive for the same.
In the little over a year you have entrusted me to lead the Department of Family and Protective
Services, I have made compliance with the Court’s remedial orders a priority. While our steps
are far too many to mention, at a macro level we have streamlined and/or drastically changed
processes, stood-up new divisions to ensure and monitor compliance, and brought in new
leadership to assist with critical tasks. But despite our many strides, I know there is much work
to be done.
As Commissioner, my primary objective is the protection and well-being of all children in
DFPS’ care, including - certainly not limited to - the children in the permanent managing
conservatorship of the Department. I’ve also renewed our focus on providing high-quality
services to our older youth, to hopefully give them every opportunity for success. I know that
we share these important goals.
Since receiving the Court’s December 18th order, we have worked to detail our many efforts and
improvements to meet the remedial orders and will timely submit the required certifications. I
am confident our actions have improved our work and provide real benefit to children in care.
Thank you for your and the Legislature’s continued support of the efforts we are making to
comply, and for the resources and flexibility necessary to succeed in these efforts. I look
