1. Introduction

The objective of this report is to find different perspective of gender equality and its
impact on EEO in Pakistan. This report includes discussion on how the gender
employment might affect the EEO inside Pakistan.

1.1 Background
The equal employment opportunity commission is a united state federal agency,
authorized by congress, since the Civil Right Acts of 1964, to ensure to prevent
discrimination in the work place. The commission was first recognized in 1960, but the
commission was authorized in 1964 to watch the companies with discrimination practices
through lawsuit. The civil right act, in title vii of its law given commission the authority
to keep watch the employment practices of both the government and private employer.
The 1963 Equal Pay Act, Civil Right Act 1964(as mentioned above), 1967 Age
Discrimination Act, the 1990 American Disability Act, the 1973 Rehabilitation Act and
the 1991 Civil Right Act are the other laws that ensure equal employment opportunity in
the work place. These laws demand equal pay for equal work and prohibit discrimination
on the basis of gender, religion, race, disability or health status e.g. pregnancy etc. the
equal employment opportunity commission also ensure to stop the sexual harassment of
both the gender, practice by the private or government companies.
The equal employment opportunity commission also takes action through broad based
investigation to prevent hidden discriminatory hiring, promotion and pay practices. To
educate the companies and general public on what constitute discrimination, the
commission publishes pamphlet and report on hiring practices for worker and employers.
The employee can file claims with equal employment opportunity commission subject to
discrimination, if he/she feels that their rights are being violated.
The business sector severally criticized the commission by arguing that government
interferes in the private business sector.

1.2 Importance of EEO in Pakistan


As EEO is not implemented in its original form in Pakistan, therefore, as a result all most
each and every organization is affected by it. It is important to know one’s right in
organization regarding EEO, because here in Pakistan nepotism and favoritism is given
preference over merit.

1.3 Problem statement

The motive behind this report is to find out why EEO is not implementing
in Pakistan in its original form.

According to the World Bank report of 2001, that both in developed and developing
countries women faces disadvantages and unequal employment opportunities and
outcomes. Pakistan is no exception in this regard. Equal employment opportunity for
women in Pakistan is very low. Research state that women’s roles in public life are
discouraged, specially in Muslims majority countries, where women face patriarchal
customs (where men have full power and authority) and religious interpretations.
According to LFS 2005-2006(labor force survey) the Pakistani women’s role is below
20% in economic activities.
It is necessary to understand Pakistan’s commitment to equal employment opportunity,
the content and implementation of law at the national and international level and the
factors that causes the continuous disadvantages faced by its women.
In order to terminate the disadvantages experienced by the women and other ethnic
minorities, equal employment opportunity law is introduced in many western countries
for gender equality in employment. Equal employment opportunity is a government
attempt that all the people (male/female) have equal opportunities for employment,
regardless of race, religion, sex, color or national origin.
The concept of equal employment opportunity can be understood in two main ways given
by Jewson and Mason, 1986. The first concept is known as liberal approach, which treat
the men and women identically. The other concept is known as radical approach, which
state that both gender should be treated differently and necessary action must be taken
involving some better treatment or protection for women to ensure equality of outcomes
with their male counterpart. According to Cockburn, 1989, the liberal concept state that
both men and women are same and sex equality can be obtained, when employment
procedure and polices are same for both male and female. The liberal approach is
strengthening by the idea of “sameness” i.e. treating women like men. All the individuals
should be allowed to and judge within the workplace as individuals, irrespective of their
sex.
The radical approach to ensure equal opportunities is adopted by those who has strong
political and ethical values and recognize the disadvantages that certain group such as
women, minorities and disabled persons faced in employment. Those who agree with this
approach argue positive discrimination and affirmative action as the method for change.
